Michael Leek, Community Development Director SUBJECT: Approval of a Registered Land Survey (RLS) for Properties in DEAN LAKES THIRD ADDITION- Ryan Companies DATE: August 8, 2006 INTRODUCTIONIDISCUSSION: Ryan Companies submitted a request for minor subdivision to re-configure lot lines for in DEAN LAKES THIRD ADDITION. The minor subdivision was approved administratively; however, when the City Clerk's office attempted to record the minor subdivision, they were informed that an RLS would be required before the County would record. Ryan Companies have prepared the attached RLS drawing. I have reviewed it and determined that the proposed RLS is consistent with minor subdivision that had previously been approved. ACTION REQUESTED: Offer Resolution No. 6848, a Resolution approving the Registered Land Survey, and move its approval. ~~../ R. Michael Leek Community Development Director H:\CC\2006\06056 Ryan Minor Subd-RLS.doc RESOLUTION NO. 6848 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA, APPROVING A REGISTERED LAND SURVEY FOR PROPERTIES IN DEAN LAKES TIDRD ADDITION FOR THE RYAN COMPANIES WHEREAS, Ryan Companies, property owner and applicant, submitted a request for minor subdivision to re-configure lot lines for Lots 5, 6, and 7, Block 1, DEAN LAKES THIRD ADDITION for property that is located north ofCSAH 16 and east ofCSAH 83; and WHEREAS, the City had approved an administrative minor subdivision, and attempted to record the same, at which time the City leamed that the Scott County Recorder's office would require the preparation of an RLS for recording; and WHEREAS, the proposed RLS is consistent with the previously approved minor subdivision; and WHEREAS, the property upon which the request is being made is legally described as: Lots 5,6 and 7, Block 3, DEAN LAKES THIRD ADDITION, , Scott County, Minnesota; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, as follows: That the Registered Land Survey submitted by Ryan Companies is hereby approved, subject to the following conditions: 1. The City shall retain all existing drainage and utility easements. 2. The applicant shall provide electronic (Auto CAD) files ofthe property line adjustment to the Engineering department. 3. Municipal water service is available subject to Shakopee Public Utilities (SPUC) standard terms and conditions. These include but are not limited to: installing a lateral water main distribution system in accordance with utility policy, paying the associated inspections costs, paying the Trunk Water Charge, and paying the Water Connection Charge. These include, but are not limited to: entering into an Underground Distribution Agreement, granting any necessary easements, and paying the associated fees. 5. Street lighting installation is available subject to SPUC standard terms and conditions. These are contained in the current City of Shakopee Street Lighting Policy. Applicant must pay the associated fees. 6. The applicant must contact SPUC directly for specific requirements relating to their proj ect. BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby authorized and directed to approve and accept said Registered Land Survey.
