Action Sought
Approval of Amendment to Extension Agreement for Additional Design Fees on the East
Shakopee Industrial Sewer Improvements Project No. 2013 -4.
Background
The City approved an Extension Agreement with Bolton and Menk, Inc. (BMI) for design and
bidding services for the East Shakopee Industrial Sewer Improvements in the amount of
$48,935.00. Due to the number of complications, a lot of additional work was required to
successfully bid the project. BMI occurred an additional $52,000.00 in design and bidding costs.
The additional work consisted of the following:
• Coordination with Magellan Pipe line.
• Numerous additional meetings and additional surveying due to the lack of proper locates
from small utilities.
• Additional surveying for the Cretex fence relocation.
• Redesigning and rebidding the project.
• Redesigning a portion of the project a third time due to misinformation from Union Pacific
Railroad.
Recommendation
Approval of Amendment to Extension Agreement for Additional Design Fees on the East
Shakopee Industrial Sewer Improvements Project No. 2013 -4.
Budget Impact
The cost for this project are being assessed to the benefitting properties.
Relationship to Vision
This supports Goal E: Deliver effective and efficient public services by a staff of well - trained,
caring, and professional employees.

Bolton & Menk, Inc. respectfully requests consideration be given to approving an Extension Agreement
Amendment in the amount of $52,000.00 for additional services performed on the above referenced
project.
Additional services were required, due to items, events, and occurrences beyond our control and original
scope of services, to obtain a successful bid and Contract award for the City. The additional services
required include but are not limited to the following:
• Additional work such as coordination, working around, permitting, insurance requirements, etc.
associated with the Magellan Pipeline.
• Additional coordination, site meetings, and survey crew time required due to difficulties in
getting utility locates completed properly.
• Cretex fence relocation staking and coordination
• Work associated with determining whether to award the initial bid.
• Plan, specification, proposal, cost estimate, bid process, etc., revisions for rebidding the project.
• Additional post -rebid plan revisions due to UPRR misinformation.
