CITY OF SHAKOPEE CONSENT Memorandum CASE NO.: 06-025 TO: Mayor and City Council Mark McNeill, City Administrator FROM: Mark Noble, Planner II SUBJECT: Preliminary and Pinal Plat of Vierling Estates 1 st Addition MEETING DATE: June 20, 2006 REVIEW PERIOD: February 10, 2006 - June 9, 2006 (Applicant has granted a 30 day extension) DISCUSSION Shakopee Development, LLC, has submitted an application for preliminary and final plat approval of Vierling Estates 1 st Addition, located north of Highway 169, south of Vierling Drive, and east of Calvary Church (Exhibit A). The plat, as currently proposed, contemplates the creation of 13 multi-family residential structures, totaling 43 units, on approximately 8.4 acres of land (5.12 units/acre density). The submitted plat application identifies lots that will have two (2) accesses off Vierling Drive, one being directly across from Jasper Road, with the interior drive designed to be 28 feet wide. The structures would consist of two, three and four unit buildings, comprised of two story and rambler type structures, and front loading garages. Building materials proposed include brick, wood, vinyl and hardi-plank siding. Based on previous discussions, the applicant provided a revised plan that included additional parking along the private drive and in the cul-de-sac. This action resulted in the removal of a tot lot, and if this plan is approved, it would require the relocation of several trees to avoid conflict with the new parking spaces. VISIONING RELATIONSHIP This action supports: Goal D: " Vibrant, resilient and stable" PLANNING COMMISSION RECOMMENDATION The Planning Commission reviewed the preliminary plat at its June 8, 2006 meeting, and by a 7-0 vote, they recommended approval of the preliminary plat application, with revisions. Specifically, the Commission discussed the inclusion of additional parking spaces along the drive and cul-de-sac, which resulted inthe elimination of the tot lot, and they discussed eliminating a condition concerning requiring the installation of a sidewalk and/or trail along the drive in the development, although they stressed the Council may reinstate that condition if they feel it would be beneficial to include sidewalks in this development. Those revisions have been incorporated into the draft resolution attached to this report. Conditions no. II. K. and II. P. (identified in the resolution as struck- through) are the conditions the Commission are recommending be removed. Andrea Weber, Parks and Recreation Landscape Design, had provided those conditions that the Commission recommended be removed. Ms. Weber has provided a memorandum that addresses her rationale for retaining those conditions, which has been attached for the Council's information. ALTERNATIVES 1. Approve Resolution No. 6442, approving the Preliminary and Final Plat for Vierling Estates 1st Addition, subject to the conditions presented. 2. Approve Resolution No. 6442, approving the Preliminary and Final Plat for Vierling Estates 1 st Addition, subject to revised conditions. 3. Do not approve the preliminary and final plat and direct staff to prepare a resolution consistent with the direction of the Council. 4. Table the matter and request additional information from staff and/or the applicant. WHEREAS, the Planning Commission reviewed the preliminary plat on June 8, 2006, and recommended approval of the plat with conditions; and WHEREAS, the City Council reviewed the proposed preliminary and. final plat on June 20, 2006. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Shakopee, Minnesota that the preliminary and final plat of Vierling Estates 15t Addition is hereby approved subject to the following conditions: I. The following procedural actions must be completed prior to the recording of the Final Plat: A. Approval of title by the City Attorney. B. Execution of a Developer's Agreement, which shall include provisions for security for public improvements within the plat and the engineering review fees, and any other fees as required by the City's adopted fee schedule. 1. Shakopee Public Utilities Commission shall be contacted if the applicant wishes to contract with them for security lighting. 2. Electrical system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 3. The developer shall be responsible for payment of Trunk Storm Water Charges, Trunk Sanitary Sewer Charges, Trunk Storm Water Storage and Treatment Charges, security for the public improvements, engineering review fees, and other fees as required by the City's most recent adopted Fee Schedule. 4. No public improvements shall be constructed until the City Engineer and the Shakopee Public Utility Commission approve the Final Construction Plans and Specifications. 