CITY OF SHAKOPEE Memorandum TO: Mayor and City Council Mark McNeill, City Administrator FROM: Julie Klima, Planner II SUBJECT: Preliminary Plat of Ridge Creek MEETING DATE: June 6, 2006 REVIEW PERIOD: Extended by written assent of the applicant to July 1,2006 CASELOG NO.: 06-004 INTRODUCTION Ridge Creek I, Inc. (Randy Noecker) has requested approval of the preliminary plat of Ridge Creek. The subject site is located north of County Road 16 and east of Pike Lake Road (extended). The plat as proposed creates 153 single-family residential lots and provides for approximately 6 acres of park area. The plat also proposes to relocate the Prior Lake Outlet Channel. Copies of reports to the Planning Commission have been attached for the Council's information. DISCUSSION The most recent (May 18, 2006) report to the Planning Commission identified several important, unresolved issues associated with the request: 1) The EAC recommended that the applicant provide wetland mitigation eitheroffsite but within the Lower Minnesota Watershed District (LMWD) or if this option was not available, that the applicant provide was required to complete wetland mitigation completely on-site; 2) Prior Lake-'Spring Lake Outlet channel construction issues, i.e. the developer has been asked to pay the basic cost of grading the new channel, but does not wish to pay for that cost; and 3) Site grading issues; Specifically, the developer wishes to grade the site in phases. City staff does not support this alternative and would require the developer to grade the entire site, as well a provide access directly from CSAH 16 across the site for trucks hauling fill, rather than using other adjacent City streets. Prior to the May 18th Planning Commission meeting the applicant indicated that he was negotiating with a property owner within the LMWD to acquire lands for the off-site wetland mitigation. At this time, staffhas not received any confirmation of whether or not the applicant will be able to accommodate the wetland mitigation off-site. In any event, the applicant has not provided any revised drawings to indicate how the mitigation could occur on-site. As such, the City has not received a response from the applicant on how he intends I to proceed regarding wetland mitigation, and because he has not complied with the EAC recommendations, the plat is not approvable in its present form.. Because these items are not yet resolved, because July 15t is the deadline for action by the City Council, and becau~e it is consistent with the Planning Commission recommendation, staffhas attached a draft resolution of denial for the Council's information. ALTERNATIVES 1. Approve Resolution No. 6429, a resolution denying the preliminary plat of Ridge Creek. 2. Approve Resolution No. 6429 with revised findings. 3. Approve the requested preliminary plat, and direct staff to prepare a resolution consistent with that action, and secure approval of an extension of the review period from the applicant in order to prepare the resolution for Council action. PLANNING COMMISSION RECOMMENDATION At its May 18th meeting the Commission unanimously recommended denial of the preliminary plat. ACTION REQUESTED Offer Resolution No 6429, as presented or with revisions, and move its adoption. ~1/~ J e Klima Planner II h:\cc\2006\06-06\06004 ridge creek denial.doc 2 RESOLUTION NO. 6429 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA DENYING THE PRELIMINARY PLAT OF RIDGE CREEK WHEREAS, Ridge Creek I, Inc., has made application for preliminary plat approval of Ridge Creek on property located at 7301 Eagle Creek Boulevard; and WHEREAS, the Shakopee Planning Commission conducted a public hearing on the preliminary plat on May 4 and May 18, 2006; and WHEREAS, all required public notices regarding the public hearing were posted and sent; and WHEREAS, the Shakopee Planning Commission has recommended denial of the requested preliminary plat based on the findings below; and WHEREAS, the City Council reviewed the preliminary plat request at its meeting of June 3, 2003. