INTRODUCTION:
As per Resolution No. 6717, a resolution receiving a report and calling for a public
hearing on the 2008 Street Improvements, Project No. 2008-1, a public hearing is
scheduled for February 19, 2008. This agenda item is to conduct the public hearing for
the proposed improvements associated with the 2008 Street Improvements Project.
BACKGROUND:
On November 7, 2007 the City Council ordered the preparation of a feasibility report for
the 2008 Street Improvements Project.
On February 6, 2008, staff conducted an informational meeting for property owners being
affected by the proposed project. Approximately 30 residents attended the meeting. The
residents in attendance had .some general questions regarding the design, construction
schedule and assessment payments.
PROJECT COSTS:
The total estimated project cost for this project is $709,003.00.
30% of the street improvements ($210,164.00) will be assessed to the benefiting
properties. The remaining costs ($498,839.00) associated with the improvements will be
paid from tax levy and the Storm Sewer Fund.
ALTERNATIVES:
1. Adopt Resolution No. 6728, a resolution ordering the improvement and the
preparation of plans and specifications for the 2008 Street Improvements, Project
No. 2008-1.
2. Deny Resolution No. 6728. This action will halt the project until such time as the
City Council reconsiders the resolution.
3. Table Resolution No. 6728, to allow time for staff to prepare additional
information and/or revise the feasibility report as directed by City Council.
4. Modify Resolution No. 6728, to reduce the scope of the project area, as
determined by City Council.
RECOMMENDATION:

move its adoption.

Ordering An Improvement And Preparation Of
Plans And Specifications For The
2008 Street Improvements
Project No. 2008-1
WHEREAS, Resolution No. 6717 adopted on January 15, 2008, fixed a date for Council
hearing on the proposed improvement of the 2008 Street Improvements Project and all appurtenant
work; and
WHEREAS, ten days published notice of the hearing through two weekly publications of
the required notice was given and the hearing was held on the 19th day of February, 2008, at which
all persons desiring to be heard were given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA:
1. That the improvement is necessary, cost effective -and feasible and is ordered as
hereinafter described:
2008 Street Improvements Project and all appurtenant work.
2. Bruce Loney, Public Works Director, is hereby designated as the engineer for this
improvement. He shall prepare plans and specifications for the making of such improvements.
3. The work of this project is hereby designated as part of the 2008-1 Public Improvement
.Program.
4. The City Council shall let the contract for all or part of the improvements as authorized
by Minnesota Statutes 429.041, no later than three years from the date of adoption of this
resolution.

1. INTRODUCTION
' On November 7, 2007, the City Council ordered the preparation of a feasibility
report to analyze potential street improvements to all the streets in the Eaglewood
Additions, Deerview Acres Addition, Timber Trails Addition and Stonebrooke
' Drive by Resolution No. 6680.
This project is included in the City's 2008 Capital Improvement Program.
2. SCOPE
This report well determine the feasibility of street improvements, and any other
necessary improvements to the existing streets. The project area includes the
Eaglewood Additions, Deerview Acres Addition, Timber Trails Addition and
Stonebrooke Drive. The report will also determine the cost effectiveness of the
proposed improvements, provide a cost apportionment, preliminary cost estimate
and a preliminary assessment roll.
' 3. BACKGROUND
The streets within the Eaglewood Additions and Timber Trails Addition were
originally construction in 1975 & 1976 and some pavement rehabilitation was
performed in 1985 and 1986. The streets located within the Deerview Acres
Addition were constructed in 1978. The streets were constructed to rural street
design with very little cuxb and storm sewer. In 1990 the first layer of pavement
was installed on Stonebrooke Drive and the wear course (final layer) was paved in
1994. Stonebrooke Drive was constructed to an urban design with concrete curb
& gutter and storm sewer. All of the streets have been crack sealed, seal coated
and patched over the years as part of routine maintenance. Due to a combination
of traffic, wear and age, the bituminous surface on all of these roadways has
deteriorated and is in need of rehabilitation.
ED IMPROVEMENTS
4. PROPOS
' 4.1 Street
The proposed street improvements are identified in Drawing No. 1 in the
Appendix.

The proposed street improvements with the exception of Stonebrooke
Drive consist of reclaiming the existing bituminous pavement, correcting
areas of sub-grade instability, and the placement of a 2-1/2-inch
bituminous pavement layer. The proposed street improvements to
Stonebrooke Drive consist of edge milling of the existing pavement,
' patching areas of sub-grade instability, replacing small portions of
concrete curb & gutter and the placement of a 2-inch bituminous overlay.
' The purpose of this project is to resurface the roadway to extend its life,
provide a smoother driving surface and to reduce yearly maintenance costs
by reducing the amount of patching and crack sealing that is needed on a
yearly basis. Overlaying the roadways now will delay the expense and
inconvenience of a complete reconstruction by approximately 15 years.
The total estimated project cost for the proposed street improvements is
$ 709,003. An itemized cost estimate is included in the Appendix.
' 4.2 Sanitary Sewer
All properties in this project area are served with Individual Onsite
' Sewage Treatment Systems (septic systems). These systems are not
located within the roadway right of way and any maintenance and repairs
are the responsibility of the property owner. It is anticipated that municipal
sanitary sewer will be made available to these properties in the future. At
that time the property owners can petition the City for municipal sewer
and water service. When utilities are extended to this area the streets will
be completely reconstructed to the current City standard street design.
This project is being proposed now because the existing pavements are
deteriorating rapidly and utility extension through the Timber Trails
addition is anticipated to be 12 to 15 years away.
4.3 Storm Sewer
The existin metal culverts will be evaluated in the rural areas and

replaced if necessary as part of this project. The City's Public Works
' Department will evaluate the storm sewer structures and will make
necessary repairs prior to the overlay.
4.4 Watermain
Shakopee Public Utilities will evaluate the water system on Stonebrooke
Drive and will make necessary repairs prior to the overlay. All other
properties are served with individual wells which are the responsibility of
' the property owner.

' 4.5 Easements
It is not anticipated that easement acquisition will be required for this
project.
5. SPECIAL ASSESSMENTS
' 30% of the project costs for the street improvements are proposed to be assessed
to the benefiting properties adjacent to the proposed project area. Properties
' adjacent to the improvements in the project area will be assessed on a unit basis
with corner lots being assessed one-half that of the interior lots. A corner lot is
defined as a lot of record with two sides adjacent to existing City streets. Non
' single family lots will be assessed the number of equivalent residential lots
resulting from dividing the properties front footage by the average lot frontage in
each project area. The remaining costs associated with the proposed street
improvements, will be paid with Storm Drainage Funds and Tax Levy.
The estimated unit assessment rates and equivalent residential lot widths for each
of the four areas within the project scope are as follows:

' will be based on the final project costs.
Properties proposed to be assessed are identified on Drawings No. 2 through 6 in
the Appendix.
6. ESTIMATED COSTS
An itemized cost estimate is included in the Appendix. The following costs were
prepared using 2007 construction costs and are subject to change, depending on
the final design of the project, bids received and actual work performed. A
summary of the estimated construction costs plus a 5% contingency and
1 engineering and administration costs for the project are as follows:
