S HAKOII'EE TO: Mayor and City Council Mark McNeill, City Administrator FROM: Jamie Polley, Parks, Recreation&Natural Resources Director DATE: 09/16/2014 SUBJECT: Authorization to Submit a Parks and Trails Legacy Grant Program Application for Quarry Lake Park, Resolution No. 7486 (A) Action Sought The City Council is asked to offer Resolution No. 7486, A Resolution of the City of Shakopee, Minnesota Authorizing the City to submit a Parks and Trails Legacy Grant Program Application for the Quarry Lake Park Project. Introduction This agenda item requests the City Council to adopt a resolution authorizing the submittal of a Parks and Trails Legacy Grant Program application to the Minnesota Department of Natural Resources for the Quarry Lake Park project. Background and Discussion Our work with the Shakopee-Prior Lake Water Ski Association on acquiring funding for the Quarry Park project continues with another grant application. As you may recall, we were successful in securing $92,000 in funding in 2005 and$78,000 in funding in 2006. These grants had to be turned back to the Department of Natural Resources in 2011 due to the inability to obtain public access. Public access has now been obtained and the planning of the park can begin. The City Council authorized staff to submit applications for three Department of Natural Resources grants earlier in 2014. The City has been awarded a$150,000 grant from the 2014 Federal Recreational Trail Program. This grant would require the integration of the ATV/OHM training facility within the park. During the planning process the uses of the park will be defined. If this use makes sense within the park, the City Council will then be asked to accept the grant. Funding from the Parks and Trails Legacy Grant Program are now available for 2015. The attached resolution would allow us to submit for additional funding. The Parks and Trails Legacy Grant Program funds are paid on a reimbursement basis for up to 100% of the total eligible project costs or the grant amount. The Legacy Grant does not require a local share. The minimum grant amount is $20,000. There is no maximum grant amount for this program. The funding available for the Parks and Trails Legacy competitive grants for FY 2015 is $3,914,880. Requested Action If City Council concurs, it should, by motion, Adopt Resolution No. 7486, A Resolution of the City of Shakopee, Minnesota Authorizing the City to Submit a Parks and Trails Legacy Grant Program Application for the Quarry Lake Park Project. Attachments: Resolution No. 7486 RESOLUTION NO. 7486 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA AUTHORIZING THE CITY TO SUBMIT A PARKS AND TRAILS LEGACY GRANT PROGRAM APPLICATION FOR THE QUARRY LAKE PARK PROJECT WHEREAS, the City of Shakopee acquired and has plans to develop a reclaimed aggregate quarry in Shakopee for reuse as a park, recreation, and natural resource amenity; and, WHEREAS, such a project will help improve the quality of life in the southwest metropolitan area by providing a truly unique amenity; and, WHEREAS, the City supports the grant application made to the Minnesota Department of Natural Resources for the Parks and Trails Legacy Program. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, that the City of Shakopee (The City) will act as legal sponsor for the project contained in the Parks and Trails Legacy Grant application to be submitted on September 26, 2014 and that appropriate City staff are hereby authorized to apply to the Department of Natural Resources for funding of the Quarry Lake Park Project on behalf of the City. BE IT FURTHER RESOLVED, the City will be the fiscal agent and has the legal authority to apply for financial assistance, and financial capability to meet the match requirement (if any) and ensure adequate construction, operation, maintenance and replacement of the proposed project for its design life. BE IT FURTHER RESOLVED, that the City has not incurred any development costs for the property described in the Cost Breakdown section on this application. BE IT FURTHER RESOLVED, that the City has acquired fee title to the land within the park boundary described in the site plan included in the application, BE IT FURTHER RESOLVED, that, upon approval of its application by the State, the City may enter into an agreement with the State of Minnesota for the above references project, and that the City certifies that it will comply with all applicable laws and regulations as stated in the grant agreement including dedicating the park property for uses consistent with the funding grant program into perpetuity. NOW, THERFORE BE IT RESOLVED, the appropriate City staff is hereby authorized to execute such agreements as are necessary to implement the project on behalf of the City.
