SUBJECT: Cost Sharing of Pike Lake Road with the
Developer of Ridge View Estates

INTRODUCTION:
This agenda item is to request City Council direction on cost sharing of Pike Lake Road
improvements with the developer of Ridge View Estates.
BACKGROUND:
The developer of Ridge View Estates is Tollefson Development and previously they
signed a purchase agreement with the City for the purchase of 37 acres for the future plat
of Ridge View Estates. III this purchase agreement, the developer agreed to construct
Pike Lake Road, from C.R. 16 to the existing terminus of Southbridge Parkway,
including sidewalk, bituminous trail and street lights. The City's responsibility was to
pay for the cost of wetland mitigation associated with the construction of Pike Lake
Road. Attached to this memo is an excerpt of the purchase agreement for the
construction of Pike Lake Road.
III discussions with the developer, there are three areas in which the City could or should
participate in the cost sharing of the Pike Lake Road improvements and they are as
follows:
1. Turn lanes on Pike Lake Road for Crossings Boulevard and C.R. 21. Also
included in this turn lane is construction of a future fire station access off of Pike
Lake Road.
2. Over length extension of a double box culvert or a three sided span arch structure
over the Prior Lake Channel crossing on Pike Lake Road.
3. Street lighting on Southbridge Parkway and Pike Lake Road.
Item No. 1- Turn lanes and future access road to the future fire station site. An
estimated cost for this item is $45,000 - $50,000 for turn lanes and access road
construction. Recently, staffhad WSB & Associates review the horizontal alignment and
configuration of Pike Lake Road. Their recommendation was to add turn lanes on
Crossings Boulevard and CSAH 21 and also to provide turn lanes to our future fire
station access. These additional turn lanes and fire station access was not contemplated
at the time of the signing of the purchase agreement by the developer. Thus, staff feels
that this item is an appropriate item to participate in the cost for the Pike Lake Road
improvements.
Item No.2 - Box culverts or span arch bridee needed to cross the Prior Lake
Channel on Pike Lake Road. This does require extra length due to turn lanes being
constructed in this area for Crossings Boulevard. Staff is estimating that the cost
participation in this area would be $40,000. However, no cost estimates have been
received from the developer in order to finalize a cost sharing amount for this item. The
rationale by staff for participation of this item is that the structure is needed to be
lengthened due to the turn laneand collector road width. The agreement doesn't indicate
any oversizing or over length in participation of the box culvert. However, staff does feel
that the over length, due to the turn lanes and Pike Lake Road being a collector road, does
justify some participation by the City in this area.
Item No.3 - Street liehtine alone Southbridee Parkway and Pike Lake Road. III the
agreement it specifically says that the developer is responsible for street lights along this
corridor. Pike Lake Road is a collector street as is Southbridge Parkway. Southbridge
Parkway does have special street lighting that was approved by City Council with the
Southbridge development. These special street lights are a much higher cost than regular
street lights on a collector. III past agreements on collector streets and on collector streets
with City assessments, the City has picked up SO% of the cost of the street lighting
system and assessed or been reimbursed for the other 50% by developers or property
owners. Staff would like direction on this item as to if the City should participate with
the street lights on Pike Lake Road and Southbridge Parkway. At this time there has
been no street light estimate from Shakopee Public Utilities and hopefully a cost estimate
can be obtained by the July 18th meeting.
Staff is currently estimating City costs for these items mentioned as follows:
1. Turn lane and fire station access road grading $45,000
2. Over length box culvert structure $40,000
3. Street lighting $2S,000
The estimated total for City participation is $110,000. Funds exist in the CIF.
III summary, staff is looking for Council direction on cost participation on Pike Lake
Road, recognizing that a purchase agreement was signed by the developer for
constructing Pike Lake Road. There was no specific language for the City to participate
in Pike Lake Road construction other than the wetland mitigation associated with Pike
Lake Road construction. It should be pointed out that the City's cost in wetland
mitigation has been much higher than previously estimated and the City is fulfilling its
obligation in this agreement. Staff does feel that there should be some participation in the
turn lanes and access road to the future fire station site. Also, an extra over length of a
box culvert, due to turn lanes, and perhaps some participation in street lights because of
the special lighting district on Southbridge Parkway. The developer may have other
items in which they would request participation and they may bring this to Council's
attention at the meeting.

