The applicant has also submitted applications to replat the property. The subject property is located south of 4th Avenue and west of CSAH 83 (please see Exhibit A). Attached as Exhibit B is a copy of the sketch of the easements proposed for vacation. DISCUSSION The attached resolution sets a public hearing for Tuesday, May 6, 2008. On that date, comments from staff members and utilities, as well as a recommendation from the Planning Commission, will be presented to the City Council for consideration. The Planning Commission will consider the request at its April 17, 2008 meeting. ACTION REQUESTED Approve Resolution No. 6758, a resolution setting the public hearing date to consider the vacation of easements within OPUS MVW and OPUS MVW 2nd Addition. h:\cc\2008\04-08\vac ph opus 08020,doc 1 RESOLUTION NO. 6758 A RESOLUTION SETTING THE PUBLIC HEARING DATE TO CONSIDER THE V ACA TION OF EASEMENTS WITHIN OPUS MVW AND OPUS MVW 2ND ADDITION WHEREAS, a request has been submitted for a determination by the Shakopee City Council that easements within OPUS MVW and OPUS MVW 2nd Addition serves no public use or interest; and WHEREAS, a public hearing must be held before an action to vacate can be taken and two weeks published and posted notice thereof must be given. WHEREAS, two weeks published notice will be given in the SHAKOPEE V ALLEY NEWS and posted notice will be given by posting such notice on the bulletin board on the main floor of the Scott County Courthouse, the bulletin board at the U.S. Post Office, the bulletin board at the Shakopee Public Library, and the bulletin board in the Shakopee City Hall. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, that a hearing be held in the Council Chambers on the 6th day of May, 2008, at 7:00 P.M. or thereafter, on the matter of vacating easements within OPUS MVW and OPUS MVW 2nd Addition.
