SUBJECT: Request of Frank Marzario for Waiver of Subdivision Criteria, to wit Lot
Frontage Requirement.
MEETING DATE: June 6, 2006
INTRODUCTION:
Council is asked to approve a waiver of lot size and frontage requirements for a property owned
by Frank Marzario and located south ofCSAH 16 and west of Pike Lake Road (addressed as
2328 Pike Lake Road). Mr. Marzano was approached by Scott County about their interest in
acquiring the westerly 10 acres for roadway purposes in connection with the future CR 21
project. If the Council approves the proposed waiver, a minor subdivision application to create
two 10-acre lots that was submitted by Mr. Marzano would be reviewed and acted on
administratively. Attached for the Council's information are I) a copy ofMr. Marzario's letter,
2) a copy site location map, and 3) a copy ofthesurvey depicting the proposed lots.
DISCUSSION:
The subject property is currently zoned Agricultural Preservation (AG). The City's adopted
Comprehensive Plan Update guides the property for Low-Density Residential use. This 20-acre
property is already a legal non-conforming property in that I) at 20 acres it is smaller than the
40-acre minimum size ofthe AG Zone, and 2) the property does not currently have the required
lot frontage. Access to the property is by means of a 66-foot private easement, and there are no
plans for the construction of a public street to serve this area. Under the proposed minor
subdivision, the applicant would retain Parcel B (the site of his home), and Scott County would
acquire Parcel A for CR 21 right-of-way purposes. There would be no future need to provide
access to Parcel A.
ALTERNATIVES:
1. Offer and approve a motion approving the request for waiver of subdivision criteria
regarding the City's lot size and frontage requirements as proposed.
2. Offer and approve a motion approving the request for waiver of subdivision criteria
regarding the City's lot size and frontage requirements with revisions.
3. Offer and approve a motion denying the request for waiver of subdivision criteria
regarding the City's lot frontage requirement.
CONSENT
4. Table the matter and request additional information.
VISIONING RELATIONSHIP:
Because the proposed waiver and minor subdivisions would facilitate the future construction ofCR
21 and a related transit park and ride site, and because the resulting parcels would still be consistent
in size and configuration with the guided low-density residential land use, the proposed action
relates affirmatively to Goal D, Vibrant, resilient and stable.
REQUESTED ACTION:
Offer and approve a motion approving the request for waiver of subdivision criteria regarding the
City's lot size and frontage requirements as proposed.

Please accept this letter along with my "Application for Minor Subdivision" as my formal
request to subdivide my current prOperty located at 2326 Pike Lake Road, Shakopee, MN
55379.
Along with my submitted application I am requesting that you consider granting me a
wavier to the minor subdivision criteria as it pertains to lot frontage. It is my desire to
subdivide the existing property into two (2) 10 acre parcels. One lot will be used as our
homestead and the second lot will be purchased by Scott County.
Our existing lot is a legal, non-conforming "Rural Residential" lot and meets all
additional requirements of the minor subdivision criteria. If my request is granted I will
continue to work with The City of Shakopee City Planners to finalize our submitted
application for minor sub division.
