SUBJECT: A Resolution Granting Approval of Valleyfair's Appeal of the Planning Commission's Resolution No.

Action Sought
Approval of Resolution No. 7468,a Resolution approving Valleyfair's appeal of Planning Commission Resolution
No.PC 14-020.
Background
On July 15,2014, City Council discussed the appeal made by Valleyfair of the Planning Commission's Resolution
No.PC 14-020.After considering the request,the City Council directed staff to bring a resolution of approval for
the appeal. Resolution No. 7468, is a resolution approving the appeal of Valleyfair for an 8 second hold time on the
entry sign.
Recommendation
City staff recommends approval of Resolution No. 7468 on consent per the City Council discussion on July 15,
2014.
Budget Impact
There is no impact on the City's General Fund budget.

RESOLUTION NO. 7468
A RESOLUTION OF THE CITY OF SHAKOPEE GRANTING APPROVAL OF
VALLEYFAIR'S APPEAL OF THE PLANNING COMMISSION RESOLUTION PC14-020.
WHEREAS, Thomas Suel, on behalf of Valleyfair made application on March 27, 2014 for
an Amendment to the Valleyfair Planned Unit Development to alter the existing entry sign to a new
electronic message center sign; and
WHEREAS,the Public Hearing on March 8, 2014 was continued to June 5, 2014 at the
applicant's request; and
WHEREAS,the Planning Commission held a public hearing and reviewed Valleyfair's
Planned Unit Development amendment application at the Commission's June 5, 2014 meeting; and
WHEREAS,the Commission adopted Resolution No. PC 14-020, a resolution approving the
Planned Unit Development amendment subject to 4 conditions; and
WHEREAS,the Condition number 4 of Resolution No. PC14-020, stated that the electronic
message center sign shall comply with City code Section 11.70 in relation to the duration of
messages being 1 minute; and
WHEREAS, City Code Section 11.90, Subdv. 2 allows for an appeal to the City Council of
the Planning Commission's decision within 10 days of the Commission's decision; and
WHEREAS,Ms. Mindy Lawrence, on behalf of Valleyfair filed an appeal on June 16, 2014
of the Commission's decision on the basis that studies indicate the electronic message displays do
not pose a negative impact on traffic safety if the messages are changed at reasonable intervals; and
WHEREAS,the appeal requests that the message change frequency by allowed every 8
seconds rather than the 1 minute required by City Code; and

WHEREAS,the appeal request for an 8 seconds between message change was not reviewed
by the Planning Commission; and
WHEREAS,the City Council heard the appeal at its meeting on July 15, 2014; and
WHEREAS,the City Council has reviewed the materials related to the Planned Unit
Development amendment, and the submitted exhibits.
NOW,THEREFORE BE IT RESOLVED that the City Council of the City of Shakopee
adopts the following findings of facts and conclusion relative to this matter:
FINDINGS
1. The City Council has the authority to grant approval of the appeal, and amend the
Planned Unit Development.
2. City Code requires the Planning Commission to be the governing body regarding the
Planned Unit Development amendment due to the proposal being less than 10%of the
total site area being affected.
3. Based on the evidence presented City Council approved of the appeal and amendment to
the Planned Unit Development.
BE IT FURTHER RESOLVED,that the appeal of the Planning Commission Resolution No.
PC14-020 is granted and that the Commission's decision is amended to allow 8 seconds message
duration rather than the 60 seconds as required per City code.
BE IT FURTHER RESOLVED,that the findings adopted by Planning Commission are
incorporated by reference into this Resolution.
Passed in regular session of the City Council of the City of Shakopee, Minnesota held this
