SI-LAKOI'EE TO: Mayor and City Council Mark McNeill, City Administrator FROM: Chris Dellwo, Captain DATE: 12/16/2014 SUBJECT: A Resolution of the City of Shakopee, Minnesota Accepting the Donation of$5,000 from Fairmount Minerals-Res. No. 7530 (A) Action Sought The City Council is asked to adopt resolution No. 7530, a Resolution of the City of Shakopee, Minnesota, accepting the donation of$5,000 from Fairmount Minerals to be used by the police department for equipment acquisition. Background Fairmount Minerals, doing business locally as Shakopee Sand LLC, has graciously offered a $5,000 cash donation to the police department to be used toward the acquisition of two mobile biometric fingerprint identification scanners. These scanners aid in identifying persons whose identity is in question by scanning fingerprints and having those fingerprints run through a State fingerprint database all while in the field. Under MN State Statute 465 03 Acceptance of Gifts, the statute requires the "acceptance of every grant or devise of real or personal property on terms prescribed by the donor made by resolution of the governing board, adopted by two-thirds majority of its members". Compliance with this statute has been confirmed with the City audit staff. Recommendation Staff recommends approval of Resolution No. 7530. Budget Impact None. The acquisition cost of the technology purchase is covered by the donation. Relationship to Vision A. Keep Shakopee a safe and healthy community where residents can pursue active and healthy lifestyles. Requested Action If Council concurs, it should, by motion, approve Resolution No. 7530, a Resolution of the City of Shakopee, Minnesota, Accepting the Donation of$5,000 from Fairmount Minerals, as required under MN State Statute. Attachments: Resolution 7530 RESOLUTION#7530 A RESOLUTION OF THE CITY OF SHAKOPEE,MINNESOTA,ACCEPTING THE DONATION OF $5000 FROM FAIRMOUNT MINERALS WHEREAS, on November 6, 2002, the City Council adopted resolution No. 5794,which established procedure relating to the receipt of gifts and donations by the City; and WHEREAS, Resolution No. 5794 specifies that donations or gifts shall be accepted by resolution of the City Council, and shall require a two-thirds majority of the Council for acceptance; and WHEREAS, Fairmount Minerals, doing business locally as Shakopee Sand LLC, has generously donated$5000 to be used by the police department for equipment acquisition; and WHEREAS, such donation will be used by the police department to purchase two mobile biometric fingerprint identification scanners; and WHEREAS, such technology will enhance the capabilities of the police department to maintain a safe and healthy community. NOW, THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA,that the donation is gratefully accepted; and FURTHER,the City staff is directed to send a letter to the donor, acknowledging receipt of the gift and expressing the appreciation of the City Council.