1. Provide staff direction in cost participation of Pike Lake Road in the areas as
mentioned in this memo.
2. Provide staff direction on items, as mentioned in this memo, and other items as
discussed with the developer.

RECOMMENDATION~
Staff recommends Alternative No.1, to provide staff direction in the three areas, as
mentioned in the memo, in order to complete a reimbursement agreement as part of the
development of Ridge View Estates.
ACTION REQUESTED:
Provide staff direction in cost participation of Pike Lake Road in the areas as mentioned
in this memo.

Here is the text from the purchase agreement for Pike Lake Road.
11. Future Construction of Pike Lake Road. Subject to Closing, and in connection with
Buyer's intended subdivision development of the Property, Buyer agrees to dedicate approximately 40
linear feet along. the east line of the Property, from County Highway 16 north to northeast corner of the
said Property, for use as public road right of way and, subject to Seller's dedication of additional public
road right-of-way upon Seller's Retained Parcel, will construct, at Buyer's cost, improvements for the

Buyer to dedicate the any portion of the Property for Pike Lake Roa d right of way, or to construct Pike
Lake Roa d until such time as the City approves a final plat for the Property. The parties acknowledge
that a portion of currently proposed Pike Lake Road is situated on parcels adjacent to the Property
("Additional Parcels"), which parcels are owned by third parties. Buyer shall be responsible for
acquiring any Pike Lake Road right of way on the Additional Parcel owned by Mark 1. and Lois 1.
Liesener ("Liesener Parcel") but shall have no obligation to acquire and right of way for Pike Lake
Roa d on the Additional Parcel owned by Terrance W.Hansonand/or Randall Noecker ("Noecker
Parcel"). Seller will make good faith efforts to acquire needed right of way on the Noecker Parcel in a
timely manner to enable Buyer complete Pike Lake Roa d in accordance with Buyer's development
schedule for the Property. If Selleris unable to acquire right of way for Pike Lake Road on the Noecker
Parcel prior to Buyer's commencement of subdivision development on the Property, Seller shall
nevertheless permit Buyer to obtain development approvals for Buyer's proposed subdivision
development of the Property, including building permits and occupancy certificates, and to construct,
and temporarily use and maintain, improvements for Pike Lake Road on that portion of the proposed
Pike Lake Road right of way located on the Property, the Liesener Parcel and Seller's Retained Parcel
provided that the improvements constructed there on are (i) consistent with the final approved plans for
the entirety of the Pike Lake Road extension, and (ii) sufficiently wide to permit transit of fire
department equipment and vehicles to all portions of Buyer's proposed development. When additional
Pike Lake Roa d right of way is acquired on, or is dedicated pursuant to development of, the Noecker
Parcel, Buyer shall promptly construct the improvements for Pike Lake Trail on such right of way
located on the Noecker Parcel. Seller shall be responsible for, and shall bear the full cost of, all wetland

RE: Cost Sharing of Pike Lake Road
Dear Gary:
This letter is to update you as to the cost sharing of Pike Lake Road, from Southbridge
Parkway to CSAH 16. City staff has met with you several times to go over costs and get
cost estimates for consideration of cost sharing. It has been pointed out to you that the
City would participate in the turn lanes and the entrance road into the future fire station
site, as well as consideration of box culverts or three sided box culverts under Pike Lake
Road for the Prior Lake Channel, and for the street lighting system on Pike Lake Road.
The exact amount of cost participation needs to. be determined before we go the City
Council for approval. I would like to go to City Council on July 18, 2006 with an agreed
upon number.
I will be on vacation until July 10, 2006 and would like costs prepared for the street
lighting system, the approved three sided box or 12X5 double boxes, the turn lanes and
the access for the fire station. If you have any questions in regard to this issue in my
