Action Sought
Rahr Malting Company is requesting that the City Council review and approve their request to
vacate public rights-of-way, thus the City Council is asked to approve Resolution No. 7529.
Introduction
Rahr Malting Company has submitted an application for vacation of public rights-of-way
adjacent to their property in the area generally north of 2nd Avenue West, south of Spring
Avenue, west of Apgar Street, and east of Clay Street (see Exhibits B &D for general location).
Discussion
Rah has requesed that the public rights-of-way depicted be vacated as a part of Rahr's plan to
consolidate their property into a more manageable legal description, as well as more developable
parcels. Rights-of-way included in this request include portions of Pierce Street, Shumway
Street, and segments of alleys between Clay Street and vacated Apgar Street, north of 1st
Avenue. Should the vacation be approved, the applicant would proceed with a new plat that
would consolidate their property.
Considerations
City departments, Scott County and other outside agencies were given the opportunity to review
and provide comments regarding this application.
Planning staff have received comments from City Engineering, SPUC and CenterPoint Energy,
noting that there are several existing utilities located in these rights-of-way in addition to the need
for relocation of existing or installation of new service lines. They recommend approval of the
request, conditioned that the applicant either provide easements over these rights-of-way and/or
discuss processes for relocation of said services, with agreements that address the details and costs
involved with the relocation of services. Specifically, City Engineering will require information
and easements for public sanitary sewer and public storm sewer in Pierce Street right-of-way (see
attached memo), SPUC will require plat replacement easements as described in their memo
(attached to this report) and commitment from Rahr to work with SPUC on an agreement to
address cost responsibilities, and CenterPoint Energy will require that Rahr continue to work with
them on the relocation of their main (and provide the necessary easements over said main).
Alternatives
1. Approve Resolution No. 7529, a resolution approving a vacation of public rights-of-way,
subject to recording of drainage and utility easements over the rights-of-way, and/or entering into
agreements to address details and costs for the relocation of utilities.
2. Approve Resolution No. 7529, subject to revised conditions.
3. Do not approve the vacation request.
4. Table the decision to allow staff or the applicant time to provide additional information.
Planning Commission Recommendation
The Planning Commission considered the request at their December 4, 2014 meeting, and by a
6-0 vote, they recommended Alternative No. 1; recommend to the City Council the approval of
the vacation, subject to recording of drainage and utility easements over the rights-of-way, and/or
entering into agreements to address details and costs for the relocation of utilities.

ISSUE
Rahr Malting has requested the City to vacate various street and alley right of ways to facilitate their
proposed building projects as depicted on the attached drawings.
BACKGROUND
SPUC has both water and electric facilities in portions of these right of ways and I submitted a memo
to the City Planning Department commenting on Rahr's request with the statement that the City should
retain utilities easements over the right of ways or require Rahr to provide alternate easements to
enable the utilities to be relocated through the area around their building project and to enter into
agreements on the relocation costs.
DISCUSSION
I met with City staff and Rahr representatives to discuss the utility related issues this week and I
believe we have an acceptable understanding for proceeding forward.
Rahr will be required by the City to plat replacement easements for the existing utility facilities.
Specifically;Rahr will plat a 10 foot wide electric easement across all of their property north of First
Avenue connecting the non vacated alley right of way on either end that will accommodate relocating
the existing overhead feeder line underground into a multi circuit duct bank to be installed across
Rahr's parcel in coordination with their building project. Rahr will also plat a 20 foot wide water main
easement for the required water main that will provide the site with domestic service and fire
protection.
The exact water main route is to be determined with the building project plan,but it is likely to enable
the west end of First Avenue to be looped whereas up to now it has been a single feed dead end west of
Scott Street. Looping of the existing water main in that area of the system has been a goal for some
time. Also, some existing water main may have to be replaced to accommodate the site plan,but Rater
has been made aware of what SPUC will require and is agreeable. It is noted that due to the greater
EXIAANcr
public benefit resulting from the looping,Rahr would like to approach the Utilities Commission on a
cost sharing proposal once the design is more fully developed and costs are estimated.
I believe we can support the requested vacation of right of ways provided Rahr is required to plat
replacement easements and is committed to working with the Utilities Commission on an agreement
that indentifies each party's cost responsibilities consistent with the Commission's policies and past
practices.
REQUESTED ACTION
I request that this memo be forwarded to the City planning staff,Mark Noble, as an amended statement
of SPU's position on Rahr's vacation request.

