CITY OF SHAKO PEE Memorandum CASELOG NO.: 06-071 TO: Mayor and City Council Mark McNeill, City Administrator FROM: Mark Noble, Planner II SUBJECT: Final Plat of Riverside Bluffs MEETING DATE: September 5, 2006 REVIEW PERIOD:' July 7, 2006 - November 3,2006 DISCUSSION Homes By Chase submitted an application on July 6, 2006 for final plat approval of Riverside Bluffs, proposed for property north of Eagle Creek Blvd. and generally west of the Riverside Fields development. The plat, as currently proposed, contemplates the construction of 65 single family homes and an outlot (future phase to include 47 lots) on approximately 58 acres. The preliminary plat was approved on September 6, 2005. Staff received comments from City Engineering, the City Fire Inspector and Building Official, the Natural Resource Specialist, Parks Designer, and Parks, Recreation, and Facilities Director, the City Clerk, Prior Lake - Spring Lake Watershed District (PLSL WD), the City Finance Department, Centerpoint Energy, and SPUC. Additionally, staff received comments from Centerpoint Energy, which noted that the developer has not yet contacted them to reduce the blanket easement down to a strip, and from the City Finance Department, which noted that there is a pending assessment of $60,435.43 for the 2006 sewer extension project. Staffhas incorporated those conditions into the draft resolution. ALTERNATIVES 1. Approve Resolution No. 6477, a resolution approving the Final Plat for Riverside Bluffs. 2. Approve Resolution No. 6477, a resolution approving the Final Plat for Riverside Bluffs, with revisions. 3. Direct staffto prepare a resolution of denial of the Final Plat for Riverside Bluffs for action at the Council's next meeting. 4. Table a decision and request additional information from staff and/or the applicant. VISIONING RELATIONSHIP Action on these requests relates to Goal D: " Vibrant, resilient and stable" ACTION REQUESTED Offer a motion to approve Resolution No. 6477, a resolution approving the Final Plat for Riverside Bluffs, and move its adoption. ~) - g:\cc\2006\09-05\fpriverside bluffs.doc 1 RESOLUTION NO. 6477 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE FINAL PLAT OF RIVERSIDE BLUFFS WHEREAS, Homes By Chase, applicant and property owner, have made application for final plat approval of Riverside Bluffs; and WHEREAS, the subject properties are legally described as: See attached legal (Attachment #1) WHEREAS, the Shakopee Planning Commission conducted public hearings on the preliminary plat on April 7, April 21, and May 5, 2005; and WHEREAS, all required public notices regarding the public hearing were posted and sent; and WHEREAS, the Shakopee Planning Commission had recommended denial of the requested preliminary plat; and WHEREAS, the City Council reviewed the preliminary plat request at its meetings of June 21, August 16, and September 6, 2005; and WHEREAS, the City Council reviewed the final plat request at its meeting on September 5, 2006. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, THAT THE FINAL PLAT FOR RIVERSIDE BLUFFS IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS: I. The following procedural actions must be completed prior to approval of a grading permit and/or a street/utility plan: A. No public improvements shall be constructed until the City Engineer and the Shakopee Public Utilities Commission (SPUC) approves the Final Construction Plans and Specifications. B. The applicant shall agree to provide a bituminous access, a minimum of twenty- eight (28) feet in width, from Crossings Boulevard to County Road 16 (Eagle Creek Boulevard) prior to the issuance of certificates of occupancies. C. The applicant shall provide design details concerning the retaining walls and the associated fences for City staff review and approval. The applicant shall work with the City of Shakopee to provide ornamental fencing. D. The applicant shall work with the City of Shakopee to provide an acceptable design of a maintenance trail/access to the Prior Lake Outlet Channel and the proposed storm water basins. E. The applicant shall obtain the necessary US Army Corps of Engineers permits/approvals for all proposed wetland impacts. 2 F. The applicant shall obtain the necessary Minnesota Department of Natural Resources MnDNR permits/approvals for all work associated with the Prior Lake Outlet Channel. G. The applicant shall enter into a reimbursement agreement for the extension of all trunk sanitary sewer and all trunk storm sewer through the site. H. The applicant shall work with the City of Shakopee to provide adequate cover over the top of the proposed sanitary sewer crossing of the Prior Lake Outlet Channel and the crossing of the Prior Lake Outlet Channel's emergency overflow to the East. 1. The applicant shall work with the City of Shakopee to provide one (1) trunk sanitary sewer extension to the South of County Road 16 (Eagle Creek Boulevard) and one (1) trunk sanitary sewer extension to the East. J. No more that 16 lots south of Crossings Boulevard shall be available for permitting until. the development meets SPUC's requirements with respect to the water looping requirement. K. The applicant shall obtain the necessary right-of-way and/or easements to perform all proposed work offsite. If this permission cannot be obtained, the plat configuration may need to be changed, or easements will be needed and/or modified in order to eliminate the need for excessive retaining wall construction. II. The following procedural actions must be completed prior to the recording of the Final Plat: A. Approval of title by the City Attorney. B. Rename the plat Riverside Bluffs First Addition. C. Execution of a Developers Agreement, which shall include provisions for security for public improvements within the Pinal Plat, as well as payment of engineering review fees, and any other fees as required by the City's adopted fee schedule. 1. Street lighting to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 2. Electrical system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 3. Water system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 4. The developer shall be responsible for payment of Trunk 8tonn Water Charges, Trunk Storm Water Storage and Treatment Charges, and Trunk Sanitary Sewer Charges, as required by the most current City of Shakopee Pee Schedule. 