INTRODUCTION:
Attached is Resolution No. 6433, which accepts the bids and awards a contract for the
CSAH 83 Trunk Sanitary Sewer Extension, from Church Addition to River Valley
Estates 2nd Addition, Project No. 2006-6. Also, attached is the temporary easement
document needed from the Shakopee Mdewakanton Sioux Community (SMSC).
BACKGROUND:
On April 18, 2006, City Council adopted Resolution No. 6397, which approved the plans
and specifications and authorized staff to advertise for bids for the CSAH 83 Trunk
Sanitary Sewer Extension, from Church Addition to River Valley Estates 2nd Addition,
ProjectNo. 2006-6.
On May 25, 2006, a bid opening was held on the CSAH 83 Trunk Sanitary Sewer
Extension, from Church Addition to River Valley Estates 2nd Addition Project, in which
there were five bids opened for this improvement project. The bids are summarized in
the attached resolution. From the bid opening, the apparent low bidder is Minger
Construction, Inc. with a bid of $554,645.90. The engineer's estimate for this project is
$541,000.00. Attached is a memo from John Powell, Project Manager from WSB &
Associates, Inc. on the bid results as compared to the feasibility report. By constructing
the trunk sewer on the east side, a savings of $125,000.00 in right-of-way costs was
achieved.
If Council awards the contract, staff is also requesting a contingency amount equal to 5%
of the contract to cover minor change orders and quantity adjustments that may occur on
the project. Also,.an extension agreement with WSB. & Associates, Inc. is necessary to
provide for the surveying and construction engineering assistance, as needed for this
proj ect.
In addition, staff is requesting approval for payment of $50,000.00 to the SMSC for the
temporary easement needed for construction of the sewer. Attached is the easement
document and drawing that has been executed by the SMSC.
ALTERNATIVES:
1. Accept the low bid of $554,645.90 and adopt Resolution No. 6433.
2. Accept the low bid of$554,645.90 and adopt a revised Resolution No. 6433.
3. Reject the low bidder and award to another bidder.
4. Reject all bids and rebid.
5. Approve a 5% contingency amount on this project for use by the City Engineer in
authorizing change orders or quantity adjustments on this project.
6. Authorize the appropriate City officials to execute an extension agreement with
WSB & Associates, Inc. to provide for the surveying and construction
engineering assistance, as needed for this project.
7. Approve a motion approving the payment of $50,000.00 to the Shakopee
Mdewakanton Sioux Community for the temporary easement along CSAH 83.

RECOMMENDATION:
Staff recommends Alternative No.'s 1, 5, 6 and 7 in order for this project to commence.
ACTION REQUESTED:
I. Offer Resolution No. 6433, A Resolution Accepting Bids on the CSAH 83 Trunk
Sanitary Sewer Extension, from Church Addition to River Valley Estates 2nd
Addition, Project No. 2006-6 and move its adoption.
2. Approve a5% contingency amount on this project for use by the City Engineer in
authorizing change orders or quantity adjustments on this project.
3. Authorize the appropriate City officials to execute. an extension agreement with
WSB & Associates, Inc. to provide surveying and construction engineering
assistance, as needed for this project.
4. Approve a motion approving the payment of $50,000.00 to the Shakopee
Mdewakanton Sioux Community for the temporary easement along CSAH 83.

WHEREAS, pursuant to an advertisement for bids for the CSAH 83 Trunk Sanitary Sewer
Extension, from Church Addition to River Valley Estates 2nd Addition, Project No. 2006-6, bids
were received, opened on May 25, 2006, and tabulated according to law, and the following bids
were received complying with the advertisement:

Chanhassen, MN 55317is the lowest responsible bidder for the CSAH 83 Trunk Sanitary Sewer
Extension, from Church Addition to River Valley Estates 2nd Addition, Project No. 2006-6.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE,MINNESOTA:
1. The appropriate City officials are. hereby authorized and directed to enter into a
contract with Minger Construction, Inc. in the name of the City of Shakopee for the CSAH 83
Trunk Sanitary Sewer Extension, from Church Addition to River Valley Estates 2nd Addition
Project according to the plans and specifications therefore approved by the City Council and On file
in the office ofthe City Clerk.