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, that it adopts the following fmdings of fact relative to the requested preliminary plat approval: Finding A: The proposed plat does not meet the requirements identified by the Environmental Advisory Committee (EAC) regarding wetland mitigation. . The EAC recommendation requires the applicant to provide off- site wetland mitigation within the Lower Minnesota Watershed District (LMWD). Ifthe applicant is unable to meet this requirement, wetland mitigation should be provided on-site. . The applicant has not made accommodations to meet either option outlined by the EAC. Finding B: The applicant has communicated that he is unwilling to contribute, as a part of his overall grading plan, the cost of grading the new alignment of the Spring Lake-Prior Lake OuItet Channel as approved by the Watershed District/City of Shakopee and as shown in the submitted preliminary plat. Finding C: The applicant desires to complete site grading on the subject site in an incremental fashion. The City of Shakopee would require that site grading occur in one phase over the entire development area, and that the developer should provide a direct haul route on the subject site 3 for trucks bringing in fill, in order to avoid undue wear on newly constructed, adjacent City streets. Finding D: That the review deadline is imminent and the applicant has not addressed the outstanding and significant issues identified by the City of Shakopee. Mayor of the City of Shakopee ATTEST: City Clerk 4 CITY OF SHAKOPEE MEMORANDUM To: Julie Klima, Project Manager From: Ryan Hughes, Natural Resource Specialist Date: April 27, 2006 Subject: Environmental Advisory Committee Review Ridge Creek Revised Preliminary Plat INTRODUCTION The revised Preliminary Plat for the proposed Ridge Creek development was reviewed and discussed at the April 24, 2006 Environmental Advisory Committee meeting. DISCUSSION Mr. Noecker (applicant) was present at the meeting to address the Environmental Advisory Committee's (EAC) natural resource concerns. The following issues were discussed extensively with the applicant at the meeting: 1. Wetlands The preliminary plat reviewed at the January 11, 2006 EAC meeting proposed mitigation be completed entirely on-site. The EAC supported the applicant completing mitigation on-site. At this meeting the EAC only discussed extending the maintenance and monitoring period to 10-years to be consistent with the maintenance and monitoring period for another development in the area. At the January 24,2006, Teclmical Evaluation Panel (TEP), a committee that provides technical oversight for the Wetland Conservation Act, the wetland delineation was approved and mitigation requirements were deferred to the Local Government Unit (City). On February 22, 2006 the applicant submitted a plan proposing all mitigation off-site. Based on discussions at various City Development Review Committee meetings it was determined by staff that the City, as the Local Government Unit, will require mitigation on-site. It was determined that the applicant has not exhausted all possibilities to avoid and minimize wetland impacts on-site and that mitigation could be completed on-site. At this meeting staffpresented the proposed wetland mitigation design discussed with the applicant at an April 12, 2006, Development Review Committee meeting. The design includes wetland mitigation adjacent to the channel with the storm water ponds designed to overflow into the mitigated wetlands and the mitigated wetlands C:\Documents and Settings\JKlima\Local Settings\Ternporary Internet Files\OLKA \042706 - Ridge Creek - EAC to PLANNING COMMISSION.doc designed to overflow into the channel. A similar design was approved for the Riverside Bluffs development, which mitigated on-site. The design is anticipated to increase the water quality of stormwater leaving the site by reducing nutrient loads entering the channel and discharging into downstream waterbodies. In addition, the design is anticipated to provide additional flood protection to area residents by allowing the channel to overflow into the mitigated wetlands. The design is consistent with the City's goal to preserve and create a natural resource corridor along the channel. Additionally, the wetland mitigation sites would be planted with native plant species providing habitat for many bird and mammal species to feed, rest, and move up and down the channel with limited disturbance from the residential homes. The applicant discussed with the EAC that the City is not mitigating on-site for the Pike Lake Road and County Road 21 project. The applicant did not feel he should be required to mitigate on-site ifthe City is not mitigating on-site for these projects. The City, County, and watershed district, partners in the project, determined that creating one large wetland complex in an area where a wetland was previously drained was more beneficial to the environment than trying to create a wetland in the area where the soils are not conducive to creating a new wetland. The sandy upland soils, where the new wetland would be created if on-site, are not able to support the hydrology necessary to constitute a wetland. Additionally, according to the Wetland Conservation