TO: Mayor and City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director DATE: 10/21/2014 SUBJECT: Public Hearing for the Hilldale Drive Improvements Project No. 2014-3 (E) Action Sought Open the Public Hearing, take public testimony and decide whether or not to order the project, or to table for more information. Background A preliminary feasibility report was ordered on September 7, 2013 by Resolution No. 7356 and this report was received on September 2, 2014 by Resolution No. 7478. The feasibility report was requested by the residents and included a request for consideration of rezoning of the area. The two petitions are attached for Council review. The improvements listed in the report are for sanitary sewer, watermain and reconstruction of Hilldale Drive as well as a bituminous trail from Hilldale Drive to Kensington Estates. On September 17, 2014 an informational meeting was held with the residents of Hilldale Drive with City and SPUC staff in attendance. The agenda of this meeting is attached and the project improvement and costs were the main items of discussion. On October 7, 2014, a statement of concern and petitioning from the residents of Hilldale Drive was received by the City Council. The essence of this petition is that the residents oppose moving forward at this time unless their concerns, project costs and assessments are properly addressed. The main objections are the cost of assessments and charges per lot, and the proposed trail connection from Kensington Estates to Hilldale Drive. ISSUES: COST OF ASSESSMENTS, TRUNK CHARGES AND FEES The estimated cost of the assessment for sanitary sewer, watermain and 30% of street reconstruction is $28,780 per lot. The additional cost of trunk charges, water connection fees and SAC charges is approximately $14,486 per lot, and is usually paid at time of a building permit for sewer and water connection. Attached is a summary of charges and fees for 2014. Staff did not do a special benefit appraisal for any of the lots. However, a general area consultation report could be done to provide information on the benefit of sewer and water to this area. Attached is a proposal from Patchin Messner Dodd& Brumm to do a special benefit analysis. The cost of the report is estimated at$8,000 and could be completed by mid-December. This report would provide the City with guidance to the feasibility of this project. CONDITION OF INDIVIDUAL SEWAGE TREATMENT SYSTEMS (ISTS) Attached also is a letter from Scott County on the existing ages of ISTS's along Hilldale Drive with an analysis of the septic systems in the area. The County strongly supports the connection to city sewer and also has a concern due to the high susceptibility to groundwater contamination that could affect water wells. FINANCING OF PROJECT The City in 2007, did install city sewer and take over a private water system of Beckrich Estates and did assess the trunk charges and water connection fees with the assessments. The City did so with the signing of assessment waivers by the residents. The City could also consider extending the assessment term from 10 years to 20 years and Julie Linnihan, Finance Director, can address this at the hearing. EXTENSION OF TRUNK WATER FOR SPUC This project includes an 18" watermain which provides for transmission of water from the CR 18 water storage tank to other parts of the City. SPUC would like to have this line installed by 2016. SPUC is paying for oversizing of the pipe in the study. One option the City and SPUC could consider is to do a project to install sanitary sewer, extend the 18" trunk watermain and reconstruction of Hilldale Drive. It would NOT include the provision of individual water services at this time. This would take more investigation on both the City and the Utility. BITUMINOUS TRAIL CONNECTION FROM HILLDALE DRIVE TO KENSINGTON ESTATES The trail extension is in CR 16 right-of-way and would connect Hilldale Drive to Kensington Estates trail. The 18" watermain would be under the trail. In the County's TIP, there are no improvement projects currently proposed for CR 16 from CR 21 to CR 18. With no projects planned, it will be several years to complete the trail along CR 16 unless it is done as a separate project. The City's practice is to construct trail segments along county roads and city collectors whenever possible. This trail connection is being paid for out of CIF funds. Staff will make a presentation at the Public Hearing of the report and the issues. The main issues are whether to move forward with the project, and if not, when to move forward and at what cost? The project is a city initiated project so a 4/5th vote is needed to order the project. For this project, the alternatives are as follows: 1. To direct the preparation of a resolution ordering the project and the preparation of plans. 2. To approve a motion to not move forward on this project. 