5. The applicant shall obtain an NPDES permit prior to any land disturbing activity. A copy of this permit shall be provided to the City. The applicant shall adhere to all MPCA NPDES Phase II permit requirements for erosion control before, during, and after earth moving activities. 6. Verify the exact location of the high-pressure natural gas transmission pipeline prior to the installation of any utility service line. C. Shakopee Public Utilities Commission requires the watermain be looped with two connections to existing watermain in Vierling Drive, one at either end of the site. D. Shakopee Public Utilities Commission plans to install two main line underground electric feeders within the 10 foot drainage and utility easement along the south property line of this property and adjoining properties. E. Easements shall be shown on the Preliminary Plat and the Final Plat as approved by the City Engineer. They shall include, but not be limited to, the following: . Provide a minimum of twelve (12) feet of trail easement for the bituminous trail being constructed as part of this project. . Provide a minimum of ten (10) feet of drainage and utility easement between Lots 11 and 12 of Block 1. . Provide a minimum of ten (10) feet of drainage and utility easement between Lots 18 and 19 of Block .1. . Provide a minimum of ten (10) feet of drainage and utility easement between Lots 21 and 22 of Block 1. . Provide a minimum of ten (10) feet of drainage and utility easement between Lots25 and 26 of Block 1. . Provide a minimum of ten (10) feet of drainage and utility easement between Lots 31 and 32 of Block 1. . Provide a minimum of ten (10) feet of drainage and utility easement between Lots 34 and 35 of Block 1. . Provide adequate drainage and utility easements at the top and bottom of all proposed retaining walls. F. The storm water management plan shall be approved by City Engineering. G. The applicant shall meet park dedication requirements by providing cash in lieu of land dedication. Park dedication fees in the amount required by the City Code and adopted City fee schedule shall be paid prior to the recording of the final plat. If any portion of the property is being platted as outlots to accommodate a phased development, the park dedication fees for each future phase shall be based on the fees in effect at the time of final plat approval for those outlots and shall be paid before the final plat for those outlots is recorded. H. The applicant shall construct an eight (8) foot wide bituminous trail along the property line adjacent to Vierling Drive along the edge of the public right-of-way, where possible, with construction to be coordinated by the City Engineering Department. 1. All trails shall be ADA compliant. J. The applicant shall provide and install trail boundary signage as determined to be needed by the city along the trail. K. The applicant shall obtain a grading permit prior to any additional land disturbing activity. L. The applicant shall comply with MnDOT's recommendations concerning storm sewer drainage/outlets and permit requirements for any work within or affecting their right-of-way. The applicant shall obtain the necessary MnDOT approvals for the proposed emergency overflow directed to their right-of-way. The applicant shall be financially responsible for all MnDOT approvals. M. The applicant shall obtain the necessary permission, right-of-way and/or easements to perform all proposed work offsite or within existing easements. N. The applicant shall obtain a right-of-way permit prior to work within the City of Shakopee's right-of-way. O. The applicant shall obtain the appropriate Wetland Conservation Act (WCA) permits and approvals prior to issuance of a grading permit. P. The applicant shall work with City of Shakopee staff to eliminate all proposed retaining walls from within drainage and utility easements. Q. No final graded slopes in non-paved areas shall exceed three (3) feet horizontal to one (1) foot vertical (3: 1), nor shall they be less than two (2) percent. R. All proposed driveways, sanitary sewer and storm sewer shall be considered private. S. The applicant shall provide an outlet control structure for the proposed storm water basin as per City of Shakopee requirements. T. The applicant shall provide an ultimate Emergency Overflow (EOF) for the site's storm.sewer system. The location and elevation shall be approved by the City of Shako pee. The City of Shako pee's engineering department shall inspect these private improvements and the developer shall pay all administrative, plan review and inspection costs as though the improvements were public. U. The