Dear Mrs. Vidmar:
With reference to the Vacation request for Case log No. 14042 in Shakopee, MN.
CenterPoint Energy has a 2" distribution line running alongside Shumway Street and
down the alley to Pierce Street that you're asking to vacate. We have been working with
Rahr Malting Company, the new owner/developer of these properties and have a couple
of solutions were trying to put in place. CenterPoint Energy's first choice is relocating our
main along the County trail just south of these properties along County road 69 also
known as 151 Avenue West. CenterPoint Energy is in the process of acquiring a County
Permit to relocate into but if that isn't workable our second choice is acquiring an
easement from Rahr Malting Company, inside their property and with those two options in
place CenterPoint Energy has no objection to this proposal.

RESOLUTION NO. 7529
A RESOLUTION APPROVING A VACATION OF PUBLIC RIGHTS-OF-WAY
WHEREAS, it has been made to appear to the Shakopee City Council that public rights-of-way
adjacent to the Rahr Malting Company property in the area north of 2nd Avenue West, south of Spring
Avenue,west of Apgar Street, and east of Clay Street are no longer of public use or interest; and
WHEREAS, the public rights-of-way to be vacated are legally described in Exhibit A (attached);
and
WHEREAS, the Shakopee Planning Commission considered the request at its meeting of
December 4,2014, and unanimously recommended approval with conditions to the City Council; and
WHEREAS, a public hearing to consider the action to vacate was held in the Council Chambers of
the City Hall in the City of Shakopee at 7:00 P.M. on the 16th day of December,2014; and
WHEREAS, two weeks published notice will be given in the SHAKOPEE VALLEY NEWS and
posted notice will be given by posting such notice on the bulletin board on the main floor of the Scott
County Courthouse, the bulletin board at the U.S. Post Office, the bulletin board at the Shakopee Public
Library, and the bulletin board in the Shakopee City Hall.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE,MINNESOTA,THAT:
1. It finds and determines that the vacation of the City's interest in segments of public rights-of-way
north of 2nd Avenue West, south of Spring Avenue, west of Apgar Street, and east of Clay Street
hereinafter described is in the public interest.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE,
MINNESOTA,THAT:
1. Prior to recording Resolution#7529,the applicant shall provide the following:
a. For Pierce Street right-of-way, the applicant shall provide as-built/record drawing information
per requirement set forth in Section 11, Subdivision 2 of the City of Shakopee Design Criteria
of the public sanitary sewer and the public storm sewer shown in the requested vacation area in
order to verify its location and depth.
b. The applicant shall dedicate a drainage and utility easement to satisfy requirements set forth in
Section 10, Subdivision 1.A of the City of Shakopee Design Criteria.
c. The applicant shall provide replacement easements as described in Shakopee Public Utilities
memo, dated December 4, 2014 [Exhibit F(1)], and shall provide Shakopee Public Utilities an
agreement to address cost responsibilities for the relocation/installation of water and electric
utilities consistent with the Utilities Commission policies and past practices.
d. The applicant shall provide the necessary easements for the relocation of CenterPoint Energy's
2" distribution line (presently running alongside Shumway Street and down the alley to Pierce
Street), and shall provide an agreement to CenterPoint Energy that addresses cost
responsibilities for the relocation/installation of their gas utilities.
After the adoption of the Resolution, the City Clerk shall file certified copies hereof with the County
Auditor and County Recorder of Scott County.