3. Table for further information as directed by the City Council. As mentioned previously, the main issue with the residents is the cost of installing sewer and water. A special benefit analysis as proposed to be done by Patchin, Messner, Dodd&Brumm would give the Council and property owners a range of the benefits received by this project. If Council does not want to proceed with the special benefit analysis, then a motion to not move forward is in order due to the lack of support by the property owners. If the Council believes this area should have sewer and water at this time, then directing staff to prepare a resolution ordering the project would be in order. Recommendation Based on the last petition received where the residents oppose the project unless project assessments are addressed, staff recommends a special benefit analysis be done, and that the Council table action on the project until this analysis is completed. The Council can continue the public hearing until the special benefit analysis is presented and if continued, the continuation should be to a specific date. If so, staff recommends continuing to January 20, 2015. It should be noted that with additional information needed and additional right-of-way for a project if approved, that this would not be 2015 project. Budget Impact This project was included in the 2015-2019 CIP. Funding of project was to be through assessments, sanitary sewer fund, Shakopee Public Utilities and CIF (Trail). Relationship to Vision This supports Goal E: Deliver effective and efficient public services by a staff of well-trained, caring, and professional employees. Questions and Answers A trail will be constructed on the north side of CSAH 16 from Hilldale Drive to the existing trail to the east. The total estimated cost to construct the trail is$10.000. 6. SPECIAL ASSESSMENTS 6.1 Street 30% of the project costs for the street improvements are proposed to be assessed on a per lot basis. The remaining 70% of the street improvements are proposed to be funded by the sanitary sewer fund. 6.2 Storm Sewer 100% of the project costs for the storm sewer improvements are proposed to be assessed on a per lot basis. 6.3 Sanitary Sewer 100% of the project costs for the sanitary sewer improvements are proposed to be assessed on a per lot basis. 6.4 Watermain Shakopee Public Utilities will pay oversizing costs associated with oversizing the watermain from an 8-inch to an 18-inch. SPU will also pay a majority of the costs to loop the watermain to Glacier Estates. The assessable costs for the watermain loop to Glacier Estates will be capped at $1 2,000. All other project costs for the watermain improvements are proposed to be assessed on a per lot basis. 6.5 Trail 100% of the project costs for the trail improvements are proposed to be funded by the Capital Improvement Fund. The estimated assessment rate for the proposed improvements is $28,780.00 per lot. Actual assessments will be based on the final project costs and apportionments. Prior to extending sanitary sewer to the area MUSA will need to be extended and the area will need to be rezoned. If a property owner request an additional sewer service to be extended to the property at this time to accommodate a future lot split it is proposed to assess the property an additional unit. 7. ESTIMATED COSTS An itemized cost estimate is included in the Appendix. The following costs were prepared using 2013 construction costs and are subject to change, depending on the final design of the project, bids received, and actual work performed. CONCLUSION From an engineering stand point the improvements are feasible, cost effective and necessary to extend sewer and water service to the area. Upon hearing this meeting and reviewing the Preliminary Engineering Report for the project there are several concerns associated with the proposed improvements. 1) It is evident that there will be an economic hardship for several of the homeowners that reside along Hilldale Drive. Each homeowner that lives along Hilldale Drive is responsible for paying an assessment of$28,780 per lot and excluding the homeowners physical connection from house to street, the final cost will exceed more than$41,000, a rather large sum. 2) The proposed trail is expected to be paid for using Capital Improvement Funds; however,trail construction is not listed under the Capital Improvements Program, Extend Sewer and Water to Serve Hilldale Drive Project. The initial petition from the residents of Hilldale Drive did not request any type of trail improvement, only sewer and water. Additionally, in the future the trail may have to be moved if CSAH 16 is expected to be expanded resulting in additional expenses and waste of funding. 3) The cost of connecting to city sewer and water far exceeds the cost to maintain, operate, and updated personal septic systems and wells. It would be understandable if the improvement costs were comparable. 4) The proposed watermain improvements not only benefit residents of Hilldale Drive, but also residents in Glacier Estates, Kensington Estates,and Dakota Crossing however,the assessments for these two watermains lie entirely on the residents of Hilldale Drive. The assessment for these improvement benefits should be shared. 