CITY OF SHAKO PEE Memorandum CASE NO.: 06-062 TO: Mayor and City Council Mark McNeill, City Administrator FROM: Mark Noble, Planner II RE: Appeal of the Board of Adjustment and Appeals Determination on Allowable Building Materials for Valleyfair, located at One Valleyfair Drive DATE: June 20, 2006 INTRODUCTION Item No.5] A] 1. is a consent item that pertains to an appeal from Valleyfair regarding a variance request to allow building materials other than those. allowed by the City Code. Valleyfair has requested that this item be removed from the consent business and that they be allowed to discuss with the Council an alternative design to that which is presently a condition of the draft resolution. DISCUSSION Valleyfair has inquired of staff about being allowed to install materials other than brick on the south side of their two proposed storage buildings. Since the June 6th meeting, Valleyfair has conducted research into the potential construction costs of these buildings, and they have determined that brick would be a considerable cost; therefore, they would prefer to utilize an alternative material, preferably stucco or synthetic stucco, both of which are listed as permitted building materials in the City Code. ACTION REQUESTED Staff has prepared a resolution consistent with Council's direction from the June 6th meeting for Council action, which states that brick shall be provided on the south side of the proposed buildings; however, should the Council consider the alternative proposal being offered by Valleyfair, and provided they concur with the request, they should offer a motion to approve Resolution No. 6438 with revised conditions, and move its adoption. ~ --- Planner II g: \cc \2006\06- 20\appeal valleyfairvariance.doc S.A-.\l CITY OF SHAKOPEE CONSEN T Memorandum CASE NO.: 06-062 TO: Mayor and City Council Mark McNeill, City Administrator FROM: Mark Noble, Planner II RE: Appeal of the Board of Adjustment and Appeals Determination on Allowable Building Materials for Valleyfair, located at One Valleyfair Drive DATE: June 20, 2006 INTRODUCTION Valleyfair has filed an appeal of the Board of Adjustment and Appeals (BOAA) decision concerning a variance to allow for the construction of two (2) 40' by 32' steel sided buildings at their property, which is located at One Valleyfair Drive. The Board of Adjustment and Appeals held a public hearing on a variance request for Valleyfair at its May 18, 2006 meeting. By a 4-3 vote, the Board denied the Variance request. The Board determined that the request did not meet all of the criteria required for granting the variance, that there were numerous building materials available for the applicant to utilize that would be consistent with the City Code regulations, and that this is an opportunity for Valleyfair to improve the outwardly appearance of the park. Attheir June 6, 2006 City Council meeting, the Council reviewed the appeal submitted by Valleyfair, at which time they directed staff to prepare a resolution approving the request, allowing for brick on the south side of the buildings, with trees to be planted along the highway for screening. ALTERNATIVES 1. Approve Resolution No. 6438, a resolution approving the variance request to allow for the construction of two (2) 40' by 32' steel sided buildings, with conditions that brick be installed on the south side of the buildings, and trees to be planted along the highway for screening. 2. Do not approve Resolution No. 6438, and direct staff to prepare a resolution denying the request. 3. Table the decision for additional information. ACTION REQUESTED Offer a motion to approve Resolution No. 6438, a resolution approving the variance request to allow for the construction of two (2) 40' by 32' steel sided buildings, with conditions that brick be installed on the south side ofthe buildings, and trees to be planted along the highway for screening, and move its adoption. ~~. - M k Noble Planner II g:\cc\2006\06-20\appeaI valIeyfairvariance.doc RESOLUTION NO. 6438 A RESOLUTION OF THE CITY OF SHAKOPEE UPHOLDING THE APPLICANT'S APPEAL OF A VARIANCE REQUEST TO ALLOW FOR THE CONSTRUCTION OF TWO (2) 40' BY 32' STEEL SIDED BUILDINGS FOR V ALLEYFAIR, LOCATED AT ONE V ALLEYFAIR DRIVE WHEREAS, Valleyfair, applicant and property owner, has filed an application for an appeal of a determination by the Board of Adjustment and Appeals under the provisions of Chapter 11, Land Use Regulation (Zoning), of the City of Shakopee City Code, Section 11.90 (Appeals); and WHEREAS, the subject parcel ofland is presently zoned Major Recreation (MR) Zone with a Planned Unit Development (PUD) Overlay; and WHEREAS, the subject parcel of land for which the request is being made is legally described as: Exhibit 1 (attached); and WHEREAS, on May 18, 2006, the Board of Adjustment and Appeals (BOAA) conducted a review regarding a Variance request to allow the construction of new buildings constructed of steel materials at Valleyfair, located at One Valleyfair Drive, at which it heard from the Community Development Director or his designee and invited members of the public to comment; and WHEREAS, the BOAA denied the Variance request at their May 18, 2006 meeting; and WHEREAS, the applicant timely appealed the determination of the Board of Adjustments and Appeals; and WHEREAS, the City Council reviewed the appeal of the applicant at their meetings of June 6, 2006 and June 20, 2006; and WHEREAS, the City Council's reached the following findings with respect to the requested variance and applicable ordinance criteria; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, AS FOLLOWS: Finding l.A. The property in question cannot be put to a reasonable use if used under conditions allowed by the official controls. Finding 1.B. The plight of the applicant/landowner is due to circumstances unique to the property. Finding 1.C The circumstances were not created by the applicant/landowner. Finding J.D. The variance would not alter the essential character of the locality. Finding J.E. The problems do not extend beyond economic considerations. Finding 2 The proposed variance would not be in keeping with the spirit and intent of Chapter 11 (Zoning) in that it would allow additional signage beyond what is allowed by City Code. Finding 3 The request is not a use variance. Finding 4 (Dependent on the Board's action on the request.) Finding 5 (Not applicable since the property is not within the flood plain overlay zone) NOW THEREFORE, BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, AS FOLLOWS: That the decision of the Board of Adjustments and Appeals is hereby overturned, and Valleyfair's request for a variance to allow the construction of steel buildings is hereby approved with the following conditions: 1. That brick be installed on the south side of the buildings, and that City staff approved the elevation drawing for the south side as a part of the building permit review process; and 2. That City staff approve the landscape plan for planting screening trees between the buildings and CR 101.
