Waiver of Subdivision Criteria: 427 Minnesota Street ~ ~ CITY OF SHAKOPEE Q1 ~ rea+ ~ ~ ~ Memorandum ~ ~ ~ s CASE NO.: 08-002 TO: Mayor and City Council Mark McNeill, City Administrator FROM: Kyle Sobota, Planner I SUBJECT: Waiver of Subdivision Criteria: 427 Minnesota Street MEETING DATE: December 18, 2007 INTRODUCTION: Jim and Bonnie Wakely have submitted a request for approval of a waiver of subdivision criteria for the property at 427 Minnesota Street. The parcel is zoned Old Shakopee Residential (R-1C). An unoccupied home on the site dating back to the late 1800's or early 1900's was recently demolished, with some of the bricks being donated to the City of Shakopee. The applicant wishes to construct a new twin-home on the site, which will require a minor subdivision to create individual parcels for each dwelling unit. The applicant is requesting that the side yard setback be waived in order to allow a zero side yard setback for the lot line along the common boundary of the twin home units. All other proposed setbacks meet the R1C zoning guidelines. ALTERNATIVES: 1) Approve the requested waiver of subdivision criteria for sideyard setback in the R-1C Zone to allow a zero foot side yard setback at PID 27-097002-0 located at 427 Minnesota Street. 2) Do not approve the waiver of subdivision criteria. 3) Table the matter for additional information. ACTION REQUESTED: Offer a motion to approve the waiver of subdivision criteria, as presented, and move its adoption.
