(R-IA) Zone

INTRODUCTION
The City Council and Planning Commission have directed staffto prepare a text
amendment regarding the lot requirements in the Low Density Residential (R-IA) zone.
The text amendment proposes changing the lot requirements to a lot width of 95 feet and
a minimum lot area of 12,800 square feet, while eliminating the lot depth requirement.
PLANNING COMMISSION RECOMMENDATION
On May 18, 2006, the Planning Commission held a public hearing on the proposed text
amendment, and unanimously recommended approval ofthe text amendment as
presented. Please find attached a copy of the May 18 report to the Planning Commission
for the Council's reference.
ALTERNATIVES
1. Offer and pass Ordinance No. 763, an amendment to City Code Sec. 11.28.
2. Offer and pass Ordinance No. 763, an amendment to City Code Sec. 11.28, with
reVISIons.
3. Do not approve Ordinance No. 763.

AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA,
AMENDING CITY CODE SECTION 11.28
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA,
ORDAINS:
Section I - That City Code Section 11.28, Low Density Residential Zone, Subd.
5, Design Standards, is hereby amended by adding the language, which is underlined, and
deleting the language that is struck through.
Section 11.28 Low Density Residential (R-IA)
Subd. 5. Design Standards.
C. Lot specifications.
Minimum lot width: W 2i.feet
Minimum lot dopth: 160 feet
Minimum lot area: 12.800 square feet
Minimum front yard setback: 35 feet
Minimum side yard setback: 15 feet
Minimum rear yard setback: 40 feet
Section 2 - - Effective Date. This ordinance becomes effective from and after its
passage and publication.
Adopted in session of the City Council ofthe City of Shakopee,
Minnesota held the day of ,2006.

DISCUSSION
The City C01.IDcil and Planning Commission directed staffto prepare a text amendment regarding the
lot requirements of the Low Density Residential (R -I A) Zone. This zoning district currently has a lot
width requirement of 80 feet and a lot depth requirement of 160 feet.
Staff has researched the lot requirements utilized in other cities. In most cases, cities utilize a
minimum lot width requirement in conjunction with a minimum square footage requirement for the
lot. In communities surveyed, lot size requirements range from 10,000 square feet to 15,000 square
feet and lot width requirements range from 80 to 90 feet. Based on current lot width and depth
requirements, a lot in the R-IA zone is required to be 12,800 square feet in size, while the R-IB
requirements dictate a minimum lot size of 6,000 square feet.
Staff is proposing thatthe text be amended to require a minimum lot width of95 feet and a minimum
area of 12,800 square feet (This would equate to lot proportions of approximately 95 feet wide by 135
feet deep). Staffis proposing the lot width of95 feet in order to allow a building envelope that is 65
feet wide on a standard lot. Staffbelieves the additional width would provide the opportunity for
builders to be more imlovative with home design in order to allow increased area for home fi'onts
rather than garage fronts.

FINDINGS
City Code Sec. 11.83, Subd. 3 provides the criteria required for the granting of a Zoning Ordinance
Amendment. Only one of the criteria needs to exist for an amendment to be warranted. These criteria
are listed below with proposed fmdings for the Commission's consideration.
Criteria #1 That the original Zoning Ordinance is in error;
Finding #1 The original zoning ordinance is not in error.
Criteria #2 That significant changes in community goals andpolicies have taken place;
Finding #2 Significant changes in community goals and policies have taken place in that the City
wishes to promote further utilization of the Low Density Residential (R -1 A) Zoning
district. The further utilization of the R -1 A zone will allow for increased opportunities
to ensure a range of housing opportunities.
Criteria #3 That significant changes in City-wide or neighborhood development patterns
have occurred; or
Finding #3 Significant changes in City-wide or neighborhood development patterns have not
occurred. The City has not witnessed the utilization of the Low Density Residential
(R-1A) Zone as was originally intended. City-wide and neighborhood development
patterns have continued to be dominated by the development of Urban Residential
(R-1B) zoned property.
Criteria #4 That the comprehensive plan requires a different provision.
Finding #4 The Comprehensive Plan does not require a different provision.
ALTERNATIVES
L Recommend to the City Council approval ofthe text amendment as presented.
2. Recommend to the City COlmcil approval of the text amendment with revisions.
3. Recommend to the City Council the denial of the text amendment.
4. Table the matter for additional information.
