CITY OF SHAKOPEE Police Department CONSENT Memorandum To: Honorable Mayor, City Council Mark McNeill, City Administrator From: Community Service Officer Thor Carlson Subject: Ordinance Amending Chapter 9, Section 9.09, Disability Parking Date: May 24, 2006 INTRODUCTION Council is asked to consider adopting the attached ordinance, Ordinance No. 762, Fourth Series. This ordinance amends the City Code Chapter 9, by adding a new Section 9.09, relating to the authority of community service officers to enforce disabled parking restrictions. BACKGROUND The Shakopee Police Department employs Community Service Officers for the purpose of providing sworn Police Officers support through assigned duties. These duties include the enforcement of parking complaints through chalking vehicles, issuing warning tags, ticketing, towing vehicles and documentation. Current parking ordinance does not define the role of the City's Community Service Officers in dealing with disability parking violations. In an effort to relieve patrol officers from the duties. of enforcing disability parking the Shakopee Police Department is seeking to empower Community Service Officers with the proper city ordinance to enforce such violations. VISIONING RELATIONSHIP: This action supports: Goal A: Active and Healthy Community Strategy 4 - Foster community connections Strategy 6 - Provide high quality services RECOMMENDED ACTION: Offer Ordinance No. 762, Fourth Series, an Ordinance of the City of Shako pee, Minnesota, Amending Chapter 9 by Adding New Section 9.09, Relating to the Authority of Community Service Officers to Enforce Disabled Parking Restrictions, and move its adoption. t ORDINANCE NO 762, FOURTH SERIES AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA AMENDING CHAPTER 9 BY ADDING NEW SECTION 9.09, RELATING TO THE AUTHORITY OF COMMUNITY SERVICE OFFICERS TO ENFORCE DISABLED PARKING RESTRICTIONS THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS: Section 1 - City Code Chapter 9 is amended by adding new Section 9.09, DISABLED PARKING as follows: 9.09. Enforcement of Disabled Parking Restrictions. Pursuant to the authority given to the City in Minnesota Statute Section 626.862, the City's Community Services Officers shall be empowered to enforce the parking restrictions of Minnesota Statute Section 169.346 relating to parking spaces for the physically disabled by issuing lawful citations to violators. Section 2 - Effective date. This ordinance becomes effective from and after its passage and publication. Adopted in session of the City Council of the City of Shakopee, Minnesota, held this day of , 2006.