Act wetland restoration is the preferred method of replacement (WCA 8420.0550. Subp. 2.). The City, acting as the Local Government Unit responsible for administration of the Wetland Conservation Act, working with the COlmty and watershed district exhausted all possibilities to avoid and minimize adverse wetland impacts for the necessary transportation projects and determined the best replacement option would be restoring a large wetland complex within the upstream watershed district. Additionally, according to the Wetland Conservation Act public transportation projects that affect wetlands in the seven-county metropolitan area are only required to be replaced in the affected county. The City, County, and watershed district exceeded this requirement by restoring a wetland within close proximity of the impacts and in the upstream watershed. The applicant has not exhausted all possibilities to avoid and minimize adverse wetland impacts for the revised Ridge Creek Preliminary Plat. The original preliminary plat reviewed at the January 11, 2006 EAC meeting provided mitigation on-site. According to the Wetland Conservation Act (8420.0543. A.) number one in the priority order for wetland replacement is on-site or in the same minor watershed as the affected wetland. The EAC had much more discussion at this meeting about the wetland mitigation plan proposed by the applicant. The applicant proposed all mitigation be completed off-site. Following this discussion a motion "to allow mitigation off-site within the C:\Documents and Settings\JKlima\Local Settings\Temporary Internet Files\OLKA\042706 -Ridge Creek - EAC to PLANNING COMMISSION.doc Lower Minnesota River Watershed District and ifnot in the Lower Minnesota River Watershed District, then on-site" was proposed. This motion was approved with a 3- 1 vote. Chair Gerlach was the dissenting vote. Chair Gerlach supported requiring mitigation be completed on-site and stated that the proposed impacts are in the Dean Lake wetland complex and mitigation should be completed within the same complex. 2. Woodland Management Plan The revisions completed to the Woodland Management Plan include the preservation of approximately 102 trees, removal of 618 trees, and planting 412 trees. Approximately 98 maples, 96 American linden, 98 elm, and 120 various tree species consisting of oak, birch, hickory, and walnut are proposed to be planted along the bluff and proposed County Road 21 right-of-way. The revised plan will preserve the bluff and trees in a proposed conservation easement. The EAC determined that the revised Woodland Management Plan reviewed at the meeting was in conformance with the condition of approval. ENVIRONMENTAL ADVISORY COMMITTEE RECOMMENDATION The Environmental Advisory Committee recommended approval of the revised preliminary plat with a 3-1 vote. The recommended conditions of approval stated in the January 18, 2006 memorandum and the following additional recommended condition of approval apply to the revised Ridge Creek Preliminary Plat: 1. The applicant complete wetland mitigation within the Lower MiImesota River Watershed District. Ifwetland mitigation can not be completed within the Lower Minnesota River Watershed District it must becompleted on-site. INTRODUCTION Ridge Creek I, me. (Randy Noecker) has submitted an application for preliminary plat approval of Ridge Creek. Please see Exhibits A and B for location and. proposed design. After initial review by the Enviro1ll11ental Advisory Committee (EAC) and Park and Recreation Advisory Board (pRAB), it was necessary for the applicant to provide revised drawings. These revisions were received by the City on February 22, 2006. Because these drawings did. not completely reflect the recommendations of the EAC/PRAB, a second review by the EAC/PRAB was necessary. The EAC/PRAB reviewed the revised drawings at is April 24, 2006 meeting. On April 24th, the discussion by the EAC/PRAB focused primarily on woodland management issues and wetland mitigation. Ultimately, the EAC/PRAB voted 3-1 to recommended approval of the preliminary plat subject to the conditions outlined in the January 18, 2006 report and subject to allowing wetland mitigation to occur off-site if the mitigation occurs within the Lower Minnesota River Watershed District (LMRWD). If the developer is unable to mitigate the wetlands within the LMRWD, mitigation is required to occur on site. At the time this memorandum was being prepared, the applicant communicated to staff that he was working on trying to accomplish off-site mitigation but had not yet finalized a deal to guarantee the ability to complete off-site mitigation. Additional