TO: Mayor and City Council ~."~.~.w_ Mark McNeill, City Administrator FROM: Julie Klima, Planner II SUBJECT: Approval ofa Registered Land Survey (RLS) - Dean Lakes 4th Addition DATE: September 19,2006 INTRODUCTION Ryan Companies has submitted a request for an RLS for property that is located south of Highway 169, north of Dean Lakes Blvd, and west of Bulrsuh Blvd (extended) (please see Exhibit A). BACKGROUND The property in question is zoned Business Park (BP). The. purpose of the request is to reconfigure the existing lot lines in order to allow for the creation of parcels for specific user(s). . Please see Exhibit B. The proposed lots would exceed the minimum lot widths/lot depth requirements and and any proposed structure(s) on Tracts A, B, or shall comply with all applicable design and performance standards (including complying with minimum lot setbacks and the maximum allowed lot coverage) as stipulated in the City Code or in the approved PUD for the development. This RLS is proposed in conjunction with an application for vacation of easements. Because the applicant is requesting to reconfigure.lot lines with the RLS application, the easements dedicated with the original lot lines are requested to be vacated. The Council has scheduled a public hearing on the vacation request for October 3. City Engineering has provided comments (Exhibit C), noting that a ten foot drainage and utility easement should be centered on the lone lines between Tracts A and B and Tracts B and C. Currently, the applicant has provided a copy of a drainage and utility easement to be dedicated which is located on the lot line between Tracts A and B. A condition requiring that an easement also be provided on the lot line between Tracts Band C has been incorporated into the draft resolution. Because formal action on the vacation is not expected until October 3, staff is recommending that the RLS be approved conditioned upon the approval of the pending vacation application. ALTERNATIVES 1. Approve the requested Registered Land Survey, Resolution No. 6485, as proposed. 2. Approve the requested Registered Land Survey, Resolution No. 6485, subject to revised conditions. 3. Do not approve the Registered Land Survey. 4. Table action on this item and request additional information from the applicant and/or staff. ACTION REQUESTED Offer Resolution No. 6485, a Resolution approving the Registered Land Survey, and move its approval. r/~ J ie Klima P anner II h:\cc\2006\09-19\06080rls dean lakes 4th. doc RESOLUTION NO. 6485 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA, APPROVING THE REGISTERED LAND SURVEY FOR PROPERTY LOCATED WITHIN DEAN LAKES 4m ADDITION WHEREAS, Ryan Companies, applicant and property owner, has submitted a request for approval of a Registered land Survey for property that is located within Dean Lakes 4th Addition; and WHEREAS, the property upon which the request is being made is legally described as: Lots 2, 3, 4, and 5, Block 1, Dean Lakes Fourth Addition, files of the Registrar of Titles, Scott County, Minnesota; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, as follows: That the Registered Land Survey submitted by Ryan Companies is hereby approved, subject to the following conditions: 1. Drainage and utility easements measuring 10 feet shall be provided and centered on the lot lines between Tracts A and B and between Tracts B and C on Tract B as per the requirements set forth by the City Code. 2. Provide electronic CAutoCAD) files ofthe RLS to the City Engineering Department. 3. Approval of the RLS is contingent upon the approval of the pending application for vacation of easements within Dean Lakes 4th Addition. 4. Developer shall pay existing levied special assessments or may request that special assessments be reapportioned against new lots. If request is approved, developer shall pay the current fee for reapportioning assessments and agree to the City Engineer's reapportionment. BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby authorized and directed to approve and accept said Registered Land Survey. The proposal coincides with a vacation of easement request (case number 06081) to accommodate a specific user. After reviewing the above referenced application, the engineering department has the following comments for the applicant and the planning department: 1. Provide a total of ten (10) feet of drainage and utility easement centered on the lot line between Tract A and Tract B. 2. Provide a total of ten (10) feet of drainage and utility easement centered on the lot line between Tract B and Tract C. Recommendation Engineering staff recommends approval of the RLS request subject to the conditions above being addressed by the applicant.
