Michael Leek, Community Development Director SUBJECT: Amendment to City Code Sec. 11.62, Subd. 3, K MEETING DATE: December 11, 2007 REVIEW PERIOD: NA INTRODUCTION: Inspection staff identified that the current provision of the Code left open the possibility that a driveway with a 15% grade could meet a street grade of up to 10%, which is not a desirable situation. To address that possibility, staff suggests a minor revision that would 1) reduce the _ maximum driveway grade, but 2) provide for some discretion by allowing City Engineer discretion to approve an alternate grade. ALTERNATIVES: 1. Offer and approve Ordinance No. 789, An Ordinance Amending City Code Sec. 11.62, Subd. 3, K Regarding Driveway Grades as presented. 2. Offer and approve Ordinance No. 789, An Ordinance Amending City Code Sec. 11.62, Subd. 3, K Regarding Driveway Grades with revisions. 3. Table the matter for additional information. PLANNING COMMISSION RECOMMENDATION: The Planning Commission reviewed the proposed text amendment at its December 6, 2007 meeting, and recommended approval unanimously. SUBD. 3. K. REGARDING DRIVEWAY GRADES THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA DOES HEREBY ORDAIN: Section 1. City Code Sec. 11.62. Subd. 3. K. regarding driveway grades is hereby amended as set forth below, with new language underlined and deleted language struck out; K. Maximum Driveway Grade. No driveway grade shall exceed X10% within twenty-five (25) feet of the property line or such other grade as approved by the City En ig Weer. Section 2. Effective Date of Ordinance. This ordinance becomes effective from and after its passage and publication. Adopted in regular session of the City Council of the City of Shakopee, Minnesota, held this day of , 2007.
