SUBJECT: Public Hearing for the 2006 Bituminous Overlay,
Project No. 2006-5

INTRODUCTION:
As per Resolution No. 6414, a resolution receiving a report and calling for a public
hearing on the 2006 Bituminous Overlay, Project No. 2006-5, a public hearing is
scheduled for June 6, 2006. This agenda item is to conduct the public hearing for the
proposed improvements associated with the 2006 Bituminous Overlay Project.
BACKGROUND:
OnJanuary 16, 2001 theCity Council ordered the preparation of a feasibility report to
analyze a bituminous overlay of Holmes Street, from 3rd A venue to 10th A venue by
ResolutionNo. 5472. This project has been put on hold to allow for the completion of
the new Scott County Jail on Holmes Street, between 3rd Avenue and 4th Avenue. On
November 1, 2005, the City Council ordered the preparation of a feasibility report to
analyze a bituminous overlay of 10th Avenue, from Marschall Road to Harrison Street by
Resolution No. 6321. These two projects have been combined into the 2006 Bituminous
Overlay.
On May 25, 2006, staff conducted an informational meeting for the property owners
being affected by the proposed project. Approximately 17 residents attended the
meeting. The residents in attendance at the informational meeting seemed in favor of the
project and had some general questions regarding the design, construction schedule and
assessment payments.
PROJECT COSTS:
The total estimated project cost for this project is $1,222,889.30
25% of the street improvements ($158,498.06) will be assessed to the benefiting
properties. The remaining costs ($962,019.39) associated with the street improvements
will be paid from State Aid Funds. Storm sewer improvements ($102,371.85) will be
paid from the Storm Sewer Fund.
ALTERNATIVES:
1. Adopt Resolution No. 6248, a resolution ordering the improvement and the
preparation of plans and specifications for the 2006 Bituminous Overlay, Project
No. 2006-5.
2. Deny Resolution No. 6248. This action will haltthe project until such time as the
City Council reconsiders the resolution.
3. Table Resolution No. 6248, to allow time for staff to prepare additional
information and/or revise the feasibility report as directed by City Council.
4. Modify Resolution No. 6248, to reduce the scope of the project area, as
determined by City Council.
RECOMMENDATION:
If Council desires to proceed with this project, at this time, then Resolution No. 6248
needs to be adopted, a resolution ordering the improvement and the preparation of plans
and specifications; If City Council does not wish to pursue this project, then. the
appropriate action would be to move the approval of Resolution No. 6248. and. vote
against the motion. If City Council wants more information on the project and/or to
amend the feasibility report, then Alternative No.3 is recommended.
ACTION REQUESTED:
Offer Resolution No. 6248, A Resolution Ordering an Improvement and Preparation of
Plans and Specifications for the 2006 Bituminous Overlay, Project No. 2006-5, and move
its adoption. ~.~

RESOLUTION NO. 6248
A Resolution
Ordering An Improvement And Preparation Of
Plans And Specifications For The
2006 Bituminous Overlay
Project No. 2006-5
WHEREAS, Resolution No. 6414 adopted on May 2, 2006, fixed a date for Council
hearing on the proposed improvement of the 2006 Bituminous Overlay Project and all appurtenant
work; and
WHEREAS, ten days published notice of the hearing through two weekly publications of
the required notice was given and the hearing was held on the 6th day of June, 2006, at which all
persons desiring to be heard were given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA:
1. That the improvement is necessary, cost effective and feasible and is ordered as
hereinafter described:
2006 Bituminous Overlay Project and all appurtenant work.
2. Bruce Loney, Public. Works Director, is hereby designated as the engineer for this
improvement. He shall prepare plans and specifications for the making of such improvements.
3. The work of this project is hereby designated as part of the 2006-5 Public Improvement
Program.
4. The City Council shall let the contract for all or part of the improvements as authorized
by Minnesota Statutes 429.041, no later than three years from the date of adoption of this
resolution.