applicant shall adjust all elevations to comply with freeboard requirements set forth by the City of Shakopee as they relate to the approved High Water Level (HWL) of the existing storm water basin/wetland. V. The applicant shall eliminate all proposed impacts to the existing storm water basin/wetland. W. The applicant shall work with City of Shakopee staff to mitigate impacts to the existing storm water basin adjacent to Vierling Drive. X. The applicant shall work with City of Shako pee staff to provide additional water quality treatment volume in the existing storm water basin adjacent to Vierling Drive. y. The applicant shall eliminate all retaining walls and their associated foundation from below the approved High Water Level (HWL). Proposed lots may be eliminated to accommodate. Z. The minimum allowable storm sewer pipe diameter shall be twelve (12) inches. AA. The proposed private driveway within the site shall be a minimum of twenty-eight (28) feet wide (measured from back of curb to back of curb). BB. The proposed private driveway, private sanitary sewer and private storm sewer within the site shall be designed to standards approved by the City of Shakopee. CC. The applicant shall work with City of Shakopee staff to move the proposed sanitary sewer to the centerline of all driveways. DD. The applicant shall work with City of Shakopee staff to provide nine (9) feet of cover over all proposed sanitary sewer. EE. The entrance to Vierling Drive shall be thirty-seven (37) feet wide (measured from back of curb to back of curb). The proposed concrete curb and gutter matching into the existing curb and gutter in Vierling Drive shall have radii measuring twenty-five (25) feet. All curb and gutter within the right-of-way shall be B618. II. Following approval and recording of the final plat, the following conditions shall apply: A. Building construction, sewer, water service, fire protection and access will be reviewed for code compliance at the time of building permit application( s), B. The developer and/or their assigns shall be responsible for any required or desired noise or dust mitigation measures. C. Shall provide electronic (Auto CAD) files ofthe Final Plat to the Engineering Department. D. The applicant shall meet the screening and landscaping ordinance requirements of the City Code. E. The drives shall be posted "No Parking, Fire Lane" on at least one side. F. The applicant shall provide six (6) inches of topsoil below areas to be sodded. The soil composition should be similar to the MnDOT topsoil borrow requirements. G. The applicant shall provide rain sensors for any irrigation system. H. The applicant shall implement the use of Best Management Practices for erosion control and stormwater management during construction. I. The applicant shall utilize the MPCA Protecting Water Quality in Urban Areas as a technical reference for erosion control. J. Silt fence and/or tree protection fence is to be removed following establishment of vegetation as determined by an inspection by City staff. ~ The Tot Lot, which is a private amenity, seems very small to accommodate a play structure '.vith adequate safety zones. The size sho'?lR, 25'x35' '?mn't accommodate any sv:ing bays, but possibly can accommodate a smaller structure intended for young children. There should also be a trail or sidevlalk access to the tot lot with an f..Df.. curb ramp. The applicant shall ensure that CP8C and A8TM 1187 01 safety guidelines as well as f..Df.. standards ar.c all met in this tot lot. L. Provide screening of any proposed trash enclosure areas consistent with the City Requirements. M. Install an eight foot high sound wall along the south property line, consistent with the traffic noise assessment report. N. Comply with the conditions of the approved Conditional Use Permit Resolution No. PC05-078. O. The applicant must meet the City's Woodland and Tree Management Ordinance requirements. P. There arc no internal '.valks or trails conneeting the private drive to the residences. The developer shall provide a sidewalk on at least one side of the N 8 portions of the private driyc from Vierling Dri'le, at a minimum, and along one side of the B '.V portion of the drive. f.. sidewalk to the tot lot is also a strong recommendation, to ensure vehicle and pedestrian separation for the young children v..ho will use this facility. Q. There should be ADA compliant curb cuts (with truncated dome panels) at all trail and sidewalk connections and crossings. R. The entire trail width should not be impacted by utility structures. S. The tree planting detail should note that "wood mulch should be kept 4" from the base of the trunk." This reduces potential