No. 6706 Z , CITY OF SHAKOPEE Memorandum n ~ r, ~ ~ ~ nlf TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Consider Approval of a Resolution Appointing a Representative and an Alternate to Serve on the Prior Lake Outlet Channel Project Cooperators Meetings DATE: December 18, 2007 INTRODUCTION: On August 8, 2007 the City Council authorized the execution of a Joint Powers Agreement and Memorandum of Agreement for the construction, use, operation, and maintenance of the Prior Lake Outlet Channel. The agreements are between the City of Prior Lake and the Prior Lake-Spring Lake Watershed District (PLSLWD), City of Shakopee and the Shakopee Mdewakanton Sioux Community (SMSC). Together the four organizations participating in the Joint Powers and Memorandum of Agreement are defined as the "Project Cooperators." On the attached Pages 44 and 45 of the Memorandum of Agreement, each Project Cooperator is to designate an individual and an alternate to serve as representatives and attend Project Cooperator meetings. The representative will be discussing the previous year's activities, future design and construction, operation and maintenance plans, modifications to the cost share allocations, review the expenditures and approve a budget for design and construction as well as operation and maintenance. Many of these items are technical in nature and involve storm water management plans (Engineering) and operation and maintenance of the channel (Public Works). Staff would recommend that since the implementation of the agreement involves Engineering and Public Works staff expertise, the Public Works Director/City Engineer, Bruce Loney be the representative. The alternate is recommended to be the Assistant City Engineer, Jeff Weyandt. On budget issues, staff will inform Council of significant changes to the agreement. Currently, staff has budgeted the channel improvements in the Storm Drainage CIP, as included in the agreement. If Council desires to have a Council member to be the representative, that is an option. The MOA is a fairly complex agreement and technical formulas were incorporated to determine the cost shares of each member. A technical person would need to go to the meetings if a Council member is appointed. Attached is a resolution proposing to appoint the Public Works Director/City Engineer as representative and the Assistant City Engineer as the alternate to represent the City at the Project Cooperators meetings. ALTERNATIVES: 1. Approve Resolution No. 6706, appointing the Public Works Director/City Engineer to serve as City representative at the Project Cooperators meetings and the Assistant City Engineer to serve as alternate. 2. Deny this agenda item for a specific reason and provide staff with direction. 3. Table this item to a certain date in the future. RECOMMENDATION: Staff recommends Alternative No. 1. ACTION REQUESTED: Offer Resolution No. 6706, A Resolution Appointing the Public Works Director/City Engineer and Assistant City Engineer to Serve as Representative and Alternate, Respectively, at the Project Cooperator Meeting According to the Joint Powers Agreement and Memorandum of Agreement for the Restoration and Maintenance of the Prior Lake Outlet Channel and move its adoption. l~`'- ce Loney, Public Works Director BUpmp ENGR/2007PROJECTS/2007COUNCII/MEMOfi706 RESOLUTION N0.6706 A Resolution Appointing The Public Works Director/Engineer And Assistant City Engineer To Serve As Representative And Alternate, Respectively, At The Project Cooperator Meetings According To The Joint Powers Agreement And Memorandum Of Agreement For The Restoration And Maintenance Of The Prior Lake Outlet Channel WHEREAS, the City of Prior Lake, Prior Lake-Spring Lake Watershed District and the City of Shakopee have entered into a Joint Powers Agreements for the maintenance of the Prior Lake Outlet Channel; and WHEREAS, the City of Prior Lake, Prior Lake-Spring Lake Watershed District, City of Shakopee along with the Shakopee Mdewakanton Sioux Community have entered into a Memorandum of Agreement for the same purpose; and WHEREAS, the Joint Powers Agreement and Memorandum of Agreement require a representative and alternate to attend Project Cooperator meetings. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, NIINNESOTA: 1. The recitals set forth above are incorporated herein. 2. The Public Works Director/City Engineer is hereby appointed to serve as City Representative at Project Cooperator meetings as spelled out in the Memorandum of Agreement and Joint Powers Agreement for the maintenance of the Prior Lake Outlet Channel. 3. The Assistant City Engineer is hereby appointed to serve as Alternate City Representative at Project Cooperator meetings as spelled out in the Memorandum of Agreement and Joint Powers Agreement for the maintenance of the Prior Lake Outlet Channel.