outstanding significant concerns for the. plat application include outlet channel construction and site grading issues. Due to the approaching deadline of July 1 and staffs desire to preserve the opportunity for the City Council to review the application at two meeting dates, if necessary, staff is providing a recommendation for the Planning Commission's consideration at this time. STAFF RECOMMENDATION Due to the outstanding significant issues identified above (Le. fmalization of wetland mitigation plans, outlet channel construction issues, and overall site grading and access issues) and the review period deadline, staff recommends that at this time the Planning Commission recommend to the City Council denial ofthe preliminary plat application. Staff is recommending a continuation to the May 18, 2006 meeting in order to provide the applicant additional time to research mitigation possibilities within the LMRWD. STAFF RECOMMENDATION Staff recommends that the public hearing be continued to May 18, 2006. INTRODUCTION I am writing to provide you the Parks and Recreation Advisory Board's recommendation and park related comments for the second review of the Ridge Creek Preliminary Plat, proposed by Randy Noecker of Ridge Creek 1 Inc.,. DISCUSSION The Parks and Recreation Advisory Board (PRAB) originally reviewed the proposed Ridge Creek Preliminary Plat at their January 23 meeting, at which time they recommended general approval of the plat with specific conditions. Their discussion included park dedication, trails and sidewalks, and the Prior Lake Outlet Channel,. Mr. Noecker was in attendance at the meeting and addressed the board. The PRAB) reviewed the revised proposed Ridge Creek Preliminary Plat at their April 24 meeting, at which time they recommended.general approval of the plat with specific conditions. Mr. Noecker was in attendance atthe meeting and addressed the Board. Park Dedication Park.dedication calculations based on the current proposal and 2006 fee schedule are as follows: 3.0 persons per lot X 153 lots /75 = 6.12 acres of park land The applicant is proposing land dedication in a single parcel adjacent to the Riverside Bluffs Park parcel. Howeverr the Proposed park dedication did not meet the .current number of lots proposed by the applicant since he revised his plan to add 2 lots. The Advisory Board confirmed the desire for the full land dedication (6.12 acres) required in accordance with the number of lots proposed. Trails and Sidewalks The PRAB's recommendations included a condition that the applicant provide an 8' wide bituminous trail along the outlet channel through the park parcel. Adjacent developments have provided this trail withoutregard for park dedication. This trail is strongly desired to be constructed with the development, however, if the applicant refuses to.construct it, the city will do this and no construction credit for this work shall be granted in lieu of park land dedication. However, as per the Environmental Advisory Committee's recommendation regarding wetland mitigation, the applicant has agreed to constructthe trail in the park IF he is able . . PARKS AND RECREATION ADVISORY BOARD PARK DEDICATION RECOMMENDATION The Parks and Recreation Advisory Board recommended approval of the proposed preliminary plat, with the following conditions: Prior to Recording of the preliminary Plat: 1. The applicant shall meet park dedication requirement by providing land in a single parcel adjacent to the east Property line on the north side of the development, in the full amount in accordance with the number of lots (currently shown as 15310ts= 6.12 acres). 2. The Trails and Sidewalks and Grading Plans must be shown to match adjacent approved development plans (Riverside Bluffs and Ridge View Farmsr Liesener parcel) and that the applicant be required to install sidewalks on all streets in the development that are not cul-de-sacs as shown on plans. 3. (staff comment) Grading of the Prior Lake Spring Lake Outlet Channel and park land parcel shall be a part of the first phase of development if the project contains phasing. After Recording of the Final Plat but before Release of Letter of Credit: 4. (staff comment) In the park area, the developer shall: A) Fine grade the site, picking rocks and dirt clumps %" and greater in size B) Provide a finished grade that is approved by the city as suitable for park use and which ties in to the adjacent developments. DISCUSSION Mr. Noecker (applicant) was present at the meeting to address the Environmental Advisory Committee's (EAC) natural resource concerns. The following issues were discussed extensively with the applicant