No. 7475 (B) Action Sought Offer a motion to approve Resolution No. 7475, a resolution approving the Final Plat of Valley Park 18th Addition, and move its adoption. Background Jay Moore, representing Oppidan Investments has made application for the Final Plat of Valley Park 18th Addition for construction of a 20,600 square-foot Goodwill store. The proposed final plat involves the subdivision of Lot 1, Block 1, Valley Park 17th Addition, which is 5.73 acres and is zoned B-1, Highway Business. The proposed subdivision creates 2 lots. As proposed, Lot 1 is approximately 3.23 acres and Lot 2, the proposed Goodwill site, is approximately 2.50 acres and is directly west of Holiday Inn Express. A future user of Lot 1 is unknown at this time. As part of the plat, the applicant is proposing to have a shared driveway that would be constructed along the western lot line of the Goodwill site and serve both lots. It is anticipated that another access to 12th Avenue on the west side of Lot 1 would be requested at the time Lot 1 develops. A western access to Lot 1 would be required to be aligned with an existing access on the north side of 12th Avenue. The Goodwill store would involve a retail store and also a drive thru area for donations, a site plan showing development of the site is attached. A shared access and maintenance agreement is required for shared driveways. Currently a trail is planned for the south side of 12th Avenue. A trail easement was provided with the subdivision of Valley Park 17th Addition. Comments have been added to the draft resolution in regards to development of the site in anticipation of the future trail. There are not existing trees on the site. The building permit application for the Goodwill store has been submitted and is currently under review, but cannot be approved until the plat is approved and recorded. Recommendation Approve the Final Plat of Valley Park 18th Addition, subject to the conditions of the attached Resolution No. 7475. Budget Impact There is no immediate budgetary impact. Future construction of a commercial building will add additional property tax revenue to the City of Shakopee based on the value of the improvements to the site. The valuation on the building permit application submitted by the applicant is $1,004,000. Relationship to Vision The City Council approved rezoning of the subject property from Business Park to Highway Business in 2012. A Goodwill store and donation center is considered a permitted use in the Highway Business zone. Development of the site brings additional retail space for use by residents and visitors. Requested Action Staff recommends that the City Council offer a motion to approve Resolution No. 7475, a resolution approving the Final Plat of Valley Park 18th Addition, and move its adoption. It 4 I I 1 1 1 i City of Shakopee Memorandum TO: Kyle Sobota, Senior Planner FROM: Joe Swentek, Project Engineer SUBJECT: Final Plat—Valley Park 18th Addition PID#: 27-422001-0 CASE#: 14031 SUBLEDGER#: 114031 DATE: August 12, 2014 The application indicates a request for a Final Plat review of a property currently zoned as Highway Business (B-1). The property is Lot 1, Block 1 of the Valley Park 17th Addition and is located along the south side of 12th Avenue, east of County Road 83 (Canterbury Road). This review should be considered preliminary, as more comments will follow with additional submittals. However, the engineering department offers the following comments at this time for the applicant and for the planning department: General Conditions The following items need to be addressed/completed prior to release of the Final Plat for recording: 1. Payment of any applicable engineering review fees. 2. Payments of Trunk Sanitary Sewer Charges need to be made, as required by the most current City of Shakopee Fee Schedule. 3. Payments of Trunk Storm Water Charges and Trunk Storm Water Storage and Treatment Charges need to be made, as required by the most current City of Shakopee Fee Schedule. 4. Provide electronic files (AutoCAD and Adobe Acrobat formats) of the Final Plat to be recorded with datum on the Scott County coordinate system. No improvements (site grading and street and utility) will be constructed until the City Engineer and the Shakopee Public Utilities (SPU) approves the required Final Construction Plans and Specifications. 2. The applicant will obtain the necessary permits/approvals from the Minnesota Department of Transportation (MNDoT) for discharge of storm water runoff to their right-of-way. A copy of this permit/approval will be provided to the City of Shakopee engineering department. 3. The applicant will comply with the maximum allowable impervious surface percentage set forth by the City Code. 4. Infiltration will need to be incorporated into the site's design and storm water management plan. The amount to be infiltrated is set forth by the National Pollutant Discharge Elimination System (NPDES) requirements. 5. Surface water runoff for each of the lots will be required to be piped to the regional storm water basin to the south. Overland flow will not be allowed as this creates a potential for future erosion issues. 6. All flared end sections to the MNDoT right-of-way will need to have geotextile fabric and class IV fieldstone riprap to the basin bottom. The amounts of fabric and riprap are set forth in the City of Shakopee General Specifications and Standard Detail Plates for Street & Utility Construction (Detail Number 4010). 7. The applicant needs to obtain a NPDES construction site permit prior to any land disturbing activity. A copy of this permit will be provided to the City. 8. No pylon signs are allowed in the 12th Avenue right-of-way, the roadway easement or any drainage and utility easements unless written permission from the City Engineer is obtained. 9. The applicant will adjust the westernmost 12th Avenue access to line up with the access to the north. 