Action Sought
Adopt Resolution No. 7455 designating the polling places for Shakopee.
Background:
City staff is recommending moving the precinct five from Sweeney School on Adams Street to the Youth Building
at Lion's Park. Staff has recently been informed that the school is undergoing renovations this summer.Part of the
renovations includes abatement of the building. This means that no one is allowed in the building until after the 19th
of August. Since the work will not be completed before the August primary it is necessary for the city to provide
another polling place for both the primary and general election. Once a polling place is defined,it can't be changed
during the election cycle of 2014. Therefore both elections will be held at the Youth building.
Staff will also be sending a written notification to all registered voters of precincts five notifying them of this
specific location change. This will be done following approval of this council action.
Additional signage will be posted at the Sweeney School and at the Youth Building site as well as provided to the
local paper,website and other communication links.

A RESOLUTION CHANGING THE POLLING PLACE LOCATION FOR THE FIFTH ELECTION PRECINCTTO THE
YOUTH BUILDING AT LION'S PARK, LOCATED AT 1099 ADAMS STREET SOUTH FOR BOTH THE 2014
PRIMARY AND GENERAL ELECTIONS
WHEREAS, in Resolution No. 7180, adopted on March 20, 2012, the City Council designated
Sweeney Elementary School, located at 1001 Adams Street South as a polling place for the Fifth Election
Precinct for the upcoming primary and general elections; and
WHEREAS, the City was informed on May 28th, 2014 by Sweeney Elementary School
representatives that the school will be undergoing renovations this summer which include the
abatement of hazardous materials;and
WHEREAS, due to nature of these renovations, no portions of the Sweeney Elementary School
building will be accessible to the general public on August 12, 2014,the day of the primary election;and
WHEREAS, because no access to any part of the Sweeney Elementary School building will be
allowed on the date of the primary election and because there are less than 90 days prior to the primary
election, which is required by Minnesota Statutes Section 217B.16, subdivision 3 to change the polling
place, the City Council finds this to be an emergency rendering this polling place unusable pursuant to
Minnesota Statutes Section 2176.16,subdivision 7;and
WHEREAS, the Youth Building at Lion's Park, located 1099 Adams Street South is located one-
tenth of a mile from Sweeney Elementary School, meets all accessibility requirements, and is available
to be used as a polling place for both the primary and general elections;and
WHEREAS, the City Council hereby changes the polling place location for the Fifth Election
Precinct from Sweeney Elementary School to the Youth Building at Lion's Park, located at 1099 Adams
Street South;and
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA:
1. That there is an emergency rendering the polling place at Sweeney Elementary School
for the Fifth Election Precinct unusable pursuant to Minnesota Statutes Section 217B.16,
subdivision 7.
2. The polling place for the Fifth Election Precinct for both the primary and general
elections is hereby designated as the Youth Building at Lion's Park, located at 1099
Adams Street South in the City of Shakopee.
3. That City staff are directed to notify the voters in the Fifth Election Precinct of the
change in the location of the polling place in accordance with the requirements set forth
in Minnesota Statutes Section 2046.16,subdivision 1a.
4. That as an additional precaution to ensure that all voters are aware of this change, the
election judges of the Fifth Election Precinct are directed to follow the procedures set

forth in Minnesota Statutes Section 204B.17 that are required for a change of a
designated polling place with respect to both the primary and general election days.
These procedures are as follows:
a) Meet at Sweeney Elementary School on the election days where they shall fill any
vacancies in their number;
b) Publicly announce the change in polling place to the voters who are present at
Sweeney Elementary School;
c) Post a notice in large print of the change in a conspicuous place at Sweeney
Elementary School;and
d) Post an additional notice in a location at Sweeney Elementary School that is visible
by voters who vote from their motor vehicles as provided in Minnesota Statutes
Section 204C.15,subdivision 2.
5. Upon completion of the requirements set forth above and in Minnesota Statutes
Section 204B.17, the election judges shall adjourn to the new polling place (Youth
Building at Lion's Park, located at 1099 Adams Street South), where they shall post a
similar notice of change in polling place.
6. Any expenses incurred because of the change in polling place shall be certified by the
election judges and shall be paid as part of the expenses of the election.
Adopted in regular session of the City Council of the City of Shakopee, Minnesota, held this 3`d
day of June, 2014.
