Riverside Fields Homeowners,
Attached please find a copy of the staffreport for an item on the agenda for the City
Council meeting this evening. This item is for reconsideration of the access to the
development with Kwik Trip. The final plat was approved on August 2 with a right in
only at the first access point. When the CUP and the Preliminary Plat were approved, I
indicated to a group of residents that we would request additional access recognizing the
benefit of reducing traffic in the immediate proximity to the pool. At this point the
Council will be faced with three options:
. Right in only at the first access point.
. Right in and Right out at the first access point
. Open the first access point to full movement, potentially temporarily
The issue with the first option is that it maximizes traffic at the pool. This would be the
only point to exit the development.
The concern with the second option is that it will increase the U turns taken at the next
intersection. There has been some concern that this traffic may circulate through the
residential neighborhood, but we believe that the length of this movement would
discourage any repetition of this movement. To some extent this is a temporary increase
due to the incomplete status of Crossings Blvd. Arguably however, some people may
continue to make this movement if they exit the right out, but desire to get back to 18.
The option of opening the intersection most benefits the operation ofthe pool by reducing
the traffic in proximity to the pool, but this option has technical considerations at
maturity, if the traffic assumptions prove to be at or near the numbers used in the traffic
analysis., The memo provided by Chuck Rickart, WSB & Associates, for the City, details
these issues. IF the opening is to be a permanent design, he recommends two' options to

address concerns primarily with providing a left turn from Crossings Blvd. to Penstemon.
,We believe this serves approximately 30 homes and will be a minimum movement. I
have suggested that the left turn could be controlled with time limitations and signage, if
necessary. I do not think the City engineer or their consultant believes this is effective. I
believe that if there is an issue with this operation and conflicts with this movement, we
simply close the full movement and revert to the Right inlRight out as originally designed
and originally approved by the City Engineer and consultant. Ultimately the success or
failure of this option would be in the observation and control of this limitation for left
turns. We do not believe it is better to redesign the lane configurations when ultimately
this access may be closed.
Crossings Blvd. is incomplete at this time. The best scenario is to try the best available
option and change it if conditions dictate. We have offered to accept responsibility
physically and financially for the changes if required. We will all see an evolution with
development to the west and future uses added to our development. Each of these

windows will give the City and the Engineering Department an opportunity to have us
make changes ifriecessary. We accept that this must be within their discretion and that
the City inust be somewhat insulated from objections from future businesses within our
development. We will accept that responsibility with appropriate disclosures and
contracts with any business occupants. .

INTRODUCTION:
At the City Council meeting of August 2, 2006, the Council voted to have the final plat of Southbridge
Fields put on the August 15th Council agenda for reconsideration of the condition related to limiting the
first access to right-in only. If the Council wishes to reconsider its action on the final plat, it will first
need to offer and pass a motion to suspend their rules, which require reconsideration to occur at the same
meeting or the next regular meeting of the Council. If the motion to suspend the rules passes, the Council
can then take up a motion to reconsider their previous action approving the final plat of Southbridge
Fields. Ifthe motion to reconsider passes, the item will be before the Council for consideration.
DISCUSSION:
The specific rationale for bringing the plat to Council for reconsideration seems to relate to the limitation
on access to a right-in only condition. In anticipation of that, staffhas asked the City's traffic consultant,
WSB/Chuck Rickart, to suggest the conditions under which a right-in/right-out might be allowed, and
what changes to the intersection would be needed to make the access as safe as possible.

If Council reconsiders the final plat, staff asks that the Council consider two additional conditions as
acted on by the Council initially, First is the Council's deletion of the condition that would make the
applicant or subsequent businesses responsible for costs to modify Crossings Boulevard that are caused
by their development. This condition was a part ofthe Council's preliminary plat approval, and there is
good reason to make the applicant or future businesses responsible for future costs incurred in making
improvements or modifications to Crossings Boulevard.
Second, it was not clear from Council's initial action whether it intended to delete the four foot trail on
the west side of the private drive. Staff believes this trail would serve a useful purpose for the residents of
the Riverside Fields neighborhood, and asks that Council clarify its intent, and leave that trail in place as a
condition of approval.
The City Council directed staff to place this final plat application on the agenda of August 15th, with staff
to provide summarized e-mails and letters on the subject. In the attached resolution, staffhas underlined
and placed in bold that text that Council may want to consider or reconsider.
ALTERNATIVES:
1. Approve Resolution No. 6469, a resolution approving an amendment ofthe Final Plat for Southbridge
Fields Addition, subject to the conditions presented.

