St-.\KOI'EE TO: Mayor and City Council Mark McNeill, City Administrator FROM: Jeff Weyandt, Assistant City Engineer DATE: 10/21/2014 SUBJECT: Public Hearing for the East Shakopee Industrial Sewer Improvement Project,No. 2013-4, Res. No. 7499 (E) Action Sought Adopt Resolution No. 7499, a resolution which adopts the assessment for the East Industrial Sewer Improvements, Project No. 2013-4. Background On July 16, 2013, City Council adopted Resolution No. 7331, approving the plans and specifications and ordering the advertisement for bids for the East Industrial Sewer Improvements, Project No. 2013-4. On March 18, 2014, City Council adopted Resolution No. 7429, a resolution which accepts the bids and awards the contract for the East Industrial Sewer Improvements Project. The improvements have essentially been completed with the final costs for construction at$362,500.00. The total costs associated with administration, financing and engineering for the project is $203,499.50. Recommendation Staff recommends adopting Resolution No. 7499 which adopts assessments for the East Industrial Sewer Improvements Project. Budget Impact This project has essentially been completed and all project costs identified. The final project cost is $565,999.50, which consists of construction costs, financing costs and engineering/administration costs. A breakdown of the project costs are as follows: DESCRIPTION AMOUNT Assessments $ 503,944.50 Union Pacific Railroad $ 60,000.00 Shakopee Public Utilities ' $ 2,055.00 TOTAL PROJECT COSTS = $ 565,999.50 Project costs are proposed to be assessed on a per acre basis to the benefiting properties. The proposed assessment rate is $4,065.05 per acre. The City has an agreement regarding payment of special assessments for $60,000.00 with Union Pacific Railroad. RESOLUTION NO. 7499 A Resolution Adopting Assessments For The East Industrial Sewer Improvements Project No. 2013-4 WHEREAS, pursuant to proper notice duly given as required by law, the City Council of the City of Shakopee met and heard and passed upon all objections to the proposed assessments of: Properties abutting vacated Cretex Avenue;and CSAH 101 and Stagecoach Road from 70th Street to 200' south of TH 169. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE,MINNESOTA: 1. That such proposed assessment together with any amendments thereof, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named herein and each tract therein included is hereby found to be benefitted by the proposed improvements in the amount of the assessments levied against it. 2. Such assessments shall be payable over a period of ten years, the first installment to be payable on or before the first Monday in January, 2015, and shall bear interest at the rate of 5.00 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added the interest on the entire assessment from the date of this resolution until December 31, 2015 and to each subsequent installment when due shall be added the interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment,to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within thirty(30)days from the adoption of this resolution;the owner may thereafter pay to the County Treasurer the installment and interest in process of collection on the current tax list, and may pay the remaining principal balance of the assessment to the City Treasurer. 4. The Clerk shall file the assessment rolls pertaining to this assessment in her office and shall certify annually to the County Auditor on or before November 30th of each year the total amount of installments and interest on assessments on each parcel of land which are to become due in the following year.
