INTRODUCTION:
City Council is asked to consider an application from Mr. Brian
Compton for a taxicab driver's license.
BACKGROUND:
Mr. Brian Compton has made application for a taxicab driver's
license. An application for a taxicab driver's license is
approved or denied by the Issuing Authority and may be appealed to
the City Council.
The customary background investigation has been conducted by the
Police Department. Sergeant Bob Forberg has recommended denial of
the license. Based upon review of Mr. Compton's application and
based upon the report from Sergeant Bob Forberg, staff denied the
application from Mr. Compton for.a taxicab driver's license. Mr.
Compton wishes to appeal to the City Council.
City Code Section 6.02, Subd. 4. False Statements. It is
unlawful for any applicant to intenti<;:>nally make a false statement
or omission upon any application form. Any false statement in
such application, or any willful omission to state any information
called for on such appiication form, shall, upon discovery of such
falsehood work an automatic refusal of license, or if already
issued, shall render any license or permit issued pursuant
thereto, void, and of no effect to protect the applicant from
prosecution for violation of this Chapter, or any part hereof.
City Code Section 6.22, Subd. 15.C. Grounds for Denial of
Driver's License. Falsification of an application for a taxicab
driver's license constitutes grounds for denial of the license or
renewal.

1. Grant a license to Mr. Compton
2. Deny a license to Mr. Compton
3. Table application for additional information
RECOMMENDED ACTION:
After hearing from the applicant and any other appropriate
parties, determine whether or not to:
Approve the application and grant a Taxicab Driver's License to
Brian Compton, 16466 Inguadona Beach Circle, Prior Lake, MN 55372.

Judy, it is my recommendations that the City of Shakopee deny Compton a Taxi
Drivers License due to his failure to disclose any criminal convictions.

Taxicab Driver License Application - Brian Compton
On January 24,2008 Mr. Brian Compton filed an application for a taxicab driver's license with
the city. The following day the police department opened a background investigation on the
applicant (case# 08001109). This background investigation was concluded on February 13,
2008 with a recommendation of denial from Sgt. F orberg. The denial of the application was
based on Mr. Compton's failure to disclose a criminal conviction. According to Shakopee City
Code 6.22 subd. 15( c)
Falsification of an application for a taxicab driver's license constitutes grounds for
denial of the license or renewal.
On February 22,2008 Mr. Compton filed another taxicab driver's license application with the
city. On, or around this date, Sgt. Forberg advised Mr. Compton that this was not the proper
procedure to appeal the earlier denied application. Proper procedure for the appeal of a denied
license application is contained in Shakopee City Ordinance 6.22 subd. 14 (a)
If the application is rejected, the applicant may request a personal appearance before
the Council to offer evidence why the application should be reconsidered.
As you are aware Mr. Compton has been granted time on the March 5, 2008 Council agenda to
appeal the rejection of his original taxicab license.
