No. 7536 (A, F) p 9 Action Sought If Council concurs, offer resolution No. 7536, A Resolution Accepting the work of Northwest Asphalt, Inc. on Riverside Field Park Improvements and Authorizing Final Payment, project PR 2012-1 Introduction This item is to request City Council's authorization to accept the work on Riverside Fields Park and approve the final payment to the General Contractor Northwest Asphalt, Inc. Background The construction of Riverside Fields Park was bid originally in 2012, bids were rejected and the project was rebid in 2013. The construction of Riverside Fields Park began in June of 2013 with the City issuing a general contract to Northwest Asphalt, Inc. Northwest Asphalt, Inc. was responsible for all construction elements, including site work, Tennis Court construction, hockey rink construction, trails, 1/2 basketball court and parking lot. The contract also included extension of the parking lot at Green Meadows Park. The project completion date was originally October 1, 2013. Northwest Asphalt, Inc did not meet the seeding window of August 20-September 1, 2013. In additional the weather did not allow for the tennis court painting to take place. The project date was therefore extended with the turf seeding and exterior painting to be completed in the spring of 2014. The contractor made an effort to obtain turf establishment in the spring/summer of 2014. The heavy rains in June made the turf establishment difficult. Additional seeding was completed and the turf was reviewed in October of 2014 and has shown improvement. According to the contract, liquidated damages could be assessed however because the contractor did make continued efforts to correct the areas the contractor has agreed to over seed the park in the spring under the warranty. The contract price was as follows: •total bid price of the project was: $569,921.16 •Change Order#1-10: +70,112.66 •Quantity work not required -31,452.30 •Amended contract price: $ 608,581.52 The total Construction CIP allocation was $614,600.00 including 6% contingency. By aggressively managing the contract, we were able to keep the change order costs to a minimum and complete the project under budget. The contractor has provided the City with a one-year performance and payment bond at 100% of the improvement costs. Relationship to Vision A. Housekeeping Requested Action If Council concurs, offer resolution No. 7536, A Resolution Accepting the work of Northwest Asphalt, Inc. on Riverside Fields Park Improvements and Authorizing Final Payment, project PR 2012-1 and move its adoption. Attachments: Resolution No 7536 RESOLUTION NO. 7536 A RESOLUTION ACCEPTING THE WORK OF NORTHWEST ASPHALT, INC. FOR THE RIVERSIDE FIELDS PARK DEVELOPMENT PROJECT, PR 2012-1 AND AUTHORIZING FINAL PAYMENT WHEREAS, pursuant to a written contract, signed with the City of Shakopee on May 6, 2013, Northwest Asphalt, Inc. has satisfactorily completed the Riverside Fields Park Development Project in accordance with such contract. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA that the work completed under said contract is hereby accepted and approved; and BE IT FURTHER RESOLVED, that the City Finance Director/City Clerk and Mayor are hereby directed to issue a proper order for the final payment plus retainage on such contract in the amount of$39,802.97, taking the contractor's receipt in full; and BE IT FURTHER RESOLVED, that Northwest Asphalt, Inc. has provided the City with a one year performance and payment bond for 100% of the contract price.
