Action Sought
Approval of Resolution 7459, as resolution approving the vacation of right-of-way along
Fairhaven Drive in the Stonebrooke 4th addition as well vacation of drainage and utility
easements to enlarge residential Lot 6, Block 1 and Lot 9, Block 2 in Stonebrooke 4th addition.
Background
The purpose of the vacation of the Right-of-way (ROW) along Fairhaven drive is to allow for Lot
6, Block 1 and Lot 9, Block 2 in Stonebrooke 4th addition to have better access to the roadway.
Both lots are currently in the platting process to include additional road ROW for Fairhaven
Drive. This will straighten the roadway as proposed, and prevent the need for a temporary
cul-de-sac easement.
The purpose of the vacation of the drainage and utility easements is to increase the lot sizes of
Lot 6, Block 1 and Lot 9, Block 2 in Stonebrooke 4th addition. Due to changes in City code for
the setback from wetlands these lots became difficult to develop. The developer, Fritz Menden is
currently undergoing the platting process to combine outlot M (as seen on the attached plat)to
these lots increase their size and remove a small undesirable outlot from the plat. A portion of
outlot M is also being dedicated to Fairhaven drive for further extension of the roadway.
Recommendation
City Staff recommends approval of Resolution 7459, a Resolution which approves the vacation
of identified right-of-way and drainage and utility easements in Stonebrooke 4th addition with the
following conditions:
1. The forthcoming Stonebrooke 5th Addition Final Plat will need to dedicate adequate Fairhaven
Drive right-of-way and easements as required by City Code and the City of Shakopee Design
Criteria.
2. The approval of the vacation is contingent upon the approval of the Stonebrooke 5th Addition
Final Plat application.

This is primarily a housekeeping item that allows for the Final Plat of Stonebrooke 5th Addition,
which increases the number of homes within the community.
Requested Action
Approval of Resolution 7459 with the conditions as presented.

STREET,DRAINAGE AND UTILITY VACATION PETITION
To the City of Shakopee, Scott County,Minnesota:
The undersigned majority owners of the property abutting the property that is being proposed for
vacation hereby petition you to vacate the following described street and drainage and utility
easement legally described as follows:
That part of Fairview Drive, dedicated per STONEBROOKE FOURTH ADDITION,
according to the recorded plat thereof, Scott County, Minnesota, described as follows:
Beginning at a point on the southwest corner of Lot 9,Block 2, STONEBROOKE
FOURTH ADDITION;thence North 89 degrees 58 minutes 51 seconds West(assumed
bearing), along the south line of Lot 9, a distance of 15.47 feet;thence North 10 degrees
43 minutes 32 seconds West, a distance of 78.40 feet to the west line of said Lot 9;thence
southerly, a distance of 83.17 feet,along said west line of Lot 9,being a non-tangential
curve concave to the east having a radius of 225.00 feet, a central angle of 21 degrees 10
minutes 44 seconds and a 82.70 foot chord which bears South 21 degrees 18 minutes 54
seconds East to the point of beginning.
AND
All the part of the 10 foot wide drainage and utility easement, dedicated per
STONEBROOKE FOURTH ADDITION, according to the recorded plat thereof, Scott
County,Minnesota, abutting the south line of Lot 6,Block 1, said STONEBROOKE
FOURTH ADDITION.
The purpose and necessity of the requested road, drainage and utility vacations are to allow the
property owners Fritz Menden and Menden's F and B Construction Inc.the ability to re-plat their
property. Fritz Menden and Menden's F and B Construction Inc. own all of the land area
proposed to be vacated or abutting the street proposed to be vacated. We ask that you proceed
with such vacation.

RESOLUTION NO. 7459
A RESOLUTION APPROVING A VACATION OF A PORTION OF RIGHT-OF-WAY
ALONG FAIRHAVEN DRIVE AND CERTAIN PUBLIC DRAINAGE AND UTILITY
EASEMENTS IN STONEBROOKE 4TH ADDITION PLAT
WHEREAS, Fritz Menden,property owner, has made an application proposing the vacation of
a portion of Right-of-Way on Fairhaven Drive and certain public drainage and utility easements in
Stonebrooke 4th Addition; and
WHEREAS, it has been made to appear to the Shakopee City Council that a portion of Right-
of-Way of Fairhaven Drive and certain public drainage and utility easements in Stonebrooke 4th
Addition is no longer of public use or interest; and
WHEREAS, the public drainage and utility easements to be vacated are legally described
within an attached Exhibit (Proposed Vacations); and
WHEREAS, the Shakopee Planning Commission considered the request at its meeting of June
5, 2014, and unanimously recommended approval with conditions to the City Council; and
WHEREAS, a public hearing to consider the action to vacate the public easement was held in
the Council Chambers of the City Hall in the City of Shakopee at 7:00 P.M. on the 17th day of June,
2014; and
WHEREAS, ten days published notice was provided by publication of the notice in the
SHAKOPEE VALLEY NEWS and posted notice was provided by posting such notice on the bulletin
board on the main floor of the Scott County Courthouse, the bulletin board at the U.S. Post Office, the
bulletin board at the Shakopee Public Library, and the bulletin board in the Shakopee City Hall.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE,MINNESOTA, THAT:
1. It finds and determines that the vacation of a portion of Right-of-Way on Fairhaven Drive and
certain public drainage and utility easements in Stonebrooke 4th Addition hereinafter described
is in the public interest.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE,MINNESOTA, THAT:
1. The forthcoming Stonebrooke 5th Addition Final Plat will need to dedicate adequate right-
of-way for Fairhaven Drive and drainage and utility easements as required by City Code
and the City of Shakopee Design Criteria.
2. The approval of the vacation is contingent upon the approval of the Stonebrooke 5th
Addition Final Plat application.
After the adoption of the Resolution, the City Clerk shall file certified copies hereof with the County
Auditor and County Recorder of Scott County.
Adopted in the session of the City Council of the City of Shakopee, Minnesota, held the
