SUBJECT: Request of Scott County for Extending Work Hours on 17th Avenue Paving Project(D)
Action Sought
Offer a motion approving a suspension of City Code Sec. 10.60,Noise Elimination and Noise Prevention, Subd. 3,
Hourly Restrictions on Certain Operations,D,allowing work beginning on July 13, 2014 and continuing only until
the County's Paving project is completed on 17th Avenue from Marschall Road to Sarazin Street; and directing staff
to publish notice of the suspension terms with the conditions as recommended by staff.
Background
Scott County has requested that City Code Sec. 10.60,Noise Elimination and Noise Prevention, Subd. 3,Hourly
Restrictions on Certain Operations,be suspended for certain work hours.
The above named section of the City Code restricts the hours of operation from 7:00 A.M.to 10:00 P.M. on
weekdays, and from 9:00 A.M.to 9:00 P.M. on weekends and holidays.
The County is requesting a suspension on the hours as per the attached letter to allow for work between the hours of
10:00 P.M. and 6:00 A.M.beginning the week of July 13,2014 until the project is completed.Although the project
should only take approximately one week,the proposed start date is tentative and could change based on weather
and previously scheduled projects.
The project scope includes:
CSAH 16 from Marschall Road to Sarazin Street
This request is being made to help expedite the work and avoid traffic impacts on CSAH 16,especially due to the
construction work on CSAH 17.
Staff would recommend that if the suspension of hours is granted,that the approval is subject to the following
conditions:
1.Approval is contingent upon minimizing noise exposure.
2. If property owner complaints are received by the City,the suspension can be revoked at the discretion of the
City Engineer.
If Council approves the suspension, a public notice to meet the City Code requirements and notice such as a news
release would be placed in the Shakopee Valley News.
Recommendation
Approve the suspension of City Code Sec. 10.60,Noise Elimination and Noise Prevention, Subd. 3,Hourly
Restrictions on Certain Operations,per this memo,and direct staff to publish notice of the suspension terms with
the conditions as recommended by staff

Re: Request for Extended Working Hours
Scott County's 17th Ave Paving Project
Dear Mr. Loney:
Scott County's annual bituminous paving projects this year include 17' Ave. (CSAH 16)from Marschall Rd. to
Sarazin St. in the City of Shakopee. Hardrives Inc. has been selected to perform the work which includes milling the
inplace material, which is to be hauled offsite and replaced with 5.5"of blacktop.
This section of 17th Ave.is adjacent to a shopping mall that includes retail stores that draw a high volume of
daytime and early evening traffic. Scott County is also re-constructing Marschall Rd. between 17`h Ave and
Dominion Ave.which has displaced traffic in this area.
To minimize disruption to nearby residents and the traveling public, Scott County has proposed to the contractor
to perform this work at night.The suggested working hours would be between 10:00 p.m.and 6:00 a.m.Monday—
Friday, tentatively starting the week of July 13th,2014.This project is scheduled to take one week to complete
dependent on weather and any unforeseen problems that may arise.
Scott County respectfully requests that the City of Shakopee working hours be extended during the 17th Ave.
bituminous paving project to include the hours of 10:00 p.m. to 6:00 a.m. for this specific project only.