5) The recent addition of Dakota Crossing, developed by Ryland Homes, and the inability of the developer to complete their connection to CSAH 16 and disconnect Hilldale has led to several of the contractor vehicles using Hilldale and further degradation of the road,yet Ryland Homes was not identified in any part of the improvements costs within the Preliminary Engineering Report. Based on the aforementioned concerns listed, we the homeowners of Hilldale Drive oppose moving forward on City Project No. 2014-3 at this time unless these concerns,project costs, and assessments are properly reviewed and addressed. As discussed, our firm will investigate and analyze probable special benefit to ten residential properties fronting Hilldale Drive, north of County Road 16, from the proposed street reconstruction project, including the extension of municipal sewer and water services. As a consultation, we will provide an anticipated range of special benefit for the residential properties in the proposed project area. The function of this analysis is to provide guidance to the City of Shakopee in determining the feasibility of this project. While no specific properties will be appraised, the anticipated value enhancement of the proposed project will be expressed on a per assessable unit/lot basis. In order to estimate probable benefit, the following methodology will be employed. 1) Research other similar projects in comparable residential neighborhoods in the metropolitan area. 2) Investigate sales that sold before and after similar street, sewer and water improvement projects occurred, in order to isolate anticipated benefit. 3) Investigate compliance of the existing septic systems and wells, as well as alternative costs for replacing these private wells and/or septic systems. DATE: October 15, 2014 SUBJECT: Municipal Sewer Service to Hilldale Dr. Residents This regards the proposal to bring municipal sewer service to residents on Hilldale Dr. As shown in the table below, our records indicate that the septic systems on Hilldale Dr. are the original systems installed when the homes were built, except for 1975 Hilldale Dr.which was replaced in 2001. The remaining nine systems were installed between 1975-1983. The average functional life of a septic system is approximately 30 years, but that timeframe varies greatly depending on its use and maintenance. Since the original nine systems are all over 30 years old, it is likely that these systems will have to be replaced before too long. We also do not have any septic tank pumping records for two systems (see Recent Pump Date in table),so it is much more likely those systems are already failing or will be failing soon. Inspections are also often required by the buyer or lender when the property is sold. If the septic fails the inspection for any reason in this area,the County requires replacement of the septic within ten months of the inspection date. This timeline for replacement is more strict in this area because the groundwater is considered highly susceptible to contamination (see below for more detail). Two residents have had septic compliance inspections done that failed, and both are on a County timeline to replace their septic systems (see Must Install By Date in table). We have not yet required replacement of the septic system at 2041 Hilldale Dr. because the Scott County septic ordinance has a provision to delay that requirement if municipal sewer service to the lot is likely within five years. However,those two owners will be required to replace their septic systems if municipal sewer service is not provided within the next several years. An Equal Opportunity/Safety Aware Employer Page 2 Scott County strongly supports this area being connected to municipal sewer for the following reasons: • Hilldale Dr. is located in an area that is considered highly susceptible to groundwater contamination. This means that drinking water wells are more likely to be negatively impacted by septic systems. For example,our records since the 1980s show that ten wells located along County Road 16 to the west of Hilldale Dr. have tested high for nitrate contamination (which often comes from nitrogen fertilizer and septic systems). • Since the surrounding area north of County Road 16 will be fully developed after the current projects are completed,this might be the last chance for owners to have area development pay for some of their sewer connection costs. • Most of the lots are relatively small by County standards for having a well and septic system. As a result, many owners likely will have trouble finding a suitable location for a replacement septic system. In addition, if municipal service is not made available for 20 years or longer, some owners could be facing having to replace their system more than once, and finding two acceptable septic sites will be even more difficult.
