No. 7460 (B, F) Action Sought The City Council is asked to adopt Resolution No. 7460, a resolution approving the Final Plat of Stonebrooke 5th Addition. Background Fritz Menden, the property owner, has applied for Final Plat Approval of Stonebrooke 5th Addition(exhibit 3). The Final Plat of Stonebrooke 4th Addition(exhibit 2) created the existing lots Lot 6, Block 1 and Lot 9, Block 2 and Out-lot M , these lots are being converted to Lot 1 Block 1, and Lot 1 Block 2 of Stonebrooke 5th Addition, incorporating Out-lot M. Out-lot M was an unnecessary parcel, which through incorporation into Lot 1 Block 1, and Lot 1 Block 2 allow these lots to be utilized to their fullest extent. The purpose of combining Out-lot M into Lot 1 Block 1, and Lot 1 Block 2 is primarily due to the 30 foot setback from a wetland high-water-line on Lot 1 Block 1. A 30 foot setback is required from a High-water-line to the principal structure on the lot, including decks, due to this setback and the standard drainage and utility easements created during Stonebrooke 4th Addition, it became difficult for a home to be constructed within all applicable setbacks. City staff recommended that the applicant combine all of Out-lot M into Lot 1 Block 1, and Lot 1 Block 2 to remove the unnecessary Out-lot, and create two more standard parcels. This request is occurring concurrently with the Vacation of Right-of-way along Fairhaven Drive, and the standard drainage and utility easements created during Stonebrooke 4th Addition. Recommendation Staff recommends approval of Resolution No. 7460, a resolution approving the Final Plat of Stonebrooke 5th Addition. Budget Impact The budgetary impacts based on whether the City Council approves this request will likely be negligible based on the City's share of property tax collection. Relationship to Vision The Final Plat of Stonebrooke 5th Addition allows for the construction of 2 homes which were otherwise difficult to utilize. Stonebrooke 5th Addition removes an unnecessary outlot and creates an easier transition for future development. Requested Action Offer a motion to approve Resolution No. 7460, a resolution approving the Final Plat of Stonebrooke 5th Addition with conditions, and move its adoption. O--m L m°m C b • mONNN U'° • gi City of Shakopee Memorandum TO: Alex Sharpe, Planner FROM: Joe Swentek, Project Engineer SUBJECT: Final Plat—Stonebrooke 5th Addition PID#: 27-142049-0, 27-336006-0, 27-336015-0 CASE#: 14024 SUBLEDGER#: 114024 DATE: June 9, 2014 The staff review indicates a request to review a Final Plat application for a single-family rural residential (RR) subdivision located at the south terminus of Fairhaven Drive. This review should be considered preliminary, as more comments will follow with additional submittals. However, the engineering department offers the following comments at this time to the applicant and to the planning department: General Conditions The following items need to be addressed/completed prior to release of the Final Plat for recording: 1. Payment of all Storm Water Management Plan Review Fees need to be made, as required by the most current City of Shakopee Fee Schedule. 2. Payments of the Trunk Storm Water Charge and Trunk Storm Water Storage and Treatment Charge need to be made, as required by the most current City of Shakopee Fee Schedule. 3. Provide electronic files (AutoCAD and Portable Document Format) of the Final Plat to be recorded with datum on the Scott County coordinate system. The applicant needs to be aware the dwelling setback requirement to the approved high water level of the wetlands and the storm water basin set forth in Section 10, Subdivision 5.A.1 of the City of Shakopee Design Criteria includes decks. 2. The emergency overflow of each wetland will need to be surveyed by the applicant in order to determine if the minimum allowable building elevations are in compliance with Section 2, Subdivision 8.1 of the City of Shakopee Design Criteria. 3. A Wetland Conservation Act (WCA) type and boundary permit application will need to be approved in order to establish the wetland limits. 4. Any impacts to the wetlands will require the appropriate WCA permit. 5. It appears a portion of the existing Fairhaven Drive cul-de-sac is located on Lot 1, Block 1. The applicant will work with the City of Shakopee to enter into an encroachment agreement. 6. Access to Lot 1, Block 2 is through a drainage and utility easement. The applicant will work with the City of Shakopee to enter into an encroachment agreement. Park Dedication for the two residential lots within this application was not paid with previous Stonebrooke plats. 2. Given the location of the lots within an existing development, cash in lieu of land is required for satisfying the park dedication requirements. 3. Per City Code Chapter 12, Section 12.34, Subd. 2. A. As a prerequisite to subdivision approval, subdividers shall dedicate land for parks, playgrounds, public open spaces and trails and/or shall make a cash contribution to the City's park fund and trail fund as provided in this section. 4. Park dedication fees in the amount required by the City Code and adopted City fee schedule shall be paid at the time of recording of the final plat. 5. The emergency overflow of each wetland will need to be surveyed by the applicant in order to determine if the minimum allowable building elevations are in compliance with Section 2, Subdivision 8.I of the City of Shakopee Design Criteria. 3. A Wetland Conservation Act (WCA) type and boundary permit application will need to be approved in order to establish the wetland limits. 4. Any impacts to the wetlands will require the appropriate WCA permit. 5. It appears a portion of the existing Fairhaven Drive cul-de-sac is located on Lot 1, Block 1.The applicant will work with the City of Shakopee to enter into an encroachment agreement. 6. Access to Lot 1, Block 2 is through a drainage and utility easement. The applicant will work with the City of Shakopee to enter into an encroachment agreement. 7. If deemed necessary a Developers Agreement may be required by City staff or legal counsel, for the Public improvements to Fairhaven drive. 8. A summary of the tree removal/replacement is as follows: 1. Applicant is to remove 2 non-heritage trees, which requires no replacement. If the applicant removes 3 or more significant trees or one heritage tree, replacement is required per the City's Tree Management Regulations. In addition, the applicant shall meet the City's landscaping requirements. 9. Tree protection fencing must be install and inspected by City staff before any grading, woodland alteration, or building takes place. 10. The following trees are not accepted as replacement or landscaping trees*: Maple (Acer) Ash(Fraxinus) Spruce (Picea) Apple (Malus) *Due to genus making up a high percentage of Shakopee's urban forest or the threat of insect/disease. 11. Final grading requires the placement of a minimum 6 inches of topsoil meeting requirements set in MnDOT's "SELECT TOPSOIL BORROW" (spec. 3877.2 B, Table 3877-2). 12. Trees shall be planted according to the following conditions: 1. Trees shall be planted a minimum of 4 feet from impervious surfaces. 2. Trees shall be planted a minimum of ten feet from property lines. 3. Trees shall not be planted in easements containing utilities. 4. Trees shall not be planted in City owned right-of-way. 5. Trees shall not be planted below overhead utilities. 6. Trees shall not be planted below high water levels (HWL) in existing or created ponds or wetlands.