girdling of the tree due to rodent damage. T. The applicant shall design the storm pond to provide a natural appearing shoreline with an irregular edge with points and bays. The applicant shall provide more rounded slopes for the proposed storm water basin. U. The applicant shall meet the requirements of the Noise Assessment Report or staff conditions regarding the height of the sound wall, whichever is applicable. V. The proposed trail alignment along Vierling Drive is over existing light poles and utility boxes. W. The proposed storm pond and disturbed existing storm pond be seeded with a native wetland seed mixture and erosion control blanket be placed four feet either side of the normal water level and around outlets to prevent erosion and sediment deposits into the wetland mitigation sites and enhancement areas. X. The proposed location of the silt fence around the existing stormwater pond shall be located above NWL. Y. The proposed sound wall location onthe grading plan does not match the proposed sound wall location on the landscape plan. This shall be corrected and approved by the city, as this discrepancy effects the locations of the proposed trees. Z. The landscape plan proposes to re-establish native vegetation in the existing storm pond and proposed storm pond from the emergent zone to the top of pond. Indicate seed mixtures information on this plan as it corresponds to the SWPPP. AA. Do not plant trees or shrubs in drainage and utility easements. BB. Plant trees and shrubs a minimum of 5 feet from property lines. CC. The applicant shall plant a diversity of tree species to reduce the impacts of potential tree diseases or epidemics that may occur in the future. The applicant must plant different species adjacent to each other and may not plant more than 15 trees of the same species. Recommended tree species to utilize in this area are: a. Hackberry (Celtis occidentalis) b. Northern Catalpa (Catalpa speciosa) c. Bur oak (Quercus macrocarpa) d. White cedar (Thuja occidentalis) e. Eastern white pine (Pinus strobes) DD. Provide 18 parking spaces along the main road and cul-de-sac, as identified in the site plan dated May 8, 2006. EE. Relocate those trees that would be in conflict with the parking spaces along the main road and cul-de-sac. The plat, as currently proposed, contemplates the creation of 13 multi- family residential structures, totaling 43 units, on approximately 8.4 acres of land (5,12 units/acre density). The property in question received conditional use permit (CUP) approval on August 18,2005 (Resolution No. PC05-078), and included 35 conditions of approval. One ofthe conditions of approval was that the applicant submit a minor subdivision application, but was informed by Scott County that a preliminary and final plat would be required. The submitted plat application identifies lots that will have two (2) accesses off Vierling Drive, one being directly across from Jasper Road, with the interior drive designed to be 28 feet wide. The structures would consist of two, three and four unit buildings, comprised of two story and rambler type structures, and front loading garages. Building materials proposed include brick, wood, vinyl and hardi-plank siding. The Commission discussed at their May 18th meeting whether additional parking spaces > shall be provided, with the applicant stating that they will attempt to provide additional spaces where they can on the street and in the cul-de'-sac. Other elements of this project include a stormwater detention pond and an eight foot tall screen fence and extensive landscaping along the property line adjacent to Hwy. 169. The applicant is also proposing a play area/tot lot on this property. The applicant has submitted a traffic noise assessment prepared by David Braslau Associates, Inc. The Commission should determine whether the screen fence and landscaping provide a sufficient noise buffer for the future residents of these structures. The applicant is proposing to construct an 8 foot wide bituminous trail along Vierling Drive, consistent with city Design Criteria. Also, there are trees shown on the submitted landscape plan that are located in the 60 foot wide utility easement along the north property line. The developer was to confirm with Centerpoint Energy whether those trees will be allowed. If not allowed, staff requests that those trees shall be relocated outside of that easement yet in a location that would provide a visuallnoise buffer from Vierling Drive. The Engineering Department has reviewed the application and provided a memorandum, recommending approval of the Preliminary Plat and the Final Plat subject to the conditions being addressed by the applicant