No. 7444 (E) 4. B. Approve Resolution No.7444, which accepts the bids and awards a contract for the 2014 Street Reconstruction, Project No. 2014 -1 to Wm. Mueller & Sons, Inc. and approve a 5% contingency amount on this project for use by the City Engineer in authorizing change orders or quantity adjustments on this project. Background On April 1, 2014, City Council adopted Resolution No. 7432, which approved the plans and specifications and authorized staff to advertise for bids for the 2014 Street Reconstruction, Project No. 2014 -1. On April 29, 2014, a bid opening was held for the 2014 Street Reconstruction Project, in which there were five bids opened for this reconstruction project. The bids are summarized in the attached resolution. From the bid opening, the low bidder is Wm. Mueller & Sons with a bid of $2,112,435.91. The Engineer's estimate for this project is $2,260,000.00. The Preliminary Engineering report included a project cost estimate of $2,786,860.00. Adding a 5% contingency to the low bid and 20% indirect costs, the projected project cost is approximately $2,640,000.00 which is below the estimated cost in the Preliminary Engineering Report. If Council awards the contract, staff is also requesting a contingency amount equal to 5% of the contract to cover minor change orders and quantity adjustments that may occur on the project. Recommendation 1. Accept the low bid from Wm. Mueller & Sons, Inc. and adopt Resolution No.7444. 2. Approve a 5% contingency amount on this project for use by the City Engineer in authorizing change orders or quantity adjustments on this project. Budget Impact This project is funded by Assessments, Tax Levy, Shakopee Public Utilities, the Sanitary Sewer Fund and the Storm Sewer Fund. Relationship to Vision This supports Goal E: "Deliver effective and efficient public services by a staff of well- trained, caring, and professional entities ". Requested Action Approve Resolution No.7444, which accepts the bids and awards a contract for the 2014 Street Reconstruction, Project No. 2014 -1 to Wm. Mueller & Sons, Inc. and approve a 5% contingency amount on this project for use by the City Engineer in authorizing change orders or quantity adjustments on this project. Awarding the project now will allow time for contracts to be signed, submittals to be reviewed, manholes to be ordered and a pre meeting to be conducted so construction can start earlier. Attachments: RESOLUTION NO. 7444 Location Map RESOLUTION NO. 7444 A Resolution Accepting Bids For For The 2014 Street Reconstruction Project No. 2014 -1 WHEREAS, pursuant to an advertisement for bids for the 2014 Street Reconstruction, Project No. 2014 -1, bids were received, opened on April 29, 2014, and tabulated according to law, and the following bids were received complying with the advertisement: Bidder Amount WM. Mueller & Sons, Inc., 831 Park Avenue, Hamburg, MN 55339 is the lowest responsible bidder for the 2014 Street Reconstruction Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. The appropriate City officials are hereby authorized and directed to enter into a contract with Wm. Mueller & Sons, Inc. in the name of the City of Shakopee for the 2014 Street Reconstruction Project according to the plans and specifications therefore approved by the City Council and on file in the office of the City Clerk. 2. The City Clerk is hereby authorized and directed to return forthwith to all bidders the deposits made with their bids, except that the deposits of the successful bidder and the next lowest bidder shall be retained until a contract has been signed.