5. Street construction, sidewalks, trails and retaining walls shall be constructed by the developer, consistent with the City Engineering requirements. D. Street names and addresses shall be provided to the Planning Department for review and approval. E. Temporary street signs shall be provided prior to issuance of building permits, and shall remain until such time that permanent street signs are installed. F. Provide electronic (Auto CAD) files of the Final Plat and all record drawings to the City Engineering Department. 3 G. Building permits may be issued in areas where sidewalks are not completed; however, issuance of occupancy permits shall not occur until the sidewalks are completed. H. The applicant shall properly vacate all unnecessary easements. 1. Easements must be shown on the Final Plat as approved by the City Engineer. They shall include, but not be limited to, the following: 1. Minimum drainage and utility easements for sanitary sewer and storm sewer in non-paved areas shall be provided at a one to one ratio, depth versus width, plus four (4) feet. The easements shall be centered along the utility alignment. 2. Provide a minimum often (10) feet of drainage and utility easement along the interior of all outlots. 3. Adequate drainage and utility easements shall be provided along the top and the bottom of all proposed retaining walls. J. The applicant shall obtain the necessary CenterPoint Energy (Minnegasco) permits/approvals. The developer shall contact Centerpoint Energy to reduce the blanket easement down to a strip. K. The applicant shall meet partial park dedication requirement by providing land dedication as shown as Outlot B. Consistent with the preliminary plat, additional park dedication will be required when Outlot C is platted. L. The City shall convey a portion of Outlot C, Riverside Fields, to the applicant as shown on the plans by Quit Claim Deed, which deed shall. be recorded immediately prior to the recording of the final plat. M. The developer shall convey Outlot A to the City for satisfying the park dedication requirements. N. The developer shall convey any easements needed for the trail on Outlot C. O. The developer shall provide to or comply with the Prior Lake - Spring Lake Watershed District (PLSL WD) conditions: 1. With respect to the creek easement, the developer shall leave the current easements alone until they plat Outlot C, at which time they will need to modify that easement. 2. As the project moves forward through the final review phase prior to grading, the PLSL WD ask that the developer stay in close contact with them so they can time the PLSL WD/City channel project to follow immediately after the channel is graded and the rock vanes and spillway are installed, and also so they can try to schedule the channel grading for a time when they are not outletting from Prior Lake and there is not a lot of runoff from the adjacent watershed. P. Simultaneous to the recording of the Final Plat, a deed restriction shall be recorded on all lots as designated by the City of Shakopee. The Deed Restriction shall appear as the following: This conveyance is made conditioned upon and subject to the following restriction. The Grantee, heirs, successors and assigns, are restricted .from erecting any fence or other structure within the utility and drainage easements dedicated by plat over the above-described property, except with the prior written consent of the City of Shako pee. This restriction shall run in favor of and be enforceable by the City of Shako pee. III. Following approval and recording of the final plat, the following conditions shall apply: 4 A. Building construction, sewer, water service, fire protection and access will be reviewed for code compliance at the time of building permit application(s). B. Noise issues along the County roadways may arise as traffic levels increase in the area. The developer and/or their assigns shall be responsible for any required or desired noise mitigation measures. C. The developer should implement the use of Best Management Practices for erosion control and stormwater management during construction. D. The applicant is required to seed the storm ponds with a native wetland seed mixture, and erosion control blanket shall be placed four (4) feet on both sides of the normal water level and around outlets to prevent erosion and sediment deposits in downstream surface waters. E. The applicant shall not plant ash trees (Fraxinus sp.) on the site due to the threat of Emerald Ash Borer. F. The applicant shall not plant replacement trees in the following areas: l. Drainage and utility easements containing utilities. 2. Emergency overflow areas. 3. Below the high water level inside easements of storm ponds. 4. County Road line of sight. 5. City owned right-of-way. G. The applicant must meet the city's woodland management ordinance requirements. H. Connecting sidewalks/trails shall be provided throughout the development as required by the City. 1. Applicant shall install park, open space, and/or wetland boundary markings at locations to be determined by the city. J. Sidewalks, trails, and bridges shall be constructed as shown on the preliminary plat plans, and along County Road 16 running the length of the development, consistent with the City design requirements. K. In Outlot B (the park area), the developer shall: l. Grade the park as proposed. 2. Fine grade the site, picking rocks and dirt clumps %" and greater in size. 3. Provide a finished grade that is approved by the city as suitable for park use. 4. Ensure a minimum of 6" of topsoil. 5. It is located to the South and to the West of the Riverside Fields Addition. This review should be considered preliminary, as more comments are to follow with additional submittals. However, I offer the following comments at this time for the applicant and for the planning department: General Comments The following items shall be completed prior to release of the Final Plat for recording: 1. Execution of a Developer's Agreement, which shall include provisions for security for public improvements within the Pinal Plat and the engineering review fees. 2. Payment of Trunk Sanitary Sewer Charges shall be made, as required by the most current City of Shakopee Fee Schedule. 