Cox, City Clerk SUBJECT: Fee ScheduleBackground Investigation DATE: January 24, 2008 INTRODUCTION: City Council is asked to review the fee that the City charges to conduct a background investigation on an applicant who wishes a taxicab driver's license. BACKGROUND: On December 31, 2007, Mr. Randy Busch, Tri Taxi, Inc., talked with staff about licensing taxicab drivers for his taxicab business. He stated that he felt that the background investigation fee was high and explained that it was a burden on his part time drivers who only drive for him occasionally. On January 2, Council Lehman asked that staff contact five communities who license taxicab operations to learn what they charge for a background investigation and what they do. Staff has contacted five communities who license taxicab operations as well as two neighboring communities. Shakopee's fee for a background investigation is greater than those cities contacted. Of the seven cities contacted, two cities have issued no licenses, three communities charge $150 or more than Shakopee for a taxicab business license. Survey attached. When an application for a taxicab license or a taxicab driver's license is received, it is forwarded to the Police Department for a background investigation. In addition to the criminal history background, the Police Department also verifies the additional information provided by the applicant as required in the City Code. Captain Robson has advised that the $100 background fee is warranted based on the amount of time that is spent on an applicant. See attached information provided by Captain Robson. ALTERNATIVES: 1. Do nothing, maintain the current fee schedule for a background investigation 2. Direct staff to amend the fee schedule to raise/lower the current fee 3. Identify any additional information desired RECOMMENDATION: Discuss whether or not to amend the fee that the City charges to do a background investigation for a taxicab driver's license and give staff direction. Supervisor RE: Background investigation In order for a citizen to gain criminal history information they would need to do the following: Fingerprints: Scott County requires an appointment to get printed. Appointments are scheduled two days each month. Cost:. $15 resident and $25 non-resident Minnesota CH using BCA This will only reveal MN arrest and convictions on Gross Misd. and Felonies. FBI = $18 Can take up to 18 weeks (FBI records may not be available for licensing purposes) (Police use other authorized inquires (IQ/AQ/FQ on the III system) Sometimes an arrest is documented, but we are required to search criminal justice databases for conviction and disposition data. This info would not be available to applicants. DVS -certified copy = $10 on self In addition, we search local records that the applicant would not have access to. IvIisdemeanors are not documented on criminal histories, but could preclude that person from licensing. (Disorderly conduct, some misd sexual conduct) Publishing in news paper costs: I've included a few sections that are relevant. SEC. 6.07. CONVICTION OF -CRIME -DENIAL OF LICENSE. A license may be denied to an applicant by the Council solely or in part due to a prior conviction of a crime by an applicant. only upon a finding that such conviction directly relates to the occupation for which the license is sought, and then only after considering evidence of rehabilitation and such other evidence as may be presented,. all in accordance with Minnesota Statutes. Provided, however, that an applicant must show that the applicant is presently f1t to perform the occupation for which the license is sought. (Ord. 1, April 1, 1978; Ord, 337, July 23, 1992) Subd. 4. Public Hearing. Upon the filing of an application, the City Clerk shall set a time and place for. a public. hearing before the Council: Notice of such hearing shall be -given to the applicant and to all licensees. Due notice shall be given in the legal newspaper at least ten (10) -days prior to such hearing. D. No license shall be issued to an .applicant who has been convicted of any crime or crimes directly related to the occupation of taxicab driver, as defined by Minnesota Statutes, Section 364.03, Subdivision 2, and has not shown competent evidence of sufficient rehabilitation and present fitness to perform the duties of the occupation of taxicab driver, as defined by Minnesota Statutes, Section 364.03, Subdivision 3. 2 y0F$H.}~ ~ ~ '`~'S~ 3v; CITY OF SHAKOPEE MEMO s' POLICE DEPARTMENT DATE: 01-22-08 TO: Capt. Robson -Amended 01-29-07 FROM: Det. Matt Conway SUBJECT: Taxi driver license investigation On 01-11-08 I was asked by Capt. Robson to check into the licensing status of the taxi service run by Randy Busch, Tri Taxi Inc. The city currently has one driver and one vehicle registered for operation. The driver, Randy Busch, had a background check performed by the police department in 2005. There has been no other licensed issued for additional drivers or vehicles with the city. On 01-22-08 I spoke to Randy Busch via the phone reference Tri Taxi Inc. He stated that he currently has five P/T drivers that drive for him. He has three vehicles being used for the transportation of passengers. One is licensed as his full time taxi, and the other two are licensed as medical/courier transport vehicles. These three vehicles are used as taxis on the weekends within Shakopee. A DMV check shows him to have four passenger vehicles registered to himself. (See attached) It was also learned from Randy that the website name "Taxi Taxi Taxi" is an advertising name and not the name of any business. Mr. Busch has a taxi service, courier service, and medical transportation service which all fall under Tri Taxi Inc. (See attached printouts) It was brought to me attention that a registered sex offender maybe driving taxi for Tri Taxi. The subject was convicted of a sex crime in 1998 against an adult female, currently resides in Belle Plaine, and is compliant to date with his registration. He is not on probation and has no restrictions attached to his offender registration other than reporting his change=of address when applicable. No formal background check has been done on him for a taxi cab driver license through the police department. Conclusion: It appears that that Randy Busch has three transportation businesses running under Tri Taxi Inc. He currently has three known vehicles doing passenger transportations within Shakopee and employs five P/T drivers.
