Action Sought
The Council is asked to open the Public Hearing, take public testimony and provide
direction on whether to order a project at this time or not.
Background
A public hearing was held on October 21, 2014 on the Hilldale Drive sanitary
sewer, watermain and street reconstruction project. The hearing was continued to
January 20, 2015 and then to February 17, 2015 to allow time to review the results
of a special benefit consultation.
Attached is a summary of the special benefit consultation which has determined the
benefits as follows:
•Extension of Sanitary Sewer, Water & Street Reconstruction - $28,000/Lot
•Extension of Sanitary Sewer & Street Reconstruction - $20,000/Lot
This information was provided to Shakopee Public Utilities (SPUC) and discussed
at their Feb. 2, 2015 meeting. SPUC would like to see the water system extended to
Hilldale Drive and passed a motion to extend the length of time property owners
have to connect to the water system from 3 years to 5 years.
A subsequent informational meeting with the residents of Hilldale Drive was
conducted on February 4, 2015. Attending the meeting were residents from 7 out of
10 lots.
In general, the residents appear to be in favor of extending sewer and water and
reconstructing the street but not at the price estimated. Attached is a statement and
signature page from the residents stating their concerns on the cost of the project
and other items they wish to see if this project moves forward. Overall, the
residents would like to have the assessments, connection charges, permits and fees
capped at $28,000 and allow a 20 year assessment term.
Also attached is a summary of the alternatives as well as drawings showing
improvements in each option. Staff will make a presentation at the Public Hearing
on the issues and options.
ISSUES:
Staff has identified four options for the Council's consideration:
1. Proceed with original project from the feasibility study - Sewer,Water and Street
Reconstruction
•Assessment - $28,000 (Benefit Consultation)
•Fees and charges - $12,687.88
•Extend connection requirement from 3 to 5 years
•Provide a longer assessment term (15 or 20 years)
2. Extend sewer, an 18" water transmission line and reconstruct the street
•Assessment and fees - $19,750
•Benefit Consultation max - $20,000
•Extend connection required from 3 to 5 years
•Provide a longer assessment term (15 or 20 years)
3. Extend 18" water transmission line and reconstruct the street
•Assessment for Street- $7,830
• 10 year assessment term
•No extension of water or sewer and therefore no assessment for water or sewer
4. Do nothing at this time.
If the Council were to vote to proceed with option 1, 2 or 3; work would take place
in 2016. Work cannot begin in 2015 due to the timeline for necessary right-of-way
acquisition.
Since the hearing of October 21, the City has revised the trunk sanitary sewer
charge for large rural lots to charge a maximum of 0.30 acre. The lots
on Hilldale Drive are over 1 acre in size. This charge resulted in decrease of
$2,119.39 per lot from the previous estimates.
At this point, the main issue is cost. Most residents have indicated they do want
sewer and water. The project is a city initiated project so a 4/5th vote of the Council
would be needed to order the project.
Scott County has previously submitted a letter strongly supporting the extension of
city sewer due to a concern that there is a high susceptibility for groundwater
contamination. Staff is checking to see if a Clean Water grant would be available to
assist with funding the project because of the groundwater contamination issue and
should have more information on this at the meeting. Attached is information
from Scott County on status and susceptibility map of Scott County showing that
Hilldale Drive is in the high susceptibility zone. It has been mentioned by the
residents that a new septic system is approximately $16,000. Two properties are on
the list for replacement by Scott County.
The benefit consultation analysis indicates a benefit of$28,000 which is the
maximum amount that can be assessed by law. Connection fees are not considered
assessments. However, they are additional costs that the property owner will incur
for obtaining sewer and water service.
Recommendation
For the Council to hear public testimony and provide further direction to staff.
If Option 1 is not acceptable to the Council due to the costs and residents's
concerns, staff would recommend strong consideration should be given to Option 2
as this would provide sanitary sewer, an 18" water transmission line and a new
street. This addresses Scott County's environmental concerns and stays within the
benefit analysis for assessments.
Budget Impact
If the project is approved, it will be funded by the sanitary sewer fund, storm sewer
fund, special assessments, the capital improvement fund and Shakopee Public
Utilities.
Relationship to Vision
This supports Goal E: Deliver effective and efficient public services by a staff of
well-trained, caring and professional employees.
Requested Action

Dear Mr. Loney:
At your request, we have investigated and analyzed probable special benefit to be derived
from the above-referenced street improvement project. Included in the City improvement
project is the reconstruction of bituminous-surfaced streets; installation of an 18-inch/8-inch
water main; installation of an 8-inch sanitary sewer main; and storm sewer improvements.
There will also be trail improvements along the north side of C.S.A.H. 16, extending from
Hilldale Drive to the existing trail to the east.
The purpose of this consultation is to provide an anticipated range of special benefit for
single-family residential properties in the proposed project area. The function of this analysis
is to provide guidance to the City of Shakopee in assessing the feasibility of the Hilldale
Drive Improvement Project.
In estimating anticipated special benefit to properties in the project area, individual
properties or land parcels have not specifically been appraised. Rather, this analysis attempts
to quantify probable special benefit directly, which can then be applied to typical properties
within the Hilldale Drive project area.
Based on the data and analyses as summarized in the attached report, as well as additional
information and documentation retained in the appraisers' files, it is anticipated that
properties benefiting from the proposed improvement project will be enhanced in value by at
least $28,000 per assessable unit/lot in the proposed project area.
This consultation has been made in conformity with accepted professional, ethical and
performance standards of real estate appraisal practice. The "Contingent and Limiting
Conditions" section of this report should be thoroughly read and understood before relying
on any information or analysis presented herein.

