SUBJECT: Assessment Hearing on Delinquent Garbage/Recycling Bills from Dick's/Lakeville
Sanitation, Inc., Res. No. 7482 (E)
Action Sought
Offer Resolution No. 7482, A Resolution Adopting Assessments for Delinquent Garbage Bills,
and move its adoption.
Background
The Council is asked to consider Resolution No.7482 that would assess property owners on taxes
payable 2015 for unpaid refuse and recycling services from the City's designated garbage hauler,
Dick's/Lakeville Sanitation, Inc.
In previous action, the City Council has authorized City participation in the collection of
delinquent garbage accounts in the City's designated"organized" collection area. By doing this,
it eliminated the need to stop service to the accounts, which could lead to a higher incidence of
illegal dumping.
Ordinance No. 583 was passed on October 17, 2000 which amended Section 3.15, Subdivision 7
of the City Code and obligated the property owners to pay the charges and costs for the collection
and disposal of refuse and recyclable materials.
Dick's/Lakeville Sanitation, Inc. provided the City with a current list of delinquent accounts on
Sept. 9, 2014, of which there were approximately 322 for a total amount due of$47,046.81. In
past years, delinquent bills under$100 were not assessed and was approved by Dick's. Being the
last year of their contract, Dick's is asking for collecting any delinquent refuse bill amount.
A list of property owners to be assessed will be on the table Tuesday evening; this is to allow
property owners to make final payments until Tuesday, September 16, 2014. The listing will
consist of Shakopee property owners who have either 1) not paid or 2)not paid in full their
delinquent garbage bill to Dick's/Lakeville Sanitation. This list, which will accommodate
Resolution No. 7482, includes an administrative charge of$45.00 to cover the City's cost and a
$30.00 charge to cover Dick's Sanitation costs in assessing these delinquent bills. These charges
will be added to the delinquent bills once the assessments are adopted by Council. As of
September 9, 2014, the 322 accounts would have a delinquent bill and administrative charges
from Dick's and the city amounting to $71,196.81. This list is anticipated to go down before next
Tuesday's council meeting.
Recommendation
Staff recommends that the City adopt attached Resolution No. 7482, assessing the delinquent
costs for refuse and recycling collection based on the details listed above.
Budget Impact
The $45.00 delinquent charge would be revenue to cover the administrative costs; therefore, there
is no impact on the budget.
Relationship to Vision
This supports Goal E: "Deliver effective and efficient public services by a staff of well-trained,
caring, and professional employees.
