SUBJECT: Amending the Personnel Handbook Regarding Pre - Employment Screenings -- Res. No. 7445 (E) Action Sought The Council is asked to adopt Resolution No. 7445, a Resolution Amending the Personnel Handbook for Employees of the City of Shakopee. Background The City currently requires a pre - employment physical / drug -test for all candidates for full -time employment. In 2012 the City added the requirement to complete a functional capacity exam to the pre - employment screenings for police officers and in 2013 we added this requirement for prospective firefighters. At this time, staff is recommending extending this requirement to the hiring process for full -time Public Works employees as well. A functional capacity exam or evaluation, which can also be known as fitness or agility testing, requires a candidate to physically demonstrate that they are able to perform the essential functions of the position they are being considered for. For example, if the job description states that they must be able to lift 50 lbs., they would be required to actually lift a 50 lb. object during the functional capacity exam. The City hires NovaCare Work Strategies to develop and administer these screenings. Attached is a description of the proposed screening for Public Works employees. As you will see, each component of the evaluation starts with a specific physical component of the job, then lists how this task will be simulated in the testing environment and what criteria will be used to determine a passing score. Two current employees have gone through the exam in order to ensure that the components are a valid representation of the daily work tasks associated with the Public Works Department. Functional capacity exams are an important and valuable part of our hiring process for physically demanding positions. They help ensure we are hiring the best possible candidates for a specific position, that candidates can safely perform the full range of duties expected of the position and that candidates understand the physical expectations of position from the start. Having these evaluations done by physical therapy and rehabilitation professionals ensures their validity and impartiality. Requested Action: If the Council concurs, it should offer Resolution 7445, a Resolution Amending the Personnel Handbook for Employees of the City of Shakopee, and move its adoption. Attachments: Res. No. 7445 Maintenance Operator Functional Capacity Test RESOLUTION No. 7445 A RESOLUTION AMENDING THE PERSONNEL HANDBOOK FOR EMPLOYEES OF THE CITY OF SHAKOPEE WHEREAS, Resolution No. 6604, a resolution adopting a Personnel Handbook for Employees of the City of Shakopee, was adopted on May 1, 2007. WHEREAS, from time to time there is a need to modify such policies to best suit the needs of the City and its employees. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, that Chapter III, Section D of the Personnel Handbook for Employees of the City of Shakopee shall be amended to read as follows: D. Pre - employment Medical Exams. After a written conditional offer of employment is made to either a non - promotional or promotional candidate, the City may require the candidate to take and pass a pre - employment physical exam, including a drug /alcohol test. The physician will render an opinion regarding the candidate's ability to perform the essential functions of the position, with or without reasonable accommodation. Successful completion of other pre - employment screenings, such as psychological testing, may be required depending on the nature of the position. Examples of individuals required to undergo pre- employment (or pre - promotional) psychological testing include those applying for positions with the Police and Fire Departments, as well as those being considered for upper level supervisory or management roles, such as Department Heads. Candidates for a position as a Police Officer, Community Service Officer, Maintenance Operator, Mechanic or Firefighter shall also be required to successfully complete a functional capacity evaluation, physically demonstrating their ability to perform the essential functions of the position.