3. Do not approve the final plat and direct staff to prepare a resolution consistent with the direction of
the Council for action at the Council's next meeting.
4. Table the matter and request additional information from staff and/or the applicant, provided the
applicant.grants an extension of this application.
5. Take no action, but leave the Council's past approval in place.

A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING AN
~NDMEN'Dc.OF"TIIE FINAL PLAT OF SOUTHBRIDGE FIELDS ADDITION
WHEREAS, Southbridge Crossings, L.P., applicant and property owner, has made application for
final plat approval of Southbridge Fields Addition; and
WHEREAS, the subject property is legally described as:
Outlots B, Riverside Fields 3ra Addition, according to the recorded plat thereof, Scott County, Minnesota; and
WHEREAS, the Planning Commission recommended approval of the proposed preIiminaryplat
with conditions; and
WHEREAS, on February 21,2006, the City Council approved the proposed preliminary plat;
and
WHEREAS, on July 18, 2006, the City Council approved the proposed final plat; and
WHEREAS, on August 15, 2006, the City Council reconsidered the final plat resolution.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE, MINNESOTA THAT AN AMENDMENT OF THE FINAL PLAT OF
SOUTBBRIDGE FIELDS ADDITION IS HEREBY APPROVED, SUBJECT TO THE
FOLLOWING CONDITIONS:
I. The following procedural actions must be completed prior to the recording of the Final
Plat:
A. Approval of title by the City Attorney.
B. Remove the signature block for the City Planning Commission.
C. Execution of a Developer's Agreement, which shall include provisions for security
for public improvements within the plat and the engineering review fees, and any
other fees as required by the City's adopted fee schedule.
1. Shakopee Public Utilities Commission shall be contacted if the applicant
wishes to contract with them for security lighting.
2. Electrical system to be installed in accordance with the requirements of the
Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the requirements of the
Shakopee Public Utilities Commission.
4. Public sanitary sewer, public storm sewer and public watermain have been
extended through the site, The applicant shall work with City of Shakopee
staff to provide acceptable access to each system and their associated
appurtenances. This includes providing adequate easements and entering
into an encroachment agreement with the City.
5. The developer shall be responsible for payment of Trunk Storm Water
Charges, Trunk Sanitary Sewer Charges, Trunk Storm Water Storage and
Treatment Charges, security for the public improvements, engineering
review fees, and other fees as required by the City's most recent adopted Fee
Schedule.

6. No public improvements shall be constructed until the City Engineer and the
Shakopee Public Utility Commission approve the Final Construction Plans
and Specifications.
7. The applicant shall obtain an NPDES permit prior to any land disturbing
activity. A copy of this permit shall be forwarded to the City. The applicant
shall adhere to all.MPCA NPDES requirements.
8. The applicant shall provide evidence of suitable easement agreements for
access to all adjacent properties utilizing the private sewer system. These
easements shall be approved by the City prior to recording of the plat.
Maintenance of these utilities shall be the responsibility of the applicant.
D. The applicant shall provide a more defined site plan showing impervious surface
percentages complying with the requirements set forth by City Code, at time of
Conditional Use Permit and Building Permit application submittals.
E, Easements shall be shown on the Final Plat as approved by the City Engineer.
F. The applicant shall contact City Engineering to apply for and secure an encroachment
agreement for the trunk storm sewer located along the westerly line of Lots 1,3,4, 5
& 6, as well as secure an encroachment agreement for the trunk sanitary sewer
located between Lots 4 & 5.
G, The survey data (length and bearings) shall be shown for each lot.
H. Temporary street signs shall be provided until such time that permanent street signs
are installed.
I. The water distribution system shall be revised to comply with Shakopee Public
Utilities Commission's requirements. This shall include, but not be limited to,
identifying and providing water serviCes for each lot.
J. Adequate easements for watermains shall be required, consistent with Shakopee
Public Utilities Commission's requirements.
K. The applicant shall meet park dedication requirements by providing cash in lieu of
land dedication.
L. Park dedication fees in the amount required by the City Code and adopted City fee
schedule shall be paid prior to the recording of the final plat.
M. The applicant shaH provide an 8' wide bituminous trail connection. as per Citv
Standard Details. between Crossin!!s Boulevard and Southbrid!!e Parkwav
alon!! the west side of Conntv Road 18 and a sidewalk or trail on one side of the
second western access to the internal street. which provide access to all proposed
lots. to be built at the time of the street construction.
N. Screening elements required by the Board of Adjustment and Appeals, the City
Council, and/or City Staff shall be allowed within drainage and utility easements
adjacent to Riverside Fields 3rd Addition. The applicant shall be responsible for the
maintenance of the screening andshall repair and/or replace any landscaping located
in the easements that may be damaged due to need to access the easements.
O. The applicant shall obtain a grading permit prior to any additional land disturbing
activity.
P. The soils on site shall be subject to sampling and testing at the City's discretion. The
cost associated with the testing, and if necessary, the removal of any material deemed
unacceptable by the City shall be the applicant's responsibility.
Q. The applicant shall provide storm water computations for the proposed development
as required by City Engineering to insure the downstream system can accommodate
the runoff.
R. The applicant shall ensure that the emergency access from Crossings Boulevard to
Southbridge Parkway be well maintained and accessible at all times.