3. These include, but are not limited to: installing a lateral water main distribution system in accordance with utility policy, paying the associated inspections costs, paying the Trunk Water Charge, and paying the Water Connection Charge. Underground electric service is available subject to our standard terms and conditions. These include, but are not limited to: entering into an Underground Distribution Agreement, granting any necessary easements, and paying the associated fees. Street Lighting installation is available subject to our standard tenns and conditions. These are contained in the current City of Shakopee Street Lighting Policy. DISCUSSION The Parks and Recreation Advisory Board (PRAB) reviewed the proposed Riverside Bluffs preliminary plat at their February and March, 2005 meetings, as proposed by Ryland Homes. They recommended approval with conditions. Park Dedication Preliminary Plat Conditions There has been extensive work since preliminary plat approval to accommodate the planned transfer of Riverside Fields park dedication land to Riverside Bluffs, with the intent that adjacent land in Riverside Bluffs will be dedicated to create a larger neighborhood park. Based on the preliminary plat drawing showing 101 units, park dedication requirement was as follows: Park dedication requirements are as follows: Riverside Fields Park Swap 3.92 acres Riverside Bluffs Requirement for 101 homes 4.04 acres Total Land Required 7.96 acres Ryland Homes proposed the following: Main Park Area (including gas line easement) 6.44 acres Trail and Greenwav Area 1.40 acres Total Proposed 7.84 acres Land dedication was to follow the channel corridor from CR 16 north, opening up to a larger general park area where it would be joined with land from the next development to the west. Credit for park land dedication excluded the 60' easement for the channel and allponding/wetlands, but credit was provided for the utility easement corridor. (The preliminary plat approval occurred prior to the text amendment eliminating credit for utility easements.) The applicant also agreed to construct the trails as shown on the drawings, and the balanceofthe park dedication requirement (.12 acres) would be fulfilled by providing the applicant a credit toward the costs of the constructing the trails. Final Plat Since the preliminary plat approval, the property has been sold to Homes by Chase and is being final platted in two phases with one additional lot proposed. Although the same park dedication requirements apply, the proposed final plat phasing will requirement park dedication to be met in two phases: Total Park Dedication Requirement: Riverside Fields Park Swap 3.92acres Riverside Bluff's Requirement for 102 Homes 4.08 acres First Phase Dedication Shown (Outlot B) (6.97acres)* Balance Due in Second Phase 1.03 acres *Actual amount of credit (excluding channel and backup area) needs to be determined. The applicant is also providing Outlot A (formerly a portion of Outlot C in Riverside Fields)to the City as park and open space. However, no credit is being provided to the applicant for this land. Finally, the applicant is required to re-grade Outlot B to provide adequate drainage. Grading plans are being finalized. Trails and Sidewalks Trails and sidewalks shall be constructed as shown on the plans. These include but are not limited to: . A trail along CR 16. . A trail connecting the Riverside Fields trail. · . A trail along the length of the outlet channel through. the development. (Portions would not be constructed until the second phase of the development.) . Required bridge crossing capable of supporting a light-duty pickup. . Sidewalks throughout the development. PARK DEDICATION RECOMMENDATIONS The staff recommends approval of the proposed final plat, with the following conditions: Prior to recording of the Final Plat: 1. The applicant shall meet partial park dedication requirements by providing land dedication as shown as Outlot B. Consistent with the preliminary plat, additional park dedication will be required when Outlot C is platted. 2. The City will convey a portion of Riverside Fields Outlot C to the applicant as shown on plans, and the applicant shall dedicate Outlot A. to the City. After Recording of the Final Plat: 1. The homes are marked on the attached plan. Also, indicated on this plan are items A-D of the work that will be prefonned under Homes by Chase's supervision. As a general note, all work will be approved in accordance with the standard as well as inspected by the City of Shakopee. Tl1re work will also be supervised by Homes by Chase to assure that the workmanship will be completed in a professional manner. All erosion control and restoration will be completed as possible to its original condition. A summary of the workto be preformed is as follow: 1. "A" Lots to be survey and marked along the edge of the existing drainage and utility easements as shown. Erosion control silt fence to be installed and removed once the work is installed and accepted by the City of Shakopee. 2. "8" The trail will be removed the week of August 21 st or sooner. 3. "C" Stonn sewer as indicated on the plan removed during the. construction of the utilities, subject to city authorization. The manhole/catch basin adjacent 'to the sidewalk between lots 7&8 will be relocated approximately 40 feet to the east. A new manhole/catch basin to be installed between lots 4 & 5. The sidewalk along lot 8 will require 3 or 4 sections to be removed. 4. "D" A new trail will be installed along the northern boundary of the existing wetland and connected to the purposed park to the west. The installation of the utilities and restoration is unknown at this time. It is Homes by Chase intention to complete the work fan 2006 with the exception that the trail and tinaIly restoration may not be completed until spring 2007.