FINAL SUMMATION
Given the above, and considering the condition of the subject street improvements, and
also recognizing that the wells and septic systems are at or near the end of their
economic lives, we conclude to anticipated special benefit of at least $28,000 per
residential equivalent. This equates to 11.51% of the average assessed market value of
the subject properties.
Alternatively, if the project includes road reconstruction and extension of sanitary sewer
services only, the benefit to properties in the subject project area will be approximately
$20,000, which equates to 8.22% of the average assessed market value of the properties.

INDIVIDUAL SEWAGE TREATMENT SYSTEM COMPLIANCE FACT SHEET
Compliance Inspection Requirements. Scott County does not require a Compliance Inspection of an
Individual Sewage Treatment System (ISTS)when a home is sold. However, a Compliance Inspection
might be required by the buyer or lender. If you apply for a building permit through our Office, you may be
required to do a Compliance Inspection if we do not have enough information in our files to determine the
status of your existing ISTS. If an ISTS is failing, a replacement(alternate) ISTS location site must be
identified before we will accept most building permit applications for review (includes permits for horizontal
additions, accessory structures, bedrooms, etc.).
Schedule to Replace Failing ISTS. The table and map below applies only to an ISTS that has been
found through a Compliance Inspection (or self-declaration)to be failing or in noncompliance.

* A system that poses an imminent health threat is a system that discharges untreated sewage to the soil
surface, surface waters, field tile, or into the interior of a building.
** Vertical separation is the distance of sand or soil between the bottom of the distribution medium
(usually drainfield rock)and the top layer of seasonally saturated soil or bedrock. Three feet or more
vertical separation is required for systems installed after April 1, 1996, and for those systems located in
a Shoreland or Wellhead Protection Area or serving a Food, Beverage or Lodging Establishment. Any
other system is required to have two feet or more vertical separation.

COMPLIANCE INSPECTIONS ARE REQUIRED:
• When an inspection is done for any new or replacement Individual Sewage Treatment System (ISTS) or
Community Sewage Treatment System (CSTS).
• If a permit or variance is applied for to alter an existing ISTS or CSTS.
If a septic tank must be replaced or a drainfield trench added, the entire ISTS or CSTS must be inspected and
brought into compliance.
• Any other time an ISTS or CSTS is reviewed to determine if the system is in compliance.
Though not required by the County, this will most often be the result of a property sale or refinancing required
by a mortgage company.
• When a permit is applied for to build a horizontal addition onto an existing structure, or to build an
accessory structure on a lot having an ISTS.
This includes garages,pole sheds, barns, decks, gazebos, grain bins, 3 or 4-season porches etc. Even in the
case where the ISTS is failing, the permit can be issued without delay if there is sufficient area on the lot for
replacement of the ISTS. This can often be determined with existing data and is seldom a problem for farms
and large lots. However, small lots may need soil testing to verify this especially if the proposed structure will
take up a considerable amount of the remaining open space on the lot. This provision will only affect an
individual who has a failing ISTS and is requesting a permit to build something else on the only remaining place
on their lot.
• Any time the Scott County Zoning Ordinance No. 3 requires an inspection of an ISTS.
Conditional Use Permits, Variances etc.
• Before a building permit or variance is issued for a bedroom or the addition of a bedroom on property
served by an ISTS.
If the bedroom permit is applied for between November 1 and April 30, the Department may temporarily waive
the compliance inspection provided that the inspection is performed by June 1 or before an occupancy permit is
granted for the bedroom, which ever comes first. Any work done on the ISTS in order to issue a certificate of
compliance must be done by the following September 30. (State Law)
• Any time there is a change in use of a property (i.e. residential to commercial, commercial to industrial,
etc. or the addition of a business to a home).
If a residential home gets turned into a business or if a business that potentially increases water use is added to a
home the ISTS must be inspected to determine if it is in compliance.
• When any parcel of land is developed, subdivided, rezoned or split and there is an existing ISTS on any of
the parcels.
COMPLIANCE INSPECTIONS ARE NOT REQUIRED:
• For those systems that were previously permitted by this Department when acceptable information is
available regarding the installation of the ISTS and soil properties. The Inspector may require the
identification of an alternate site. The action proposed in the building permit application shall not
encroach upon the alternate site or the existing ISTS.
• For sale of property. However, compliance inspections might be required by the buyer or lender.

To the Members of Shakopee City Council, Mayor Tabke,Shakopee City Engineer,Shakopee
Public Utilities Commission, and City Clerk:
Statement:
The residents of Hilldale Drive are interested in moving forward with city water, septic sewer,
storm sewer, and road repairs if the following objectives can be agreed upon.
1) Special assessments, connection charges, permits, and fees at a sum no higher than
$28,000 maximum. It is understood that this cost will not include the expense

homeowner and it is the responsibility of each homeowner to cover their costs
associated with this connection.
2) We would like to have the option to pay the above costs extended over 20 years.
3) We have talked with several plumbers who install connections to city water and sewer
for other communities, and we would like to have the option to connect using plastic
piping to minimize costs to homeowners. Currently SPUC does not allow homeowners
to connect to city water and sewer with plastic, however several other Minnesota
communities both within the metro and greater Minnesota have ordinances that follow
Minnesota Statute 4715.0510(Water Service Pipe) &4715.0530(Building Sewers) &
4715.0420(Standards for Plumbing Materials).
4) We understand that permission must be given by SPUC in order to keep our personal
water wells after connecting to city water; we want to be assured that we will continue
to have the option to keep our wells after connecting for irrigation on our properties.
If these terms cannot be fairly negotiated and agreed upon,then we do not wish to move
forward with the project since the cost to each homeowner would be too expensive. It would
be cheaper for each of us to then replace and/or maintain our personal water wells and septic
systems for costs equal to or less than the cost listed above.
