SUBJECT: Public hearing on revision to building permit and development fees

INTRODUCTIONIDISCUSSION:
Based on further conversations with Jessie Hart of Springsted, as well as the City's
attorneys, staff has prepared a revised ordinance for Council to consider on August 15,
2006. It is being provided at the August 14th meeting to provide Council members some
time to review it.

ORDINANCE NO. 767, FOURTH SERIES
AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA,
AMENDING THE CITY'S 2006 FEE SCHEDULE TO IMPLEMENT
CHANGED BUILDING PERMIT FEES FOR NEW RESIDENTIAL,
COMMERCIAL AND INDUSTRIAL CONSTRUCTION.
WHEREAS, the Shakopee City Council duly noticed and opened a public
hearing on August 2, 2006 on the possible revision of its fees for new residential,
commercial and industrial construction; and
WHEREAS, the public hearing was continued to the regular Council meeting of
August 15, 2006; and
WHEREAS, the City Council has determined that it is desirable to revise the
2006 Fee Schedule to modify fees for new residential, commercial and industrial
construction;
NOW, THEREFORE BE IT ORDAINED, that the City Council ofthe City of
Shakopee hereby revises the Adopted 2006 City Fee Schedule by implementing the
following changes and/or fees;
1. Building Permit Fees for new construction shall be calculated
utilizing the current valuation table contained in the City's adopted
Fee Schedule, and applying the Index Factors below to arrive at the
actual building permit fee within the stated minimums and
maximums found below.
2. Plan Review fees shall be as found below, replacing the current
fee calculation of65.00% of the Building Permit Fee.

**"Gross" Building Permit Fees are to be calculated as per building permit fee
schedule (City Ordinance 676 utilizing valuation. The "Index Factor would then be
applied to the "gross" building permit to derive the "net" building permit fee which
should be no less than the minimum, and no more than the maximum Building Permit
Fee.
BE IT FURTHER ORDAINED, that the permit fee to operat~ a motorized golf
cart shall be $20.00.

INTRODUCTION/DISCUSSION:
On August 2, 2006 the City Council opened and continued the public hearing on the
possible revision of the City's Fee Schedule to adjust building permit fees for new
residential, commercial, and industrial construction. Accompanying this memorandum is
a draft ordinance for the Council's consideration that would amend these specific fees.
Since the opening ofthe public hearing City staff has been discussing the other fees that
were a part of Springsted' s Cost of Services study, and have determined that 1) any
proposed changes in those fees will be incorporated into the overall 2007 Fee Schedule
amendment, and 2) that information about those changes will be shared with the Council
as a part ofthe ongoing 2007 budget process.
ACTION REQUESTED:
Offer and pass Ordinance No. 767, an ordinance of the City of Shako pee amending the
City's 2006 Fee Schedule to implement changed building permit fees for new residential,
commercial and industrial construction.

SUBJECT: Establishing a Fee for Motorized Golf Cart Permits
DATE: August 11, 2006
INTRODUCTION:
City Council is asked to establish a $20 permit fee for the operation of a motorized golf cart,
which fee is included in the Ordinance to be considered by Council regarding the new building
permit fees.
BACKGROUND:
At the City Council meeting on July 18, 2006, City Council adopted Ordinance No. 764, Fourth
Series, allowing for the operation of motorized golf carts on designated roadways upon receipt of
a permit from the Police Department. City Council directed staff to establish an appropriate fee
for the permit and to include it in the forthcoming ordinance to amend fees for building permits.
Ordinance No. 767, which amends the fee ordinance relating to building permit fees, also amends
the fee ordinance by adding the fee in the amount of $20 for a permit to operate a motorized golf
cart in the City of Shakopee. The Police Department recommends the $20 fee to help defray the
cost of the permit and staff time involved.
RECOMMENDED ACTION:
If Council concurs, this permit fee will be implemented with the adoption of Ordinance No. 767,
Fourth Series, which will be considered by City Council in conjunction with amending the
building permit fees - August 15,2006, agenda item number 9.

AMENDING THE CITY'S 2006 FEE SCHEDULE
TO IMPLEMENT CHANGED BDaDING PERMIT FEES FOR NEW
RESIDENTIAL, COMMERCIAL AND INDUSTRIAL CONSTRUCTION
AND TO ESTABLISH A PERMIT FEE TO OPERATE
A MOTORIZED GOLF CART
WHEREAS, the Shakopee City Council duly noticed and opened a public
hearing on August 2, 2006 on the possible revision of its fees for new residential,
commercial and industrial construction; and
WHEREAS, the public hearing was continued to the regular Council meeting of
August 15,2006; and
WHEREAS, the City Council has determined that it is desirable to revise the
2006 Fee Schedule to modify fees for new residential, commercial and industrial
construction;
NOW, THEREFORE BE IT ORDAINED, that the City Council of the City of
Shakopee hereby revises the Adopted 2006 City Fee Schedule by implementing the
