SHAKOI'EE TO: Mayor and City Council Mark McNeill, City Administrator FROM: Jeff Weyandt, Assistant City Engineer DATE: 07/15/2014 SUBJECT: Approve a Request from Bituminous Roadways for Extending Work Hours on the 2014 Bituminous Overlay Project No. 2014-2 on Eagle Creek Blvd. (D) Action Sought Offer a motion approving a suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, allowing them to work from 5:30 A.M. to 10:00 P.M. on July 23 and July 24, 2014 on Eagle Creek Blvd. to expedite the work and cause less days for public inconvenience. Background Bituminous Roadways has requested that City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, be suspended for certain work hours. The above named section of the City Code restricts the hours of operation from 7:00 A.M. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and holidays. Bituminous Roadways is requesting suspension on the hours as per the attached email to allow for work between the weekday hours of 5:00 A.M. to 10:00 P.M. on Monday, July 23, 2014 and Tuesday, July 24, 2014. This request is to expedite the work in this area to be two longer days instead of 4 shorter days providing a shorter inconvenience to the traveling public on Eagle Creek Boulevard. Staff recommends allowing work to begin at 5:30 P.M. The project scope for this requests includes: Eagle Creek Boulevard from CSAH 17 to CSAH 3. Staff would recommend that if the suspension of hours is granted, that the approval is subject to the following conditions: 1. Approval is contingent upon minimizing noise exposure. 2. If property owner complaints are received by the City, the suspension can be revoked at the discretion of the City Engineer. If Council approves the suspension, a public notice to meet the City Code requirements and notice such as a news release would be placed in the Shakopee Valley News. Also staff will send out a notice to single family residences along Eagle Creek Boulevard prior to the work being done, if approved by City Council. Recommendation Staff recommends approving a suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, per this memo, and direct staff to publish notice of the suspension terms with the conditions as recommended by staff. Budget Impact There is no impact on budget. Relationship to Vision This supports Goal D: Maintain, Improve and Create strong partnerships with other public and private sector entities. The waiver will allow us to finish the milling and paving in 2 long days rather than 4 shorter days and provide a shorter inconvenience to the traveling public in terms of days and missing 2 morning rush hours and 2 afternoon rush hours.