n. Following approval and recording of the final plat, the following conditions shall
apply;
A. The applicant shall record the private road access easement document.
B. The developer and/or their assigns shall be responsible for any required or desired
noise or dust mitigation measures.
C. Shall provide electronic (AutoCAD) files of the Final Plat to the Engineering
Department.
D. The applicant shall meet the screening and landscaping ordinance requirements of the
City Code.
E, The applicant shall submit a landscaping plan for review and approval by the City of
Shakopee Natural Resource Specialist.
F. The applicant shall provide six (6) inches oftopsoil below areas to be sodded. The
soil composition should be similar to the MnDOT topsoil borrow requirements.
G. The applicant shall provide rain sensors for any irrigation system.
H. The applicant shall implement the use of Best Management Practices for erosion
control and storm water management during construction.
I. The applicant shall utilize the MPCA Protecting Water Quality in Urban Areas as a
technical reference for erosion control.
J. The applicant shall comply with the design and performance standards for the
Planned Residential District (PRD).
K. Silt fence and/or tree protection fence is to be removed following establishment of
vegetation as determined by an inspection by City staff.
L. The easternmost access to Crossin!!sBoulevard shall be reconstructed and
siened as a rieht-in onlv.
M. Any impact this development has, as far as adjusting or relocating existing facilities,
is subject to reimbursement to Time Warner Cable applicable costs of relocation/
adjustment and subject to scheduling of work requested.
N. The developer is authorized to submit an application for a Minor (administrative)
Subdivision for Lot 3.
O. The applicant shall be responsible for all future improvements to the Crossin!!s
Boulevard infrastructure caused bv their development.

As you requested, I have reviewed the options for providing a full movement access at the East
Penstemon Lane intersection, west ofCSAH 18. Currently, East Penstemon Lane and the commercial
access on the north side are configured as right-in/right-out accesses. A request has been made to open
the median, providing a full movement access at this location. With the existing lane configuration
approaching CSAH 18, this median break would fall right in the taper ofthe lefttum lane to CSAH 18.
Eastbound, a right turn lane is provided into the commercial access on the north side. Based on this
request, I have reviewed the potential options based on a preliminary design (not final design) and I offer
the following comments:
A. Simply opening the median will create safety issues for this intersection. Vehicles traveling
eastbound will be stopping to turn left onto East Penstemon Lane in the existing through lane of
traffic. Traffic will either need to wait for this left turn traffic or, more likely, bypass in the right
turn lane through the intersection. This is a major safety concern which will create potential for
both rear end collisions, as well as sideswipes, while they are bypassing the stopped vehicles. In
addition, traffic coming from CSAH 18 will potentially be driving at a faster speed and, thus,
having to stop within a few hundred feet is also a safety concern. For vehicles heading
westbound, wanting to turn into the commercial access on the north side, confusion will exist
with a blinker turning left into this access, and vehicles getting in the left turn lane to go to
CSAH 18. In addition, with no left turn storage, vehicles will back up into the through lane of
traffic, causing similar issues as for eastbound traffic.
B. It is necessary to create a protected left turn lane on Crossing Boulevard. There are two ways to
create a protected left turn bay for eastbound and westbound approaching the east Penstemon
Lane intersection.