at the meeting: 1. Wetlands The preliminary plat reviewed at the January! I, 2006 EAC meeting proposed mitigation be completed entirely on-site. The EAC supported the applicant completing mitigation on-site. At this meeting the EAC only discussed extending the maintenance and monitoring period to 10-years to be consistent with the maintenance and monitoring period for another development in the area. \ At the January 24,2006, Technical Evaluation Panel (TEP), a committee that provides technical oversight for the Wetland Conservation Act, the wetland delineation was approved and mitigation requirements were deferred to the Local Government Unit (City). On February 22, 2006 the applicant submitted a plan proposing all mitigation off-site. Based on discussions at various City Development Review Committee meetings it was determined by staff that the City, as the Local Government Unit, will require mitigation on-site. It was determined that the applicant has not exhausted all possibilities to avoid and minimize wetland impacts on-site and that mitigation could be completed on-site. At this meeting staffpresented the proposed wetland mitigation design discussed with the applicant at an April 12, 2006, Development Review Committee meeting. The design includes wetland mitigation adjacent to the channel with the stonn water ponds designed to overflow into the mitigated wetlands and the mitigated wetlands C;\Documents and Settings\JKlima\Local Settings\Temporary Internet Files\OLKA\042706 - Ridge Creek - EAC to PLANNING COMMISSION.doc I?XlflBrr 1> <.. designed to overflow into the channel. A similar design was approved for the Riverside Bluffs development, which mitigated on-site. The design is anticipated to increase the water quality of storrnwater leaving the site by reducing nutrient loads entering the channel and discharging into downstream waterbodies. In addition, the design is anticipated to provide additional flood protection to area residents by allowing the channel to overflow into the mitigated wetlands. The design is consistent with the City's goal to preserve and create a natural resource corridor along the channel. Additionally, the wetland mitigation sites would be planted with native plant species providing habitat for many bird and mammal species to feed, rest, and move up and down the channel with limited disturbance from the residential homes. The applicant discussed with theEAC that the City is not mitigating on-site forthe Pike Lake Road and County Road 21 project. The applicant did not feel he should be required to mitigate on-site if the City is not mitigating on-site for these projects. The City, County, and watershed district, partners in the project, detennined that creating one large wetland complex in an area where a wetland was previously drained was more beneficial to the environment than trying to create a wetland in the area where the soils are not conducive to creating a new wetland. The sandy upland soils, where the new wetland would be created if on-site, are not ableto support the hydrology necessary to constitute a wetland. Additionally, according to the Wetland Conservation Act wetland restoration is the preferred method of replacement (WCA 8420.0550. Subp.2.). The City, acting as the Local Government Unit responsible for administration ofthe Wetland Conservation Act, working with the County and watershed district exhausted all possibilities to avoid and minimize adverse wetland impacts for the necessary transportation projects and determined the best replacement option would be restoring a large wetland complex within the upstream watershed district. Additionally, according to the Wetland Conservation Act public transportation projects that affect wetlands in the seven-county metropolitan area are only required to bereplaced in the affected county. The City, County, and watershed district exceeded this requirement by restoring a wetland within close proximity of the impacts and in the upstream watershed. The applicant has not exhausted all possibilities to avoid and minimize adverse wetland impacts for the. revised Ridge Creek Preliminary Plat. The original preliminary plat reviewed at the January 11,2006 EAC meeting provided mitigation on-site. According to the Wetland Conservation Act (8420.0543. A.) number one in the priority order for wetland replacement is on-site or in the same minor watershed as the affected wetland. The BAC had much more discussion at this meeting about the wetland mitigation plan proposed by the applicant. The applicant proposed all mitigation be completed off-site. Following this discussion a motion "to allow mitigation off-site within the C:\Docurnents and Settings\TKlirna\Local Settings\Ternporary Internet Files\OLKA \042706 - Ridge Creek - EAC to PLANNING COMMISSION.doc IP'fH (51! j) Lower Minnesota River Watershed District and if not in the Lower Minnesota River Watershed District, then on-site" was proposed. This motion was approved with a 3- 1 vote. Chair Gerlach was the dissenting vote. Chair Gerlach supported requiring mitigation be completed on-site and stated that the proposed impacts are in the Dean Lake wetland complex and mitigation should be completed within the same.complex. 