prior to recording of the Final Plat. Andrea Weber, Parks and Recreation Landscape Design, has provided comments, including requests ofthe Park and Recreation Advisory Board, which have been incorporated into the draft resolution. Ryan Hughes, Natural Resource Specialist, provided comments, including EAC recommended conditions of approval. Those conditions have been incorporated into the draft resolution. Shakopee Public Utilities offered comments, noting that street lighting is not required on private drives, that the watermain must be looped with two connections to the existing watermain in Vierling Drive, one at either end ofthe site, and Shakopee Public Utilities plans to install two main line underground electric feeders within the 10 foot drainage and utilities easement along the south property line of this property and adjoining properties. Jim Grarnpre, City Building Official, questioned whether the design accounts for noise mitigation regarding window specifications. The Fire Inspector commented that the drives shall be posted "No Parking, Fire Lane" on at least one side. The Minnesota Department of Transportation (MnDOT) has provided a letter concerning several items with this application. The applicant should be in contact with MnDOT to address their questions. . STAFF RECOMMENDATION Staff recommends that the Planning Commission recommend to the City Council the approval ofthe Preliminary Plat of Vierling Estates 1st Addition, subject to the following conditions: I. The entrance to Vierling Drive shall be thirty-seven (37) feet wide (measured from back of curb to back of curb). The proposed concrete curb and gutter matching into the existing curb and gutter in Vierling Drive shall have radii measuring twenty-five (25) feet. All curb and gutter within the right-of-way shall be B618. II. Following approval and recording of the final plat, the following conditions shall apply: A. Building construction, sewer, water service, fire protection and access will be reviewed for code compliance at the time of building permit application(s). B. The developer andlor their assigns shall be responsible for any required or desired noise or dust mitigation measures. C. Shall provide electronic (Auto CAD) files ofthe Final Plat to the Engineering Department. D. The applicant shall meet the screening and landscaping ordinance requirements of the City Code. E. The drives shall be posted "No Parking, Fire Lane" on at least one side. F. The applicant shall provide six (6) inches oftopsoil below areas to be sodded. The Tot Lot, which is a private amenity, seems very small to accommodate a play structure with adequate safety zones. The size shown, 25'x35' won't accommodate any swing bays, but possibly can accommodate a smaller structure intended for young children. There should also be a trail or sidewalk access to the tot lot with an ADA curb ramp. The applicant shall ensure that CPSC and ASTM 1487-01 safety guidelines as well as ADA standards are all met in this tot lot. L. Provide screening of any proposed trash enclosure areas consistent with the City Requirements. M. Install an eight foot high sound wall along the south property line, consistent with the traffic noise assessment report. N. Comply with the conditions ofthe approved Conditional Use Permit Resolution No. PC05-078. O. The applicant must meet the City's Woodland and Tree Management Ordinance requirements. P. There are no internal walks or trails connecting the private drive to the residences. The developer shall provide a sidewalk on at least one side of the N-S portions ofthe private drive from Vierling Drive, at a minimum, and along one side of the E-W portion of the drive. A sidewalk to the tot lot is also a strong recommendation, to ensure vehicle and pedestrian separation for the young children who will use this facility. . Q. There should be ADA compliant curb cuts (with truncated dome panels) at all trail and sidewalk connections and crossings. R. The entire trail width should not be impacted by utility structures. S. The tree planting detail should note that "wood mulch should be kept 4" from the base of the trunk." This reduces potential girdling of the tree due to rodent damage. T. The applicant shall design the storm pond to provide a natural appearing shoreline with an irregular edge with points and bays. The applicant shall provide more rounded slopes for the proposed storm water basin. U. The applicant shall meet the requirements of the Noise Assessment Report or staff conditions regarding the height of the sound wall, whichever is applicable. V. The proposed trail alignment along Vierling Drive is over existing light poles and utility boxes. w.
