INTRODUCTION
Ridge Creek I, Inc. (Randy Noecker) has requested approval of the preliminary plat of
Ridge Creek. The subject site is located north of County Road 16 and east of Pike Lake
Road (extended). The plat as proposed creates 153 single-family residential lots and
provides for approximately 6 acres of park area. The plat also proposes to relocate the Prior
Lake Outlet Channel. Copies of reports to the Planning Commission have been attached for
the Council's information.
DISCUSSION
The June 6, 2006 report to the Planning Commission identified several important,
unresolved issues associated with the request:
1) The EAC recommended that the applicant provide wetland mitigation either offsite
but within the Lower Minnesota Watershed District (LMWD) or if this option was not
available, that the applicant provide was required to complete wetland mitigation completely
on-site;
2) Prior Lake-Spring Lake Outlet channel construction issues, i.e. the developer has
been asked to pay the basic cost of grading the new channel, but does not wish to pay for
that cost; and
3) Site grading issues; Specifically, the developer wishes to grade the site in phases.
City staff does not support this alternative and would require the developer to grade the
entire site, as well a provide access directly from CSAH 16 across the site for trucks hauling
fill, rather than using other adjacent City streets.
At the June 6 meeting, the applicant indicated that he was willing to provide an extension to
the review period to July 18 in order to allow for additional time to complete his wetland
mitigation efforts. The applicant did provide, in writing, an extension to the review period
to July 18.

At the June 6 meeting, the City Council tabled action on this application in order to allow
the applicant time to finalize his wetland mitigation plans. The applicant has indicated via
voice mail and email that he is continuing to work toward resolution of this issue, however,
at the time of the preparation of this report, staff has not received any written information
relative to wetland mitigation.
Because these items are not yet resolved, because July 18 is the deadline for action by the
City Council, and because it is consistent with the Planning Commission recommendation,
staffhas attached a draft resolution of denial for the Council's information.
ALTERNATIVES
1. Approve Resolution No. 6429, a resolution denying the preliminary plat of Ridge
Creek.
2. Approve Resolution No. 6429 with revised findings.
3. Approve the requested preliminary plat, and direct staff to prepare a resolution
consistent with that action, and secure approval of an extension of the review period
from the applicant in order to prepare the resolution for Council action.
PLANNING COMMISSION RECOMMENDATION
At its May 18th meeting the Commission unanimously recommended denial ofthe
preliminary plat.
ACTION REQUESTED
Offer Resolution No 6429, as.presented or with revisions, and move its adoption.

RESOLUTION NO. 6429
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA DENYING THE
PRELIMINARY PLAT OF RIDGE CREEK
WHEREAS, Ridge Creek I, Inc., has made application for preliminary plat
approval of Ridge Creek on property located at 7301 Eagle Creek Boulevard; and
WHEREAS, the Shakopee Planning Commission conducted a public hearing on the
preliminary plat on May 4 and May 18, 2006; and
WHEREAS, all required public notices regarding the public hearing were posted
and sent; and
WHEREAS, the Shakopee Planning Commission has recommended denial of the
requested preliminary plat based on the fIndings below; and
WHEREAS, the City Council reviewed the preliminary plat request at its meetings
of June 6 and July 18, 2006.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SHAKOPEE, MINNESOTA, that it adopts the following fmdings offact
relative to the requested preliminary plat approval:
Finding A: The proposed plat does not meet the requirements identified by the
Environmental Advisory Committee (EAC) regarding wetland
mitigation.
. The EAC recommendation requires the applicant to provide off-
site wetland mitigation within the Lower Minnesota Watershed
District (LMWD). If the applicant is unable to meet this
requirement, wetland mitigation should be provided on-site.
. The applicant has not made accommodations to meet either
option outlined by the EAC.
Finding B: The applicant has communicated that he is unwilling to contribute, as
a part of his overall grading plan, the cost of grading the new
alignment of the Spring Lake-Prior Lake Oultet Channel as approved
by the Watershed District/City of Shakopee and as shown in the
submitted preliminary plat.
Finding C: The applicant desires to complete site grading on the subject site in
an incremental fashion. The City of Shakopee would require that site
grading occur in one phase over the entire development area, and that
the developer should provide a direct haul route on the subject site

for trucks bringing in fill, in order to avoid undue wear on newly
constructed, adjacent City streets.
Finding D: That the review deadline is imminent and the applicant has not
addressed the outstanding and significant issues identified by the
City of Shakopee.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE, MINNESOTA, that Ridge Creek I, Inc. request for preliminary plat
approval of Ridge Creek is hereby denied.

INTRODUCTION
Ridge Creek I, Inc. (Randy Noecker) has submitted an application for preliminary plat approval of Ridge
Creek. Please see Exhibits A and B for location and proposed design. After initial review by the
Environmental :Advisory Committee (EAC) and Park and Recreation Advisory Board (pRAB), it was
necessary for the applicant to provide revised drawings. These revisions were received by the City on
February 22, 2006. Because these drawings did not completely reflect the recommendations of the
EAC/PRAB, a second review by the EAC/PRAB was necessary. The EAC/PRAB reviewed the revised
drawings at is April 24, 2006 meeting.
On April 24th, the discussion by the EAC/PRAB focused primarily on woodland management issues and
wetland mitigation. Ultimately, the EAC/PRAB voted 3-1 to recommended approval of the preliminary
plat subject to the conditions outlined in the January 18, 2006 report and subject to allowing wetland
mitigation to occur off-site if the mitigation occurs within the Lower Minnesota River Watershed District
(LMRWD). If the developer is unable to mitigate the wetlands within the LMRWD, mitigation is
required to occur on site.
At the time this memorandum was being prepared, the applicant communicated to staff that he was
working on trying to accomplish off-site mitigation but had not yet finalized a deal to guarantee the ability
to complete off-site mitigation. Additional outstanding significant concerns for the plat application
include outlet channel construction and site grading issues.
Due to the approaching deadline of July 1 and staffs desire to preserve the opportunity for the City
Council to review the application at two meeting dates, if necessary, staff is providing a recommendation
for the Planning Commission's consideration at this time.
STAFF RECOMMENDATION
Due to the outstanding significant issues identified above (I.e. fmalization of wetland mitigation plans,
outlet channel construction issues, and overall site grading and access issues) and the review peIiod
deadline, staff recommends that at this time the Planning Commission recommend to the City Council
denial of the preliminary plat application.

Because of the looming review deadline and remaining unresolved significant issues, offer a motion to
recommend to the City Council the denial ofthe preliminary plat of Ridge Creek crt this time, and move
its adoption.
