B.2 · TO: Mayor and City Council Mark McNeill, City Administrator C~ n,'!J~~" OJ'' , , v, ",,,:,lj ~', /.', \",~ i" ~ , ' "I" __'\cf:, ':_:t, f.l:!-"- , ' lIi...H..{~' FROM: Captain Jeff Tate SUBJECT: Amendment to the Law Enforcement Mutual Aid Pact DATE: March 31, 2008 INTRODUCTION: Council is asked to approve an amendment to the Law Enforcement Mutual Aid Pact, which includes the addition of the Three Rivers Public Safety Department and the city of Elko New Market. BACKGROUND: The political subdivisions (cities of Belle Plaine, Elko New Market, Jordan, New Prague, Prior Lake, Savage, Shakopee, Three Rivers Public Safety Department, and the County of Scott) are requesting the signing of a Law Enforcement Mutual Aid Pact. The City entered into the current Mutual Aid Pact in 2002. The first amendment was in 2003 and it was last updated in 2004. The Mutual Aid Agreement allows the political subdivisions to assist each other in a time of need. The assistance would consist of equipment and personnel. The purpose of the attached additional amendment is to include the Three Rivers Public Safety Department, as well as the addition of Elko New Market. Each City Attorney has reviewed the document. VISIONING RELATIONSHIP: This action supports: Goal B - High Quality of life. Strategy 6: Provide high quality services ALTERNATIVES: 1. Approve the amendment to the Law Enforcement Mutual Aid Pact. 2. Deny the amendment to the Law Enforcement Mutual Aid Pact. 3. Table the amendment and provide staff with direction. RECOMMENDATION: Staff recommends approval of the amendment to the Law Enforcement Mutual Aid Pact. ACTION REQUESTED: The City Council, if they concur, should by motion approve the Third Amendment to the Law Enforcement Mutual Aid Pact and authorize appropriate city officials to execute the amendment. Attachment (1) Third Amendment To Law Enforcement Mutual Aid Pact THIRD AMENDMENT TO LA W ENFORCEMENT MUTUAL AID PACT This Agreement, dated this 8th day of April, 2008, is made and entered by and between the County of Scott, and cities located within Scott County, Minnesota. WHEREAS, the County and cities within Scott County have entered into a Law Enforcement Mutual Aid Pact in 2002, pursuant to Minn. Stat. S 471.59, hereinafter referred to as the Agreement, with the intention to make equipment, personnel, and other resources available to political subdivisions within Scott County from other political subdivisions and entities within said County; and WHEREAS, the parties desire to amend the Agreement to allow the participation to the agreement by the Three Rivers Public Safety Department; WHEREAS, section X of the Agreement provides that any amendments shall be valid only when expressed in writing and duly signed by the parties; WHEREAS, the cities of Elko and New Market have merged into one municipal corporation; NOW, THEREFORE, in consideration ofthe mutual covenants contained herein, and for other good and valuable consideration, the parties do agree as follows: 1. Section II, Definitions, "Eligible Party" of the Agreement shall be amended as follows: 3. The eligible parties are the cities/entities of Belle Plaine, Elko New Market, Jordan, New Prague, Prior Lake, Savage, Shakopee, Three Rivers Park District and the County of Scott, all ofthe State of Minnesota. 2. That all other provisions of the original agreement, except as amended herein, shall remain in full first force and effect.