2. Woodland Management Plan The revisions completed to the Woodland Management Plan include the preservation of approximately 102 trees, removal of618 trees, and planting 412 trees. Approxirnately98 maples, 96 American linden, 98 elm, and 120 various tree species consisting of oak, birch, hickory, and walnut are proposed to be planted along the bluff and proposed County Road 21 right-of-way. The revised plan will preserve the bluff and trees in a proposed conservation easement. The EAC determined that the revised Woodland Management Plan reviewed at the meeting was in conformance with the condition of approval. ENVIRONMENTAL ADVISORY COMMITTEE RECOMMENDATION The Enviromnental Advisory Committee recommended approval of the revised preliminary plat with a3-1 vote. The recommended conditions of approval stated in the January 18, 2006 memorandum and the following additional recommended condition of approval apply to the revised Ridge Creek Preliminary Plat: 1. The applicant complete wetland mitigation within the Lower Minnesota River Watershed District. If wetland mitigation can not be completed within the Lower Minnesota River Watershed District it must be completed on-site. The public hearing for this item was opened on February 9 and continued to March 23 in order for staff to review revisions that were to be submitted on February 22. These revisions were prompted by the original submittal not receiving the minimum required 264 points in the Residential Project Pointing Guide that was recently adopted. The revised drawings . have been submitted and repointed under the Residential Project Pointing Guide. The revised plans do exceed the required points to recommend approval of the proposed site layout. Other. city departments and outside agencies continue to review the revised submittal information. The revised information will be presented to the Environmental Advisory Committee (EAC) and Park and Recreation Advisory Board (pRAB) at its April 24 meeting. The EAC and PRAB reviewed the plat for aspects of the plat that relate to parks and natural resources, and in so doing, were not commenting on the overall plat design. Both bodies recommended approval of the preliminary plat contingent on compliance with specific conditions that would require modification of the plat plan. The PRAB recommended approval, subject to compliance with the following: 1. The applicant shall meet park dedication requirement by providing land in a single parcel adjacent to the east propertY line on the north side of the development, in the amount of 6.04 acres. 2. The park land dedicated shall be graded according to park standards .and have. adequate topsoil spread to a depth of 6 inches as per qrdinance. 3. The Trails and Sidewalks and Grading Plans must be shown to match adjacent approved development plans (Riverside Bluffs and Ridgeview Farms, Liesner parcel) and that the applicant be required to instaIl sidewalks on all streets in the development that are not cul-de-sacs. 4. The developer shall construct the trail through the park along the drainage channel to co:rmect with Riverside Bluffs trail and the trail or sidewalk along Crossings Blvd. Additional standard park dedication conditions would also apply concerning, but not limited ta, topsoil, grading, seeding, etc. The EAC has recommended approval, subject to campliance with the following: 1. The applicant should implement the use of Best Management Practices for erosion control and stonnwater management during construction. 2. The applicant inust meet the City's Woodland and Tree Management Ordinance requirements. 3. Placement of at least One overstory shade deciduous tree in the front yard of each lot. 4. Placement of 6 inches of topsoil for vegetation establishment. The soil composition should be similar to the MnDOT topsoil borrow requirements. 5. Sod placement in front yards and seed or sod placed in side or rear yards. 6. Rain sensors for any irrigation systems. 7. The applicant shall preserve the identified natural resource corridor that follows the wooded steep slopes along the bluff.
