Michael Leek, Community Development Director SUBJECT: Amendment of the City of Shako pee's Zoning Map to Re-zone Properties in the First A venue/Riverfront Area from Highway Business (B-1), Old Shakopee Residential (R-IC), and Medium- Density Residential (R-2) Zones to Mixed Use (MU) Zone MEETING DATE: June 6, 2006 INTRODUCTION: Following Council's consideration of Ordinance No. 759 which would create a Mixed Use Zone, Council is asked to consider approving Ordinance No. 765 rezoning the properties depicted as "mixed use" on the attached Exhibit A to the new Mixed Use Zone. ALTERNATIVES: 1. Offer and approve Ordinance No. 765, an ordinance ofthe City of Shakopee rezoning properties inthe Riverfront/First Avenue area. 2. Do not approve Ordinance No. 765. 3. Table the item for additional information. PLANNING COMMISSION RECOMMENDATION: The Plannin~ Commission held a public hearing on the profosed rezoning on May 4th and May 1St. After closing the public hearing on May 1St, the Commission voted 6-0 to recommend the proposed rezoning contingent on Council approval on June 6th of the proposed, revised text amendment. VISIONING RELATIONSHIP: The proposed rezoning relates to Goal D. Vibrant, resilient and stable. No. 759), offer an approve Ordinance No. 765, an ordinance of the City of Shako pee rezoning properties in the Riverfront/First Avenue area. If the Council does not approve Ord. Michael Leek Community Development Director H:\CC\2006\06-06\06045 REZONING RIVERFRONT-FIRST AVE MIXED USE 06062006.doc 2 ORDINANCE NO. 765, FOURTH SERIES AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA, AMENDING THE ZONING MAP ADOPTED IN CITY CODE SEC. 11.03 BY REZONING PROPERTIES IN THE FIRST A VENUEIRIVERFRONT AREA FROM HIGHWAY BUSINESS (B-1), OLD SHAKOPEE RESIDENTIAL (R-1C), AND MEDIUM-DENSITY RESIDENTIAL (R-2) ZONES TO MIXED USE (MU) ZONE WHEREAS, the Cityof Shakopee has adopted Ordinance No. 759 creating a Mixed Use Zone; and WHEREAS, the City of Shakopee has proposed the rezoning of properties in the Riverfront/First Avenue area as depicted on attached Exhibit A to Mixed Use; WHEREAS, notices were duly sent and posted, and a public hearing was held before the Planning Commission on May 4 and 18,2006, at which time all persons present were given an opportunity to be heard; and WHEREAS, the Planning Commission has recommended to the City Council that the subject properties be re:"zoned to Mixed Use (MU) Zone; and WHEREAS, the City Council heard the matter at its meeting on June 6, 2006; and NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Shakopee hereby adopts the following findings of facts relative to the above-named request: Finding #1: The original zoning ordinance is not in error. Finding #2: Significant changes in community goals and policies have taken place in the most recently Council adopted Comprehensive Plan Update that mandates the requested zoning classification. Finding #3: Significant changes in development patterns have not occurred, and the proposed rezoning is consistent with development patterns in the Riverfront/First Avenue area. Finding #4: The Comprehensive Plan Update, as adopted, by the Shako pee City Council and is pending review by the. Metropolitan Council, is consistent with the request. BE IT FURTHER RESOLVED, that the request to rezone the properties in the First Avenue/RiverfrontArea from Highway Business (B-1), Old Shakopee Residential (R-IC), and Medium-Density Residential (R-2) Zones to Mixed Use (MU) Zone is hereby approved.