10. All curb and gutter within the 12th Avenue right-of-way or roadway easement must be concrete. 11. In the future a bituminous trail will be constructed along 12th Avenue. Therefore the applicant will work with the City of Shakopee to drop the curb and gutter in adequate locations for the crossings. In order to provide adequate boulevard widths for snow storage for the street and the future bituminous trail, the applicant will shrink the east-west drive lane south of 12th Avenue to accommodate. 13. A commercial driveway and cross pan (per detail number 5006) will be required at each access to 12th Avenue. 14. Any access(es) shared between Lots 1 and 2 of Block 1 will require a shared access agreement. A copy of this agreement will be provided to the City of Shakopee. 15. The applicant needs to submit a landscaping plan in compliance with the most recent version of the City of Shakopee's Easement Fencing and Landscaping Policy. Final Plat Conditions The following items need to be addressed/completed prior to release of the Final Plat for recording: 1. Easements need to be shown/referenced on the Final Plat and as approved by the City Engineer. They will include, but are not be limited to, the following: • Minimum drainage and utility easements for public utilities need to be dedicated per the City of Shakopee Design Criteria, Section 10.1 (A-D). The easements need to be centered along the public utility alignments. • Provide a minimum of thirty (30) feet of drainage and utility easement south of the centerline of the existing trunk sanitary sewer located along the north side of Lots 1 and 2 of Block 1. • Provide an adequate trail easement along the north side of Lots 1 and 2 of Block 1. The width is to be determined by the City Engineer once the site design is finalized. Recommendation Engineering staff recommends approval of the Final Plat application subject to the conditions listed above being addressed/completed by the applicant. A copy of this permit/approval will be provided to the City of Shakopee engineering department. 3. The applicant will comply with the maximum allowable impervious surface percentage set forth by the City Code,which is 75%for this site. 4. Infiltration will need to be incorporated into the site's design and storm water management plan. The amount to be infiltrated is set forth by the National Pollutant Discharge Elimination System (NPDES) requirements. 5. Surface water runoff for each of the lots will be required to be piped to the regional storm water basin to the south. Overland flow will not be allowed as this creates a potential for future erosion issues. 6. All flared end sections to the MnDOT right-of-way will need to have geotextile fabric and Class IV fieldstone riprap to the basin bottom. The amounts of fabric and riprap are set forth in the City of Shakopee General Specifications and Standard Detail Plates for Street&Utility Construction(Detail Number 4010). 7. The applicant needs to obtain a NPDES construction site permit prior to any land disturbing activity. A copy of this permit will be provided to the City. 8. No pylon signs are allowed in the 12th Avenue right-of-way, the roadway easement or any drainage and utility easements unless written permission from the City Engineer is obtained. 9. The western access to Lot 2 must be in a location and configuration acceptable to the City Engineer. 10. All curb and gutter within the 12th Avenue right-of-way or roadway easement must be concrete. 11. In the future a bituminous trail will be constructed along 12th Avenue. Therefore the applicant will work with the City of Shakopee to drop the curb and gutter in adequate locations for the crossings. 12. In order to provide adequate boulevard widths for snow storage for the street and the future bituminous trail, the applicant will provide a plan acceptable to the City Engineer. 13. A commercial driveway and cross pan (per detail number 5006) will be required at each access to 12th Avenue. 14. The shared drive between Lots 1 and 2 of Block 1 will require a shared access agreement. A property owner's association or maintenance agreement for the driveway must be executed designating the party responsible for maintaining the driveway, and granting the party right to assess all properties benefiting from the driveway for the cost of maintenance. The agreement shall also grant the City the right to enter and maintain the driveway when it deems necessary to maintain safe access, and to charge the cost of such maintenance back to the property owners. A copy of this agreement will be provided to the City of Shakopee. 15. The applicant needs to submit a landscaping plan in compliance with the most recent version of the City of Shakopee's Easement Fencing and Landscaping Policy. 16. If the apron is within the clear zone for Highway 169, a safety apron is required instead of a flared apron. Contact Nancy Jacobson at MnDOT at 651-234-7911 with questions on design. 17. The infiltration basin along the south property line appears to lower the ground elevation within the utility easement where Shakopee Public Utilities has 6 underground feeder cables installed. These cables may have to be either lowered, replaced, or relocated at the developer's expense. Contact Shakopee Public Utilities for details. 18. The private water service as shown will require a manhole with a double check valve for back-flow prevention located at the south leg of the tee where the service branches to the building and the private fire hydrant in the south parking lot. 19. Any future access to 12th Avenue on the west side of Lot 1 must be aligned with the existing access on the north side of 12th Avenue. 20. The landscaping on the site must comply with City Code Sec. 11.60 Subd. 8. Adopted in regular session of the City Council of the City of Shakopee,Minnesota, held the day of ,2014.
