Code Relating to Massage Therapy Businesses (A)
Action Sought
The Council should adopt Ordinance No. 895, which would authorize a licensed massage therapy
business to perform massage therapist services at off-site business locations.
Background
A local business which currently provides massage therapy services has contacted the City
to request a change in City Code that would permit contracted massage therapists to perform
off-site massages at business locations in the community. What is desired is that their employees,
working under a separately licensed business would perform chair massages. Local
companies would contract with this new provider, and payment would be made directly to it. The
employees, however, would be paid by the existing massage therapy company. All massage
therapy staff will be properly licensed.
If approved, this would allow chair massages to be performed in Shakopee, for such things as
wellness events. If the massage therapy business performs its services in other communities, it
will need to comply with those local regulations.
The City Attorney has provided the suggested language in the attached ordinance. As shown,
Subdivision 6 already allows exceptions for "on-premise" services--for clients and residents
of places of care (hospitals, nursing homes, etc.) or in connection with a special event or function.
Recommendation
I recommend the following language be added to Ordinance Number 895:
3. At the location of any business in the City that contracts with a licensed massage therapy
business to perform massage therapist services at the site of the contracted business.

None.

This supports Goal A, "Keep Shakopee a safe and healthy community where residents can pursue
active and quality lifestyles."
Requested Action
If the Council concurs, it should, by motion, adopt the following Ordinance:

AN ORDINANCE OF THE CITY OF SHAKOPEE AMENDING
SHAKOPEE CITY CODE SECTION 6.45 SUBDIVISION 6,PARAGRAPH A RELATING
TO MASSAGE THERAPY BUSINESSES
THE CITY COUNCIL OF THE CITY OF SHAKOPEE,MINNESOTA,ORDAINS:
Section 1. Section 6.45, Subd. 6, Paragraph A of the Shakopee City Code is amended to read as
follows:
Subd. 6. Restrictions and Regulations. All massage therapy business licensees and massage
therapist licensees must comply with the following restrictions and regulations:
A. A massage therapy business must not provide massage therapy services at any
location other than the premises identified on the license, except a licensed
massage therapist employed or contracted by the massage therapy business
licensee may provide massage therapy services in the following circumstances:
1. To a client at the client's residence or place of care if in a long- or short-
term care facility, such as a hospital, nursing home, or convalescence
facility; or
2. In connection with a special event or function whereby the massage
therapist provides massage services to attendees of the event or function.
3. At the location of any business in the city that contracts with a licensed
massage therapy business to perform massage therapist services at the site
of the contracting business.
Section 2.Effective Date. This ordinance becomes effective from and after its passage and publication.