CSAH 83 Trunk Sanitary Sewer Extension

Contractor bids for construction of the referenced project were opened on May 25, 2006. Five bids
were received by the City with the lowest bid received from Minger Construction in the total
amount of $554,645.90. We submit the following informatimi as the City considers the award of
the contract:
1. The Feasibility Report for this project dated February 2,2006, identified estimated costs for
two construction alternates. The less-expensive alternate (Alternate 1) had a construction
cost of $492,250 plus a 10% contingency for a total estimated construction cost of$541,475.
A 10% contingency on the construction cost is common in the feasibility phase when. a
detailed design has not yet been completed. The low bid amount from Minger Construction
is generally consistent with the total estimated construction cost from the Feasibility Report.
2. The Feasibility Report had shown a proposed alignment primarily located along the west
side of CSAH 83 which would have required temporary or permanent easement acquisition
from multiple property owners. Estimated. easement acquisition payment costs for
Alternate lof$174,300 were included in the estimated project cost. The final sewer
alignment is primarily along the.east side ofCSAH 83 and the easement acquisition
payment cost has been reduced to about $50,000.
3. The realignment of the sanitary sewer to the east side of CSAH 83 during final design led to
an additional jacked pipe crossing ofCSAH 83 to provide lateral service to "Future Thrush
Street". This change increased the jacked pipe quantity on the project by about 120 feet; the
resulting additional construction cost based on the low bid is $54,590.50. However, even
after considering this added cost, the overall project cost has been reduced significantly from
about $895,000 to about $756,000.

4. As stated at the public hearing, after extensive discussions with the Minnesota Pollution
Control Agency (MPCA), the agency concluded that an Environmental Assessment
Worksheet (EA W) would be required for this trunk sanitary sewer extension. The Shakopee
City Council authorized the preparation of information for this EA W on March 6, 2006. We
have been informed in writing by the MPCA, as they are the responsible governmental unit
(RGU) for this EA W, that their Commissioner has executed findings stating this project
does not require preparation of an Environmental Impact Statement (EIS). The MPCA Staff
indicates the project is now clear for permitting of the sanitary sewer extension.

Dear Mr. Loney:
According to our Agreement for Professional Services with the City of Shakopee and Section
I.C.2 (Major Projects), this extension agreement is written to provide for Construction Services
for the above-referenced project.
We are proposing to complete this work on a cost-reimbursable basis for the amount of$15,754
as stated in our original proposal. The City of Shakopee agrees to reimburse WSB & Associates,
Inc. for these services in accordance with our Agreement for Professional Services.

Abstract
TEMPORARY EASEMENT FOR CONSTRUCTION
THIS INSTRUMENT is made by Shakopee Mdewakanton Sioux Community, a
federally recognized Indian tribe, Grantor, in favor of CITY OF SHAKO PEE, a Minnesota
municipal corporation, Grantee.
FOR GOOD AND VALUABLE CONSIDERATION, receipt of which is
acknowledged by Grantors, Grantors grant and convey to the Grantee a temporary easement
for construction purposes, including the right of the Grantee, its contractors, agents, and
employees to enter upon said premises at all reasonable times for. the pUlposes of
construction, grading, sloping, and restoration purposes, and all.purposes ancillary thereto,
together with the tight to cut, trim, or remove therefrom trees, shrubs, or other vegetation
from the easement area, as well as the right to deposit construction materials upon the
easement area and to deposit or remove earthen materials from the easement area. Said
easement is granted over, under, across and upon the following described real property:
The Northeast Quarter of the Northeast Quarter; the South Half of the
Northeast Quarter; the North Half of the Southeast Quarter; and the
Southeast Quarter of the Southeast Quarter, all in Section 16, Township
115, Range 22, Scott County, Minnesota;
AND
TheSouthwest Quarter of the Southeast Quarter of Section 16, Township
115 North, Range 22 West, Scott County, Minnesota.
