SUBJECT: Request of S.M. Hentges & Sons, Inc. on C.R. 101, from
CSAH 17 to Mill Pond Bridge, Project No. 2006-3

INTRODUCTION:
By letter dated June 12, 2006, S.M. Hentges & Sons, Inc., the contractor for Scott
County, City of Shakopee and Shakopee Public Utilities has requested that City Code
Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on
Certain Operations, be suspended for certain work hours.
BACKGROUND:
The above named section of the City Code restricts the hours of operation from 7:00
A.M. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and
holidays.
S.M. Hentges & Sons, Inc. is requesting a suspension on the hours as follows:
1. For bituminous work on C.R. 17 the week of June 26-30
(10:00 P.M. - 6:00 A.M.)
2. Monday - Friday 7:00 A.M. - 8:30 P.M.
Saturday 8:00 A.M. - 5:30 P.M.
S.M. Hentges & Sons is requesting these hours due to a tight schedule to complete the
work and operations of the work is such that working at night is required by Scott
County.
Staff would recommend that if the suspension of hours is granted, that the approval is
subject to the following conditions:

I. Approval is contingent upon minimizing noise exposure near residential areas.
2. If residential complaints are received by the City, the suspension can be revoked at the
discretion of the City Engineer.
If Council approves the suspension, a public notice to meet the City Code requirements
and notice such as a news release would be placed in the Shakopee Valley News.
ALTERNATIVES:
1. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, per this memo, and
direct staff to publish notice of the suspension terms with the conditions as
recommended by staff.
2. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, for some other period
of time as determined appropriate by the City Council, and direct staff to publish
notice of the suspension terms.
3. Do not approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D.
RECOMMENDATION:
Staffrecommends Alternative No.1.
ACTION REQUESTED:
Offer a motion approving a suspension of City Code Sec. 10.60, Noise Elimination and
Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, per this memo,
and direct staff to publish notice of the suspension terms with the conditions as
recommended by staff.

Dear Mr. Loney,
S.M. Hentges & Sons Inc. requests extended working hours on the above referenced
project to expedite work for the inconvenience of all the local businesses adjacent to the
project. Also access to the existing trailer court will be a restricted detour entrance at
times when utility work is directly in front of their entrance. The specifications require
black topping on County Road .l7 to be done at night.
We request the following hours:
1. For bituminous work on County Road 17 during the week of June 26-30 for
bituminous placement on the night of placement 10:00 p.rn. - 6:00 a.m.
2. General construction work on all other phases:
Monday - Friday 7:00 a.rn. - 8:30 p.m.
Saturday 8:00 a.rn. - 5:30 p.rn.
