SUBJECT: Approval of a Registered Land Survey (RLS) - Northridge Court

INTRODUCTION
Scott County Community Development Authority (CDA) has submitted a request for an RLS
for property that is located adjacent to Northridge Court (Multi-Family Residential Complex
located at the northeast corner of 1 st Avenue West and Fuller Street North - Exhibit A).
BACKGROUND
The property in question is zoned Central Business (B-3) Zone. The applicant has stated that
the purpose of the request is that a split of torr ens property requires a RLS be recorded per
Minnesota Statutes #508.4 7. Tract A is, and would remain under the ownership of Scott
County CDA; whereas, Tract B falls entirely within the 1st Avenue West public right-of-way.
City Engineering has provided a memorandum regarding this project (Exhibit B),
commenting that a ten foot drainage and utility easement should be provided along the
Southeastern property line of Tract A. A condition requiring that easement has been
incorporated into the draft resolution.
ALTERNATIVES
1. Approve the requested Registered Land Survey, Resolution No. 6753, as proposed.
2. Approve the requested Registered Land Survey, Resolution No. 6753, subject to revised
conditions.
3. Do not approve the Registered Land Survey.
4. Table action on this item and request additional information from the applicant and/or staff.
ACTION REQUESTED
Offer Resolution No. 6753, a Resolution approving the Registered Land Survey, and move its
approval.

RESOLUTION NO. 6753
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA, APPROVING THE
REGISTERED LAND SURVEY FOR PROPERTY LOCATED AT THE NORTHEAST
CORNER OF FIRST AVENUE WEST AND FULLER STREET NORTH
WHEREAS, Scott County CDA, applicant and property owner, has submitted a
request for approval of a Registered land Survey for property that is located adjacent to
Northridge Court (l 5t Avenue West and Fuller Street North); and
as:
WHEREAS, the property upon which the request is being made is legally described
See Exhibit #1; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKO PEE, MINNESOTA, as follows:
That the Registered Land Survey submitted by Scott County CDA is hereby approved, subject to
the following conditions:
1. A drainage and utility easement measuring 10 feet wide shall be provided along the
Southeastern property line of Tract A.
BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby authorized
and directed to approve and accept said Registered Land Survey.
Adopted in session of the City Council of the City of Shakopee,

the South One Half (S 1/2) of Lot Four (4); and all of Lot Five (5); all in Block Five (5), in the City
of Shakopee, Scott County, Minnesota, according to the plat of Shakopee City on file and of record
in the Office of the Register of Deeds in and for said county and state. EXCEPTING therefrom all

The application indicates a request for approval of a Registered Land Survey (RLS) for the
parcels referenced above.
After reviewing the above referenced application, the engineering department has the following
comments for the applicant and the planning department:
1. Provide a total of ten (10) feet of drainage and utility easement along the southeastern
property line of Tract A.
Recommendation
Engineering staff recommends approval of the RLS request subject to the conditions above being
addressed by the applicant.
