SHAKOPEE TO: Mayor and City Council Mark McNeill, City Administrator FROM: Bruce Loney,Public Works Director DATE: 07/01/2014 SUBJECT: Request of S.M.Hentges&Sons for Extending Work Hours on the CSAH 17/Vierling Drive/TH 169 Ramp Improvement Project,Projects No.2013-5&2012-6(D) Action Sought Offer a motion approving a suspension of City Code Sec. 10.60,Noise Elimination and Noise Prevention, Subd.3, Hourly Restrictions on Certain Operations,D,allowing them to work Monday through Friday from 7:00 A.M.to 9:00 P.M.and Saturday from 7:00 A.M.to 5:00 P.M.to expedite the work and directing staff to publish notice of the suspension terms with the conditions as recommended by staff. Background S.M.Hentges& Sons has requested that City Code Sec. 10.60,Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations,be suspended for certain work hours. The above named section of the City Code restricts the hours of operation from 7:00 A.M.to 10:00 P.M on weekdays, and from 9:00 A.M to 9:00 P.M. on weekends and holidays. S.M.Hentges&Sons is requesting suspension on the hours as per the attached letter to allow for work between the weekday hours of 7:00 A.M to 9:00 P.M. and Saturday from 7:00 A.M.to 5:00 P.M. beginning July 2,2014 until the project is completed. This request is to help expedite the work for this project which does have a tight timeline. The project scope includes: CSAH 17 from Vierling Drive to TH 169 North Ramps and on Vierling Drive in this area. Staff would recommend that if the suspension of hours is granted,that the approval is subject to the following conditions: 1.Approval is contingent upon minimizing noise exposure. 2.If property owner complaints are received by the City,the suspension can be revoked at the discretion of the City Engineer. If Council approves the suspension,a public notice to meet the City Code requirements and notice such as a news release would be placed in the Shakopee Valley News. Recommendation Staff recommends approving the suspension of City Code Se. 10.60,Noise Elimination and Noise Prevention,subd. 3,Hourly Restrictions on Certain Operations,per this memo,and direct staff to publish notice of the suspension terms with the conditions as recommended by staff. Budget Impact There is no impact on budget. Relationship to Vision This supports Goal D: Maintain, improve and create strong partnerships with other public and private sector entities. Hentges&Sons Inc. (SMH) is submitting a request to modify the project working hours. Currently the Mon.—Fri. working hours are from 7:00 AM—7:00 PM and the Saturday working hours are from 9:00 AM to 5:00 PM for the construction duration of the said project. SMH requests that the Mon.—Fri. working hours be changed to 7:00 AM—9:00 PM and the Saturday working hours for the project be changed to 7:00 AM to 5:00 PM.
