C. 4. sViAKOPEE TO: Mayor and City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director DATE: 10/07/2014 SUBJECT: Approve an Extension of Work Hours on CSAH 17 /Vierling Drive (D) Action Sought Offer a motion approving a suspension of City Code Sec. 10.60,Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, allowing nighttime work from 9:00 PM to 7:00 AM from October 13-October 31 to minimize traffic impacts and safety as authorized by the city engineer and direct staff to publish notice of the suspension terms with the conditions as recommended by staff. Background The Contractor and Project Manager from Bolton&Menk, Inc. are requesting that City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, be suspended for certain work hours to allow nighttime milling and paving to minimize the traffic impacts on CSAH 17 & Vierling Drive. The above named section of the City Code restricts the hours of operation from 7:00 AM to 10:00 PM on weekdays, and from 9:00 AM to 9:00 PM on weekends and holidays. The Project Manager is requesting suspension on the hours as per the attached email to allow for work between the hours of 9:00 PM to 7:00 AM, beginning October 13 to October 31, 2014 and as authorized by the city engineer. This nighttime work may or may not be used depending on weather or other circumstances but provides the option of constructing the pavement at night to minimize traffic impacts and improve work safety. Nighttime work would still need city engineer approval as to the days and hours allowed. This request is to minimize traffic impacts during the day as the paving operations could have significant delays during the daytime traffic. It is anticipated that milling of existing pavement will take one night and paving will take 2 to 3 nights. Staff would recommend that if the suspension of hours is granted, that the approval is subject to the following conditions: 1. Approval is contingent upon minimizing noise exposure 2. The suspension can be revoked at the discretion of the City Engineer and the nightitme work can only occur with the approval of the city engineer. If Council approves the suspension, a public notice to meet the City Code requirements and notice such as a news release would be placed in the Shakopee Valley News. Recommendation Staff recommends approving the suspension of City Code Sec. 10.60,Noise Elimination and Noise Prevention, subd. 3, Hourly Restrictions on Certain Operations, per this memo, and direct staff to publish notice of suspension terms with the conditions as recommended by staff. Budget Impact There is no impact on the budget. Cost of paving at night will not be an extra cost to the project. Relationship to Vision This supports Goad D: Maintain, improve and create strong partnerships with other public and private entities. Attachments: Extended Working Hour Request Bruce Loney From: Kyle Johnson Sent: Monday, September 29, 2014 1:50 PM To: Bruce Loney(bloney @shakopeemn.gov) Cc: Aaron Schmidt; rthomson @shakopeemn.gov Subject: Extended Working Hour Request Bruce— During the CSAH 17/Vierling Drive weekly construction meeting held on September 23, 2014, nighttime milling and final paving operations were discussed as an option to minimize traffic delays during construction.The advantages and disadvantages of nighttime operations on project safety and the quality of the final product were also discussed in detail.Since the milling and paving operations would not commence until after October 13, it was decided to continue discussions on this topic at later construction coordination meetings.Since extended working hours need to be authorized by the City Council, I would like to formally request extended nighttime working hours from October 13 to October 31 in the event that all parties decide that nighttime work is the best option available.The wide date range is requested to account for unforeseen weather or construction delays.
