Memorandum i TO: Mayor & City Council CO'~Sf~JT Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Authorization of Extra Engineering Costs for the Pike Lake Road Wetland Mitigation Project DATE: September 5, 2006 INTRODUCTION: Attached is a letter from Andrea Moffatt, of WSB & Associates, on the increased costs of services for the Pike Lake Road Wetland Mitigation Project. This agenda item is to authorize payment of these extra services for this project. BACKGROUND: City Council previously approved a wetland mitigation project for the wetlands being impacted with the Pike Lake Road improvement project, from C.R. 16 to Southbridge Parkway. The City also has purchased a conservation easement from Mr. and Mrs. Gene Hauer for a wetland mitigation site. The original scope of service had limited amount of surveying time and some estimated work in obtaining permits from the Army Corps of Engineers. Additional survey work was done in order to resurvey the site several times during the land acquisition negotiation period. Also, additional drawings were needed to be done as requested and required by the Army Corps of Engineers fora core permit application to be done for the wetland mitigation. In total, the extra services range from $6,260.00 to $8,260.00 and the request is to authorize the increase in the contract from the original of$33,773.00 to $42,033.00. Staff is in concurrence . with this additional work as there was additional surveys, drawings and coordination hours spent for surveying the site and obtaining a U.S. Army Corps of Engineer permit. ALTERNATIVES: 1. Approve a motion authorizing a contract increase from $33,773.00 for $42,033.00. 2. Do not authorize a motion to increase the contract amount for engineering services associated with the wetland mitigation project for Pike Lake Road. 3. Table for additional information. RECOMMENDATION: Staff recommends Alternative No. 1. A number of additional items have been identified and added to the original scope as a result of the US Corps of Engineers requests, Mr. Gene Hauers requests, and/or the land acquisition process. These additional items are summarized below: . Our scope of services for this project anticipated approximately 40 hours of survey time for a total cost of $5,040. The survey completed to date included the time to survey the Hauer site and repeated trips to the site to stake the boundaries for Mr. Hauer during land acquisition negotiations. The legal description of the boundary also changed a number of times as a result of requests from Mr. Hauer. Initially, these negotiations were going to be completed by Scott County; however, it was later determined that WSB and the City would conduct these negotiations. As we discussed, this work was additional to the scope. The total survey and land negotiation costs incurred are $8,600, which is $3,560 over the original scope of work. . The wetland impact and design drawings for the Pike Lake Road permit application were to be provided by the developer. Due to the need to provide these drawings to the US Corps of ~.' Engineers in a timely manner, WSB completed the drawings at the City's request. Further, the additional information requested by the US Corps to post the permit application was beyond our original scope. The cost to complete the drawings was $900. The cost to provide additional information to the US Corps' questions was $800. The total for this work was $1,700. . It is anticipated that additional follow up with the US Corps of Engineers and Minnesota Pollution Control Agency will be needed to obtain the pennit once the comment period is completed. This will be billed on an hourly basis, but may range from $1,000-$3,000. We are requesting approval of an increase in the contract from the original cost of$33,773 to $42,033.