1) The existing left turn lanes for traffic to the West Penstemon Lane intersection and CSAH
18 can be shortened, providing room for a short (50-foot) left turn lane into the East
Penstemon Lane intersection. This would require some median modifications between
CSAH 18 and the West Penstemon Lane intersection. The result of this would be
inadequate left turn storage for the CSAH 18 intersection in the future. This is based on
the original traffic study completed for this area, which documented the need for a left
turn lane storage, in the future, which extends to where it currently is today. This plan
would eliminate approximately 150-200 feet of the existing left turn lane with storage and
tapers.
2) A second option would be to widen Crossing Boulevard to the north in order to maintain
the existing left turn storage from Crossing Boulevard to CSAH 18. The widening would
create a "back-to-back" left turn bay similar to what currently exists on Verling Drive
between the first crossroads access and CSAH 17. The impacts ofthe widening would be
substantial and would require storm sewer modification, potential traffic signal
modifications at CSAH 18, and median modifications between CSAH 18 and the West
Penstemon Lane intersection.
Based on this preliminary review, it is still my recommendation and opinion that the best operation and
safest intersection configuration is how the intersection exists today, with no full movement access at the
East Penstemon Lane intersection. However, if an alternative was to be recommended for opening the
intersection, either Alternative 1 or 2, with a protected left turn, would be adequate. With Alternative 2
having the most operational benefits, but also having the highest cost. If opening the intersection to a
full movement access is considered, a detailed design should be completed to determine the impacts. In
addition, this improvement, if opened to a full access, should be considered permanent. Closing
accesses ofthis type in the future has been very difficult, as attempts, even with agreements, have not
been successful.

N. Screening elements required by the Board of Adjustment and Appeals, the City
Council, and/or City Staff shall be allowed within drainage and utility easements
adjacent to Riverside Fields 3rd Addition. The applicant shall be responsible for the
maintenance of the screening and shall repair and/or replace any landscaping located
in the easements that may be damaged due to need to access the easements.
O. The applicant shall obtain a grading permit prior to any additional land disturbing
activity.
P. The soils on site shall be subject to sampling and testing at the City's discretion. The
cost associated with the testing, and if necessary, the removal of any material deemed
unacceptable by the City shall be the applicant's responsibility.
Q. The applicant shall provide storm water computations for the proposed development
as required by City Engineering to insure the downstream system can accommodate
the runoff.

R. The applicant shall ensure that the emergency access from Crossings Boulevard to
Southbridge Parkway be well maintained and accessible at all times.
n. Following approval and recording of the final plat, the following conditions shall
apply;
A. The applicant shall record the private road access easement document.
B. The developer and/or their assigns shall be responsible for any required or desired
noise or dust mitigation measures.
C. Shall provide electronic (AutoCAD) files of the Final Plat to the Engineering
Department.
D. The applicant shall meet the screening and landscaping ordinance requirements of the
City Code.
E. The applicant shall submit a landscaping plan for review and approval by the City of
Shakopee Natural Resource Specialist.
F. The applicant shall provide six (6) inches of topsoil below areas to be sodded. The
soil composition should be similar to the MnDOT topsoil borrow requirements.
G. The applicant shall provide rain sensors for any irrigation system.
H. The applicant shall implement the use of Best Management Practices for erosion
control and stormwater management during construction.
I. The applicant shall utilize the MPCA Protecting Water Quality in Urban Areas as a
technical reference for erosion control.
J. The applicant shall comply with the design and performance standards for the
Planned Residential District (PRD).
K. Silt fence and/or tree protection fence is to be removed following establishment of
vegetation as determined by an inspection by City staff.
L. The easternmost access to Crossine:s Boulevard shall be reconstructed and
sie:ned as a rie:ht-in only.
M. Any impact this development has, as far as adjusting or relocating existing. facilities,
is subject to reimbursement to Time Warner Cable applicable costs of relocation/
adjustment and subject to scheduling of work requested.
N. The developer is authorized to submit an application for a Minor (administrative)
Subdivision for Lot 3.
O. The applicant shall be responsible for all future improvements to the Crossine:s
Boulevard infrastructure caused bv their development.
