CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Consider A warding a Contract for the Pheasant Run Storm Sewer Improvements, Project No. 2006-7 DATE: September 5,2006 INTRODUCTION: Attached is Resolution No. 6480, which accepts the bids and awards a contract for the Pheasant Run Storm Sewer Improvements, Project No. 2006-7. BACKGROUND: On July 18, 2006, City Council adopted Resolution No. 6456, which approved the plans and specifications and authorized staff to advertise for bids for the Pheasant Run Storm Sewer Improvements, Project No. 2006-7. On August 24, 2006, a bid opening was held for the Pheasant Run Storm Sewer Improvements Project, in which there were seven bids opened for this improvement project. The bids are summarized in the attached resolution. Prom the bid opening, the apparent low bidder is Chambers Excavating & Trucking, Inc. with a bid of $52,905.40. The Engineer's estimate for this project is $69,000.00. This project will be a difficult one to construct due to the number of easement encroachments by the adjacent property owners. Retaining walls, gardens, fences, sprinkler systems, trees and other miscellaneous landscaping items are located within the existing . easements. Due to the substantial landscaping located within the City's easements, it will be difficult to return the site to the existing condition. Chambers Excavating & Trucking is a small company form North Mankato that has not worked in the City before. We called references provided to us by the contractor and received positive feedback from the Department of Natural Resources, the. North Mankato BRA and the Waseca BRA. The project was bid to salvage and reinstall all landscaping within the City's easements. Staff has had meetings with the residents affected on the project and informed them that the City will restore their property. Staff will want to discuss with the Council, on future proj ects, on whether the City should pay for encroachments in the right-of-way or easements. If Council awards the contract, staff is also requesting a contingency amount equal to 5% of the contract to cover minor change orders and quantity adjustments that may occur on the project. ALTERNATIVES: 1. Accept the low bid of Chambers Excavating & Trucking and adopt Resolution No. 6480. 2. Reject the low bidder and award to another bidder. 3. Reject all bids and rebid. 4. Approve a 5% contingency amount on this project for use by the City Engineer in authorizing change orders or quantity adjustments on this project. 5. Authorize an extension agreement with WSB & Associates, Inc. to perform construction services on this project. 6. Table for additional information. RECOMMENDATION: Staff recommends Alternative No.1, No.4 and No.5 in order for this project to be constructed in 2006. ACTION REQUESTED: 1. Offer Resolution No. 6480, A Resolution Accepting Bids on the Pheasant Run Storm Sewer Improvements, Project No. 2006-7 and move its adoption. 2. Approve a 5% contingency amount on this project for use by the City Engineer in authorizing change orders or quantity adjustments on this project. 3. Jedlicki, Inc. $142,650.48 WHEREAS, it appears that Chambers Excavating & Trucking, 39607 496th Street, North Mankato, MN 56003 is the lowest responsible bidder for the Pheasant Run Storm Sewer hnprovements. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. The appropriate City officials are hereby authorized and directed to enter into a contract with Chambers Excavating & Trucking in the name of the City of Shakopee for the Pheasant Run Storm Sewer Improvements Project according to the plans and specifications therefore approved by the City Council and on file in the office of the City Clerk. Shakopee,MN 55379 Re: Extension Agreement to Provide Survey and Construction Services Related to the Pheasant Run Storm Water Improvements City of Shakopee Project No. 2006-7 WSB Project No. 1281-97 Dear Mr. Loney: According to our agreement for professional services with the City of Shakopee in Section I-C-2 (Major Projects), this extension agreement is written to provide professional services for the above-referenced project. WSB proposes to provide construction staking and contract administration as necessary to complete the installation of Storm Water Improvements within the Pheasant Run Development. The tasks are anticipated to include the following: I. Construction Staking WSB survey crews will provide location and elevation staking for the storm sewer and outlet structures as necessary to complete the project. Anticipated cost to complete this task: $500 - $800 II. Construction Management WSB proposes to provide s hop drawing review and, as needed, construction observation, and provide pay voucher and payment recommendations and track change orders on the project. WSB will be present at the preconstruction meeting and hold a public information meeting with residents to discuss the project schedule and receive input from residents' concerns. Anticipated cost to complete this task: $1,400 - $1,800 III. Record Plans WSB will provide a record survey and plans for the Pheasant Run Storm Water Improvements. The City of Shakopee agrees to reimburse WSB & Associates, Inc. for the services in accordance with Section V of the Agreement of Professional Services.
