Action Sought
Approval of the Resolution to amend 11.70 Signs, Subdivision 4.
Background
Staff has received several questions regarding corporate flags on new sites throughout the
community. The definition of "signs" in Chapter 11, Zoning, currently includes corporate flags
This amendment would include corporate flags as unregulated signs so long as they are displayed
in conjunction with National or political subdivision flags and are limited in size.
The text below is the recommended language from the Planning Commission for amending
section 11.70 Signs subdivision 4. The underlined texts is new text to this section.
11.70 Signs, Subdivision 4.
Signs which are located on the interior of a structure, signs specifically designed to be viewed
from within the lot or parcel of land on which they are located and not from a street, national
flags, flags of political subdivisions, one campus / business flag per site or for each principal use
per site only when displayed in conjunction with national or political subdivision flags and not
exceeding the area of the national / political subdivision or 60 square feet, whichever is less, and
holiday decorations are not regulated by this section.
Recommendation
The Planning Commission recommended approval of the text amendment on May 8, 2014
consistent with the staff recommendation.

ORDINANCE NO. 888
AN ORDINANCE OF THE CITY OF SHAKOPEE APPROVING AN AMENDMENT TO
CITY CODE SECTION 11.70 (Signs)
WHEREAS, The City of Shakopee has proposed an amendments to section 11.70, signs,
subdivision 4 of the Zoning Ordinance regarding flags as signs not regulated; and
WHEREAS, notices were duly sent and posted, and a public hearing was held before the
Planning Commission on May 8, 2014 at which time all persons present were given an
opportunity to be heard; and
WHEREAS, the Planning Commission recommended that City Code Section 11.70,
subdivision 4, be amended to include language pertaining to flags as unregulated signs; and
WHEREAS, the City Council heard the matter at its meeting on May 20, 2014; and
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS:
Section 1 — That City Code Chapter 11 (Zoning) is amended to add the language as follows:
Language which is underlined shall be added. Language which is stftielAhr-eu shall be deleted.
11.70 Signs
Subdivision 4.
Signs which are located on the interior of a structure, signs specifically designed to be
viewed from within the lot or parcel of land on which they are located and not from a
street, national flags, flags of political subdivisions, one campus / business flag per site or
for each principal use per site, only when displayed in conjunction with national or
political subdivision flags and not exceeding the area of the national / political
subdivision, or 60 square feet, whichever is less, and holiday decorations are not
regulated by this section.
Section 2. The City Council adopts the following findings of fact relating to the request to
modify the language in the City's zoning ordinance regarding campus / business flags.
Criteria #1 That the original zoning ordinance is in error;
Finding #1 There has been no evidence that the original zoning ordinance is in error. There
has been increased interest in the creation of campus flags in concurrence with
National or political subdivision flags. The proposed ordinance sets appropriate
limits that allow businesses to display corporate logos.
Criteria #2 That significant changes in community goals and policies have taken place;
Finding #2 There have not been significant changes in community goals and policies,
however Shakopee has developed with many large business campuses which
desire the ability to display flags.
Criteria #3 That significant changes in City -wide or neighborhood development patterns have
occurred;
Finding #3 There has been no evidence presented that either city -wide or neighborhood
development patterns have changed. The proposed text amendment does not alter
the character of development.
Criteria 44 That the Comprehensive Plan requires a different provision;
Finding #4 The Comprehensive Plan does not require a different provision.
Section 3. Effective Date. This ordinance shall be in effect from and after the date of its
passage and publication.
Adopted in session of the City Council of the City of Shakopee, Minnesota held
this day of , 2014.
